HomeMy WebLinkAboutORDINANCE NO. 9308~8~1 ORDIPI,APJCE N0. 9308 Are Ordinance to construct a sanitary sewer on Emerald Street from Twentysixth to Tw~:hty- eighth Avenue in the City of Eugene, Oregon, and declaring an en ergency. THE CITY OF EUGEnTE IYJES ORDATPI AS FOLLOVdS: Section 1. The Common Council of the City of Eugene does hereby declare its intention to build and construct a sanitar~T s sorer on Emerald Street from Tarentysixth to Twentyei.ghth Avenue in the City of Eugene, Oregon. Section 2. That said sewer shal]_ be constructed of first-class cement, vitrified pipe, or other suitable material according to the plans an d specifications of the City Engineer. Section 3. The City Engineer is hereby directed to surrey out the location of said 1 sewer, and prepare plans and specifications an~~ a profile thereof, and to file the same with the City Recorder. Section ~. The construction of said sewers s hal]_ include all necessary man holes, wyes, and all things necessary and convenient for the complete building thereof. Section ~. The coat of the cons tru8tio21 of said sewer shall be borne b~r and shall be assessed to the lots, parts of lots and acreage properly liable therefor, and benefi.tted by the construction thereof in proportion to the benefits accruing to e ach lot, part of lot or acreage properly liable as shall b e ascertained and determingd by the Cor;mon Co~ICil of the City of Eugene, except street intersections, which will be paid for by the City, and there shall included as apart of the costs thereof,,- the Engineer's charges for his services thereon, not to exceed 5~ of the contract price therefor, and charges for interest on improvement wart-~ ants, adveutising for bids, postage and supplies for mailing notices of assessments not to exceed 5~ of the contract price therfor. Section 6. Upon the, completion of the sewer, the Common Council shall ascertain the 1 cost thereof and assess that protion thereof against the lots, parts of lots or acreage pro- perly liable therefor or benefitted thereby in acc ordance with the provisions of the Charter of the City of Eugene, and when said costs are so assessed the same shall be entered in the City Lien Docket, and be further enforced as provided by the City Charter. Section 7. V'1HERE,AS, the improvement contemplated and provided for by this ordinance is & necessary improvement and the district of the Cit~r inwhich said sewer is to be con- structed is in such a condition that the construction of said sewer is essential to the health and safety of the residents of said district, it is therefore declared that an emerg- ency exists and it is necessar~r for the immediate preservation of the public peace, health and safety, that this ordinance take effect irmlediately upon its passage by the Council and approval by the Ma ~~r .
