An Ordinance adopting the plans and specifications of the City Engineer for the con-
struction of a sewer in the follovrin~; described street:
East ;side of ~',(ashin~;ton_ Street from T~rrentythird Avenue to Tvrentyfourth Avenue,
in the City of Eugene, Oregon; directing the City Recorder to advertise for bids for the
construction of said sewer in accordance with such plans and specifications, and notifying
property ovrners vrhen and ~n*here tY~e bids therefor will be opened and considered.
"IHEREA~ , the Common Council of the s~iid Cit~T of Eugene, on the ,27th dad of September,

1948, passed Ordinance hTo . 9229 for the construction of a sevrer in the street described and
set forth in the title of this Ordinance, and said Ordinance was approved b ~ the Mayor of
the City of Eugene on the 28th day of September, 19t~8; and

Section 1. `j'ha.t the plans and specifications of the City Engineer for the construction
of a sevrer to be constructed in the follovring described.street, to-wit:
East Side of ~ilashington Street from T;"rentythird ;.',venue to T~rentyfourth ~•~venue,

in the City of Eugene, and doing such work as may be necessary to completely construct the
same, are in all things approved end adopted and the said sevrer shall be constructed in.
accordance therewith .
Section 2. That the City Recorder be, and he is hereby, instructed to give notice to
contractors and property owners as provided in Sections 52, 53, 54, 55, S6, 56B and 57 of the
L"harter of the City of Eu~ne, inviting bids for the construction of said sewer as prescribed
in and in conformity to said plans and specifications.
Section 3. That the Common Council declared tha% the said construction and tI~ whole

thereof shall be let as one contract and the City Recorder is directed to state in the
notice to contractors and property owners that said contract vr:i11 be let in one contract,
and to also state therein the time and pl<.tce when anti ~^~here bids for the construction of
said sewer will be opened and considered by the Common Council, and that at such time and
place property otivnars may file remonstrances against letting said contract.
Section h. That the party vrhose bid is accepted for said construction sign a. contract
for said vrork within ten days from the time of the receipt b~T him of the notification of. the
acceptance of_ his bid, and the vrork thereon shall be commenced within ten days after the
letting of said contract, and shall be completed within sixty days thereafter, unless an

extension of the time therefor be granted by the Common Council. The party whose bid is
accepted shalt also execute and delver to the city a good and suffici_er_t bond, with one
or more surities to be al~pr. owed by the Public ti~7orks Committee of the City, in an amount
equal to eighty per cent of his contract, price, as security for the faithful and satisfact-
cry fulfi llment of his contract.
Section ~. That each party bidding for said construction shall accompany his bid with
a certified check or cash in an amount equal to five per cent of the amount of his bid, as
evidence of good faith, and. said check, or the proceeds thereof, or said money shall be re-
tained by the CitS- until a written contract is finally made, and fully executed and the
bond furnished and delivered, all to b~ done v~rithin ten days after the award of said contract.
section 6. ~dVIiERL~;A,S, the construction contemplated and provided for b~* this ordinance,
is a necessar~r construction a.nd the sewer system to be unproved is in such conditior_ that
its immediate improvement is essential to its safet~T, it is therefore, declared that ar_
emergency exists and that it• is r_ecessarv for the immediate preservation of the public peace,
health and safety, that this ordinance take effect at once, and it is ordered that this act
shall take effect immediately upon its passage by the Council and approval. by the Mayor.
