'1'fHEREA5, the Common Council of the said City of Eugene, on the 27th day of September, 1y~8, passed Ordinance Pdo. 9226 for the construction of a sevrer in the alley described and set forth in the +„itle of this Ordinance, and sa_i_d Ordinance was approved by the P.4ayor of the City of Eugene on tha 28th day of September, 191,8; and ti1IIER.F~AS Section 3 of s~~id Ordinance directed the City Engineer to make plans and speci- fications for ttie constriction of said sevrer as specified in said Ordinance, and to file the same vrith the City Recorder, and ~I:~F,EAS, ~_n accordance u~rith such instructions the City I~gineer has prepared said plans and specifications and filed the slime with the City Recorder of said City of Eu~Tene on the 27th day of '.September, 1y1;8 , and the Common Corm cil of the City of ^ugme having examined and approved the same: Tim CITY OF I+.TJC7L;.dE TJOES ORTl~tITd AS F'JLLO',rrS: Section 1. That the p]_ans and specifications of the City Engineer for the construction gf. sevrer to be constructed in the follovring described alley, to-vrit: Alley between ~l1asY?ington and Jefferson atreet from Fifteenth to Nineteenth Avenue, in the City of Eugene, and going such work as may be necessary to completely construct the same, are; in a1.1 things approved and adopted and the said sevrer shall be constructed in accordance therevrith. Section 2. That the City Recorder be, and he is hereby, instr~ttcted to give notice to contractors and property ovrners as provided in ecti_ons 5z, 53, 54, J5, 56, 5613 and 57 of the Chdrter of the City of Eugene, inviting bids for the construction of said. sevrer as pre- scribed in and in conformity to said plans and specifications. Section 3 . That the Common Council declared that the said construction and the whole thereof sha]_1 be let as one contract and the City I~.ecorder is directed to s+.ate in the notice to contractors and property owners tha ~ said contr~.ct vrill Tie let in one contract, and to also state therein the time and place when and tivhere bids for the construction of said sevti^er will be opened and considered by the Common Council, and that at such time and place property owners may file remonstrances against letting said contract. Section 1~ . That the party whose bid is accepted for said construction sign a contract 1 for laid vrork within ten Says from the time of the receipt by him of the notifi cation of the acceptance of his bid, =end the work thereon shall be commenced tivithin ten days after the ldtting of said con tract, axld shall be completed within silty days thereafter, unless an ~74 extension of the time therefor be granted by the Common Council. The party vrhose bid is accepted shall also execute and deliver to the city a good and sufficient bond, with ore or more surities to be approved by the r'ublic ~lorks Commi ttee of the City, in an amount to eighty per cent of his contract, price, as security for th~; faithful and satisfactory ful- fillment of his contrac ~. Section 5. That each party bidding for said construction shall accompany his bid with a certified check or cash in an amount equal to five per cent of the amount of his bid, as evidence of good faith, and said check, or the proceeds thereof, or said moneZ• shall be re- tained by the City until a written contract is finally made, and ,fully executed and the bond furnished and delivered, a7_l to k~ done within ten days after the aVrard of said contract. Section 6. ZrtF~REAS, the construction contemplated and provided for by this ordinance, 'is a necessary construction and the seVrer system to be improved is in such condition that its immediate improvement is essential to its safety, it is therefore, declared that and emergency exists and that it is necessary for the i~medi.a to preser~~ation of the public peace, health and safety, that this ordinance t~}:e effect at once, and it is ordered that this act shall take effect i.a^mediately upon its passage b,y the Council and approval by the Mayor.
