VI(HEREAS, heretofore and on the 10th day of May, 19t~8, the Common Council of the City of Eugene passed and Ordinance setting a hearing for June 28, 19It8, in the Council Chambers at . vrhich time and place protests and remonstrances could be heard as to the vacation of the following premises, to-ti~rit: The Alley running North and South between Charnelton and Lincoln Street from Tenth to Eleventh Avenue . 1 ~7HEREAS, a hearing was held pursuant to said Ordinance in the Council Chambers in the City Hall in the City of Eugene on June 28, 19118, at 7:30 o~clock F.M. and at said time the Council heard all objections; and ti°JHEREAS, all persons owning property abutting upon said area have consented to said vacation; THE CI`PY OF EUGENE DJES ORDAIN AS FOLLOV'7S: i Section 1. The Common Council of the City of Eugene finds that due and legal notice of the said hearing was published and posted as required by law; that no valid objection to said vacation has been made at said hearing, or filed; that the consent of the owner of the abutting property, properly acknowledged, has been filed i.n said proceedings; and that the public interest will not be prejudiced by the vacation of said area. .Section 2. That said hearing was held on June 28, 19l~8, at 7:30 o'clock P.M. in the Council Chambers of the City Hall in Eugene, &~ane County, Oregon, and no objections or remonstrances were made or filed. A Section 3. That the following described area, to-wit: The alley running North and South between Charnelton +~+ and Lincoln Street from Tenth to Eleventh Avenue I be, and the same is hereby, vacated, and the area so vacated, being an alley, shall revert to the abutting property pursuant to the staututes of the State of Oregon, reserving the right for the City to maintain, repair and operate its public utilities. Section 14. The recorder be, and he is hereby, directed to file a certif~.ed copy of this Ordinance with the County Clerk of Lane County, together with a map or plat of said property, and that a certified copy of the Ordinance shall be filed with the County Assessor, and another certified copy of the Ordinance shall be filed with the County Surveyor.
