That the City Recorder be, and he is hereby, instructed to give notice ~ ,~ i,~ to contractors and property owners as provided in Sections 52, 53, 54, 55, 5b, 5bB and 57 of thie i t ~, Charter of the City of Eugene, inviting bids for the construction of said sewers as prescribed in and in conformity to said plans and specifications. ~~ Section 3. That the Common Council declared that the said construction and the whole- I ~~ ~~~' thereof shall be let as one contract and the City Recorder is directed to state in the not- ' ~! The party whose bid is ~i '', accepted shall also execute and deliver to the City a good and sufficient bond, with one or ~~ CI mare sureties to be approved by the ~'ublic ~aVorks Committee of the City, in an amount equal I'~~i i to eighty per cent of his contract price, as security for the faithful and satisfactory ful- l fillment of his contract. i section 5. That each party bidding for said construction shall accompany his bid vi th ~ a certified check or cash in an amount equal to five per cent of the amount of his bid, as ~~ evidence of good faith, and said check, or the proceeds thereof, or said money shall be re- tained by the City until a written contract is finally made, and fully executed and the bond ~' i furnished and delivered, all to be done within ten days after the award of said contract. ~~ ~ Section 6. 1~1H "REAS the construction centem lated and f ~ p provided for by this ordinance ' q is a necessary construction and the sewer system to be improved is in such condition that I its immediate improvement is essential to its safety, it is, therefore, declared that an ~ emer enc exists and that it is necessa for the immediate '' g y ry preservation of the public peace, ,~ health and safety, that this ordinance take effect at once, and it is ordered that this act ~~, ~~ shall take effect immediately upon its passage by the Council and approval by the Mayor.
