THE CITY OF EUGEr1E DOES ORD~!IN AS FOLL0~15: That a certain document, three (3) copies which are on file in the off"ice of the City Recorder, of +.he Cii,y of Eugene, being marked and designated as Suggested Fire Prevention Ordinance, edition of 1917, recommended and published by the National Board of Fire LTnder- vrriters, be, and the same i_s hereby referred to and adopted as the Fire Prevention Ordinance of the City of Eug~e, a.nd by said reference and adoption, made a part of this ordinance, the same as i.f it vras fu7_ly set forth herein, provided, Certain sections of said Suggested. Fire Pr~;vention Ordinance as adopted by t.hi.s ordin- ante are hereby amended as follows, to-~°r! t: Part 1 erection 12 Secti on 123 i_s amended by adding to the end of this section the following: l~11 appli- cations for pe rmits required by this ordinance s}~ucll he made to the Bureau of Firms Preventi on in such form. and accompanied by a regulatory fee of $1.50. Part 2 Section 209 Section 209 is amended b;;r deleting the first sentence . Part 8 Section 802 Section 802 is ~;merded by inserting the following at t}lo beginning of the Section: (a) The use, storage and handling of compressed or. liquified petroleum and other gases, except acetylene, is prohibited in Fire lone l., of the Cite of Eugene. (b) The Chief of the Bureau of Fire Prevention, concurred in by the Chief of the Fire Departmer_t, may prohibit the use of liquified petroleum or other flammable gasses ~.~}ien in their opinion it would create a hazard or increase an ex_istin~; hazard in Fire Lones 2 and 3 of the City of Eugore. C_y~ ~'~~ 1 Part 9 Section n8o Section. 980 is amended by deleting the, entire section and ther^ is substituted and adopted a certain document, t}.ree (3) copies of ~.vhich are on file in the office of the City Reco.rddr, of t?~le City of Eugene, being marked and desigr_ated as Circulars No. 170, dated' October 10, 19l~0 and rio. 17E, dated august 1, 191.7, of the Association of American Railroads, which ~_s hereby referred to and adopted as Section 980 of the Fire Prevention Ordinance and by said reference and adoption, made a rr•~rt of this ordinance the same as i f it v~ras fully set forth herein. The a.fox~menti.oned circulars set forth the rejulations for Tank Gar Load- ing and Unloading Facilities. Part 9 ~ecti~n 981 Section 981 is amended b-r inserting at the end of the section the following: It shall be unlavrful for the o"^.zer or operator of a public garage, }?~zblic service station, or other public dispensary of flammable liquids (wi.th a flash point below 25°F. closed cup tester) to permit the deliver;T cr dispensing of such liquids into the fuel tanks of motor vehicles or other containers except by the o~:~ner, operator, or rebular authorized e:;'ployee thereof. Part 9 Section 986 Section 936 is amended by deleting the eighth (f3th) paragraph which starts with the words ~~ Tanks used for Class I liquids .... ~' Part 11 Section _1.101 Part lI is amended by deleting the entire part a.nd inserting the folloti^ring: SALE ATdD USE OF iRY CLF~TIING LI~~UIDS . Definition and Permit required. Dry cleaning shall be kno~~m as the art, act or process of cleaning or renovating wearing or other app~.rel, clothes and other fabrics or textiles, where inflammable liduid is used, or cleaning of anything with flammable liquids. T1o person shall perform any dry cleaning vrhether of a commercial or private nature, using more than one gallon of. flammable liqui d without obtaining a permit.: Part 11 erection 1102 CUndSTRUCTI0P1 OF DRY C?EF:ATING P.OCTaS. B1o dry cleaning, as herein defined, shall hereafter be done for hire v~rithin tY:e City of Lut;ene, except in a separato building or section thereof, cut off by a fire v~rall constructed of brick stone, concrete or other fire-resisting material, any opening; in w}li ch sha.ll be protected b~- wire glass and metal sash, standard fire doers, ~ curtains or shutters. .Such building or section shall be not over one story and shall not exceed sixteen (1G) feet in height and constructed of masonry. 