ORDINANCE IdO. 9269
An Ordinance providing for, authorizing and directing the inclusion in all improvement
assessments and. improvement charges and liens hereafter levied by the Common Council of the
City of Eugene, as a part of the cost thereof, a sum of money equal to five per cent of the
amount paid the contractor for said improvement, to cover the cost of engineering, and a
sum of money equal to five per cent of the ariount paid the contractor for said improvement
to cover the cost of interest on vrarrants, advertising, postage and supplies for mailing
notices of assessments ar~ci directing the City Recorder-Treasurer to enter said charge in
the lien docket of the City of Eugene and to collect the same from the property owners
benefitted by said improvement in the same proportion and manner as other improvement costs
are collected, and repealing all ordinances and parts of ordinances in conflict herewith,
and declaring an emergency.

Section 1. That the COfimon Council of the Cit,~r of Eugene shaJ_1 hereafter include
in all assessment ordinances as a part of the cost of any improvements incurred in the
construction, improvement or repair of streets, alleys, sidewalks and -sewers, a sum of
money equal to five per cent of the amount paid- to the contractor for the cons traction
of said improvement as a charge to cover the cost of c~~-~ineer:Y~g, and. a sa^r of mo.zey
ec;ual to f:i_va o:;r cent of the amount paid to the c^ntractor for said improvement to
cover the cost of interest on vrarrants, advertising, postage and slappll_es for mailing
notices of assn:ssments. That said charges shall be included as a part of ttie cost of
the improvement and shall be declared by the Common Council to be an obli r=ation of the
property ovrner benefitted b,y said improvement in the proporticn provided bar the charter
and ordinances of tY~ City of Eugene, and further directing that said charges shall be
included as alien upon the real property benefitted by said improvement, and payable
by sai d property ovrner in the same manner as the remainder. of the cost of said improvement.
Sectit~n 2. The Cit-•r Recorder-Treasurer of the City of Eugene is hereby authorized
and idrected to i.ncl.ude said charges sit forth in Section 1 in all improvement. Ziens and,
after the cost of said i_rrprovement or repairs has been ascertained and the proportionate
share thereof allocated to each lot, part of lot, and acreage liable therefor, to enter

the same in tkie docket of City Liens for the Cit;r of Eugene, together with a
s tatemen t containing a description of each lot, part of lot or acreage properly liable
for such improvement, and the name of the owner or reputed ovmer thereof, or that the name
of the oHrner is unknown.
Section 3. That the charges herin provided for shall hereafter be deemed to be a
part of the cost of an?r construction, improvement or rep~1r in the City of Eugene, and
shall be subject to all charter, ordinance and statutory. provisions pertaining to the
assessment and collection of the cost of said improvements.

Section L~. That all Ordinances and parts of ordinances in conflict hereVrith be,
and the same are hereby repealed.
Section ~. V'•rhereas, theme is, at the present time, extnesive improvements being made
in the City of Eugene and that, in connection therewith, there are various costs being
incurred by the City of Eugene, and that it is necessary that said costs be included as a
part of the cost of said improvements, it ;_s hereby declared that an emergency e~i sts, and
it is necessary for the immediate preservation of the peace, health and safety of the City
of Eugene that this ordinance take effect immediately upon its passage by the Common Council
and its approval by the Mayor, and it is so ordered.
