An Ordinance to cox.;;truct a sarzit~ry :;ev~~o_r ,n the follo~~ring described street:

in the City of Eugene, a.nd declaring an emergency;

erection 1. The Common Council of the Cit,;T of Eugene does hereby declare its intention
to build ~.~nd construct a sanitar^,r sevrer in the follov~ring described s+,reet:
E~:st Side of "~Ia.shington Street from Tzr:;ntythird l~verzue to Twrentyfcurth t~venue,
in the City of Eugene, Oregon.
Section 2. That th:~ said sewer shall ~ constructed of first class cement, vitrified
pipe, or other suitable material according to the clans -ind specifics ti ens of the City
ling ineer.
Section 3. The City Engineer is hereby direc+~d to surve;,= cut the locat~_or. of said
sewer, and prepare plans and specifications ar~d a profile thereof and to file the same ~rrith
the City Recorder.
Section ~;. The construction of s_~id sevrer shall include all necessary- manholes, v~ryes,
and all things necessary and convenient for the complete building thereof.
:Section ~. Tha.t the cost of the construction of said sevrer shall be borne by arzd shall
be assessed. to the lots, parts of lots and acreage properly liable therefor, and benefitted
by the construction thereof in proportion to the benefits accruing to each lot,, part of lot
or acreage properly liable as shall be ascertained and detPx:r:irzed by the Common Council of
the City of Eur;ene, eycept street intersections, vrhich Trill be p~~.i_d for by thc; City, and
there shall be included as apart of the costs thereof, the Engineer's charges for his
services thereon not to exceed ~ of the coni;ract price therefor.
Section 6. Upon the completion of the sevrer, tYze Conunon Council shall ascertain the
cost thereof and assess +,hat portion thereof against the lots, parts of ]_ots or acreage proper

liable therefor or benefitted thereby in accordance vrith the provisions of the Charter of
the City of Eugene, and vrher. said costs are so assessed the same sha]_1 be entered in the
City Lien Docket, and be further enforced as provided by the City Charter.
Sect ion 7 . 'I~7zereas, the improvement contemplated and provided for by this ordinance
is a necessary improvement end the district of the cit,~r in which said sevrer is to be con-
structed is in sucha condition that the construction of said sewer is essential to the health
and safety of the residents of said district, it is, therefore, declared that an emergency
exists and it; is necessary for the inmediate preservation of the public peace, health and
safety, that this ordinance take effect izr!m<:diately upon its passage by the Council and
approval by the I~.2ayor.
