HomeMy WebLinkAboutORDINANCE NO. 9234r~~~ ~ ORDINANCE N0. 9231} An Ordinance initiating the vacation of the follovring described premises, to-Vrit: Fourteenth Street East betvreen the Easterly line of University Street and the Westerly line of Onyx :Street, in the City of Eugene, Lane County, State of Oregon, and the alley running North and South in the block bounded by thirteenth Avenue and fourteenth Avenue, and University and Onyx Street, and calling a hearing and directing that notice be gi.vE:n. THE CITY OF EUGL~tE DOES ORDAIN AS FOLLOWS: i Section 1. The Common Council of the City of Eugene hereby initiates vacation proceed- ~ I~ I ings on its own authority vrithout Y~tition or consent of the property owners excepting as 1 provided by statutes of the follovring described property, to-wit: Fourteenth Street East between the E~rsterly line of University Street and the I ~ Westerly line of Onyx. Street, in the Citzr of Eugene, Lane County, State of Oregon, ~ ~ and the alley running North and South in the block bounded by Thirteenth .venue I i and Fourteenth Avenue, and University and Onyx Street. ~ t Section 2. A hearing shall Yee held upon the proposal to vaca+,,e said premises as. herein f provided and said hearing shall be held on the 22nd day of November, 19l~8, at 7:'30 o'clock M P.M. of said day, at which time all persons will be heard upon objections or suggestions with I~ reference to the vacation of said portion of said street and at said time the Council will providE i for the vacation of said premises or deny such vacation, and in case the vacation is made will f make provisions for any damages sustained by local assessment . Section 3. The City Recorder be, and he is hereby, required to immediately publish for four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of the proposed vacation. Such notice shall give the description of the area to be vacated as ~I ':~ herein set out, and state the date when this ordinance was passed; the name of any petitioners ,. ;, petitioning for said vacation; the date vrhen the said petition, together with any objections I~ ., i~ or remonstrances which may be made in vrriting and filed with the pity Recorder prior to the I! i date of said hearing, will be heard and considered. ~~ ~~ Section 1~. The City Recorder shall for..thwith and within five days after the first pub- r lication of said notice, post or cause to he pasted at or near each end of said proposed va- ~I cation, a copy of the foregoing notice, which shall be headed "Notice of Street Vacation" and ~,l which notice shall be posted in at least two conspicuous placE:s in such proposed vacation or such area. The posting and the first da;~ of publication of such notice shall not be less than twenty- eight days before the time set for hearing.