'der=; shall be no basement or open space beneath the floor. All doors shall have raised sills at least six inches above the highest point on the floor . All v~rindows, doors or other openings abutting on ad- jacent property, a street, alley or court of lvidth less than thirty (30) feet, stall be provided with wire glass and metal sash and approved fire doors, curtains or shutters . Such building shall be well ventilated at or near the floor level, and no lights shall be permitt- ed within such building or section except vapor-proof electric lights installed in accordance vrith the City of Eugene Electrical Code. I ~'78 Section 1103 fart 11 SH•~FTING AND I~~~IO'IC)RS. No motor, stove or shark emitting device of any description shall be permitted in a room for dry cleaning. All shafting necessary for the operation of machin- ery of any washing, drying or distilling room shall enter said room not less than six feet above floor level, Part 11 Section 1101 S~RAGL OF IPIFLI~It~!r:ELr LICZUTAS. Inflammable liquids shall not be handled in open con- tainers and all infl~nmable liquids shall be pumped direct• into all machines, and all mach- ines shall be provided r.2th a s,ystPm of pipes whereby all inflammable liquids can be drained into underground storage system. Inflammable liquids shall be removed from wasting machines, stills and extractors -when machines are not in actual operation. Z'dhen steam is available, there sha7.1 be a steam line not less than one (1) inch in diameter provided for fire-exting- wishing purposes in the washing, drying and distilling rooms with suitable controlling valves arranged on outside of room. There shall also be provided one approved fire extinguisher of not less than two and one-half gallons capacit,,~ for each washing, drying. and distilling room. Section 1105 Part 11 SId0I~I1`1G PROHIBITED. Smoking is hareby prohibited in any vrashing, drying or distilling room, and notices to that effect shall be posted in conspicuous places. Part 17 Section 1702 Part 17 is amended b,y deleting Section 1702 ar:d inserting the following: GARAGES-- DEFINITION. A private garage is a building or portion of a building- in which one or more vehicles or other self-propelled vehicles or other vrheeled machines using volatile inflamm- able liquid for fuel or power shall be housed or. kept for private use and in vrhich no bus- iness or industry connected directly or indirectly vrith motor vehicles is carried on. PART 17 Section 1703 Part 17 is amended b~l deleting Section 1703 and inserting the follovri.ng: A public gar- age is any garage to which the public is invited anc~or has access to for a purpose within the scope of the business that is carried on therein, and/or where are housed for rent, care, repair, demonstration, storage or sale, four (l.~) or more motor vehicles or self-propelled vehicles or other vrheeled machines using volatile inflammable linuid for fuel or povrer. Part 17 is amended by deleting Section 1701 and inserting the follos~ing: COPISTRUCTIOPd. Ido person;, fi.rrn or corporation shall hereafter establish, constrict or operate a public garage unless the building has exterior vral.ls of masonry constr~~.ctic;n, vrith fireproof flocrs, and all v~indows, doors or other openings abutting on adjacent property, or on a street, alley or court of less than thirty (30) feet in vridth, he provided vrith vr_i_re glass and. r.:etal sash, afproved fire doors, curtains or shutters; provided, no b~zilcline occupied as a garage at the time of the passage of this ordinance shal_1 be ~iffected hereby, except the provisions relat- ing to ins~cticn and examination of building and. premises, vrhich provisions shall apply to a)1 buildings novr or hereafter used or occupied as garages; and, provided, that no enlarge- 1 ~'~9~ ments, extension, alteration, replacement or reconstruction of any building or any part thereof, occupied as a public garage, other than repairs as defined herein, shall be made except in conformity with the provisions of this ordinance; provided, further, the State I''ire ~~arshal.. may issue a permit for the e~_hibi_tion of automotive vehicles in buildings other than of masonry construction when such precautions and safety plans as designed and declared by the State Fire I,iarshal~ shall have been complied with by the applicant for such permit. All wiring shall be installed in accordance vrith, the Bugene Electri- cal Code . Part 28 section Part 28 is amended by deleting the entire part and inserting the following: PEPTA.LTIES FOR VT.OL!1TIOT1. kn~T person, firm or corporation, w}zich shall violate any of the provisions of this ordinance or fail to compl;r vrith the terms of any regulation thereunder, shall upon conviction in the 1'~?uni_cipal Court, pay a fine of not to exceedw100.00 acid the costs of the prosecution, ?xid mar be imprisoned ir_ the City Jail ono da~r for each 4;2.00 of the fine unpaid.
