ORDItIA.I~fGE N0. 9286 Arr Ordinance adopting the plans and specifications of the City Engineer for the ~... construction of. a sanitary sewer in the alley betv~reen Harris and Potter Street f ran Twenty- eighth Avenue to Twenty ninth Avenue in the City of Eug~e, Oregon, directing the City Recorder .to advertise for bids for the constructio~i of said sewer in accordance with such plans and specifications, and notifying property -owners when and where the bids therefor will be opened and c~sidered. 1~KEAS, the Common Council of the said City of Eugene, on the 28th day of larch, 19~t9, 1 passed Ordinance No. 9285 for the construction. of said sewer in the street described and set f orth iri the title of this Ordinance, and said Ordinance was approved by the Mayor of the City of Eug cme on the 29th day of March, 1919; and VJ~iEREAS, 5ectiar~. 3 of said Ordinance directed the City Engineer to make plans and specifications for the c ons true tion of said s ewer as specified in said Ordinance, and to file the same with the City Recorder , and ~hfHhREAS, in accordance witty such instructions 'the City ~%ngineer has prepared said plans and specifications and filed the same Frith the City Recorder of said City of Eugene on the 28th day of March, 19l~9, and the Common Council of the City of Eugene having examined and approved the same; THE CITY OF EUGENE DOES ORDAIN AS FnLLOti~S: Section 1, That the plans and specificatirns of the City Engineer for the castruction 1 of a sanitary sewer on the alley between Harr9.s Street and Potter Street f ran TWenty~-eighth Avenue to Twentyninth Avenue, in the City of Eugene, and doing such vrork as may be necessary to completely construct the same, are in allthings approved and adopted and the said sewer shall be constructed in accordance the rewith. Section 2, That the City Recorder be, and he is hereby, instructed to give notice to contractors and property owners as provided in Sections 52, 53, 5t~, 56, 56B and 57 of the Charter off' the City of Eugene. inviting bids fcr the aonstructicn of said sewers as prescribed in and in c onfirmity to said plans and specificatims. Section 3. That the Ccanmon Crn:ncil dechred that the said construction and the whole thereof shall be let as one ccr!trrtct and the City Recorder is directed to state in the notice to contractors and property owners that said contract will be let in one contract, and to also state therein the time and glace when and where bids for the constructial of said sewer will be opened and oensidered by the Common Council, and that at such time and place property owners may~.le remonstrances against letting said contract. Section ~.t. That the party whose bid is accepted for said construction sign a contract 1 for said s~ork within ten days from the time of the receipt by him of the ro tification of the acceptance of his bid, and the work thereon shall be commenced within ten days after the letting of said contract, and shall be completed vrithin sixty d~~s thereafter, unless an extension of the time therefor be granted by the Common Council. The party whose bid is accepted shall also execute and d eliver to the City a good and s uff3~cient bond, with one J ~~~ ~ or more sureties to be approved by the Public 1Rorks Committee of the City, in an a mount equal ,. . to eighty per cent of his ec~tract price, as security for the faithful and satisfactory ' I fulfillment of his c~tract. Section 5. That each party bidding for said construction shall accompany his bid with a certified check or c ash in an;<amount equal to five per cent of the amount of his bid, as evidence of good faith, and said check, or the proceeds therEOf, or said money shallt~e re- I ~ tained by the City until a wariaten contract is finally made, aryl fully executed and the 1_ond ~. i furnished andc~livered, all to be done within ten days after the award of said contract. I ~ Section 6. V~RE:AS, the construction contemplated and provided for by this ordinance ~~ is a necessary construction and the sewer system to be improved is in such condition that its irnnediate improvement is essential to its safety, it is, therefore, declared that an emergency exists and that is is necessary for the immediate preservation of the public peac::, health, i I and safety, that this act s~eall take effect immediately upon its passage by the Common Cotmcil ~ and approval b y the Mayor .
