HomeMy WebLinkAboutORDINANCE NO. 9186~~~ ORDINANCE N0. 9186 An Ordinance adopting the plans and specifications of the City Engineer for the con- struction of a sanitary sewer on the North side of First Avenue 'hest from the Polk :Street sewer to the UVest City Limits in the Cit~~ of Eugene, Oregon, directing the City Recorder to advertise for bids for the construction of said sewer in accordance with such plans and specifications, and notifying property owners when and where the bids therefor vrill be open- ed and considered. I~ WFR;REAS, the Common Council of the said City of Eugene, on the 28th day of June, 1948, ` ~ passed Ordinance No. 9185 for the construction of said sewer in the street described and ~ set forth in the title of this Ordinance, and said Ordinance was approved by the Mayor of t i the City of Eugene on the 29th day of June, 19l~8; and WHEREAS Section 3 of said Ordinance directed the City Engineer to make plans and speci- it I ~ fications for the construction of said sewer as specified in said Ordinance, and to file i j~ the same with the City Recorder, and i ~~ WHEREAS, in accordance vrith such instructions the City Engineer has prepared said t i plans and specifications and fYled the same with the City Kecorder of said City of Eugene I ~~ on the 2$th day of June, 1918, and the Common Council of the City of Eugene having examined I ~~ and approved the same; ~I THE CITY OF EUGENE DOES ORDAIN AS ALLOWS : i Section 1. That the plans and specifications of the City Engineer for the construe- . i ! II tion of a sanitary sewer on the North side of First I~venue Udest from the Polk Street sewer I~ to the Ul'PSt City Limits in the City of Eugene, and doing such work as may be necessary to I ~~ completelypconstruct the same, are in all things approved and adopted and the said sewer I ~ i ~~ shall be constructed in accordance therewith. li ~ Section 2. That the City Recorder be, and hw is hereby, instructed to give notice I to contractors and property owners as provided in Sections 52, 53, 5~, 55, 56, 56B and 57 i~ of the Charter of the City of Eugene, inviting bids for the construction of said sewers as i I~ prescribed in and in conformity to said plans and specifications. ~ t i I{ Section 3. That the Common Council declared that the said construction and .the whole I ~~ thereof shall be let as one contract and the City Recorder is directed to state in the l notice to contractors and property owners that said contract will be let in one contract, ~ ~ ~! and to also state therein the time and place vvhen and where bids for the construction of i ~ I ~~ said sewer will be opened and considered by the Common Council, and that at such time and ~ place property owners may file remonstrances against letting said contract. I ~ ~~ Section !~. That the party whose bid is accepted for said construction sign a contract l i for said work within ten days from the time of the receipt by him of the notification of the ~ ~i ~ acceptance of his bid, and the work thereon shall be commenced within ten days after the ~ letting of said contract, and shall be completed ti-rithin sixty days thereafter, unless an PI I ~ t ~~ I ~~ I ~32 extension of the time therefore be granted by the Common Council. The party whose bid is accepted shall also execute and deliver to the City a good and sufficient bond, with one or more sureties to be approved by the Public Works Committee of the City, in an amount equal to eighty per cent of his contract price, as security for the faitriful and satisfactory ful- fillment of his contract. Section 5. That each party bidding for said construction shall accompany his bid with a certified check or cash in an amount equal to five per cent of the amount of his bid, as e' of good faith, and said check, or the proceeds thereof, or said money shall be retained by the City until a written contract is finally made, and fully executed and the bond furnished and delivered, all to be done within ten days after the award of said contract. Section, 6. t`THEREAS, the construction contemplated and provided for by this f~rdinance is a necessary construction and the sewer sys+..em to be improved is in such condition that its immediate improvement is essential to its safety, it is, therefore, declared that an emergency exists and that is is necessary for the immediate preservation of the public peace, health and safety, that this Ordinance take effect at once, and it is ordered that this act shall take effect immediately upon its passage by the Council and approved by the Mayor.
