An Ordinance adopting the plans and specifications of the City Engineer for tkie oonstruc-`
tion of a sanitary sewer on Emerald Street from Tvrentysixth Avenue to Tvrentyeighth Avenue in
the City of El.~.gene; Oregon, directing the City Recorder to advertise for bids for the construc-
tion of said sevrer in accordance T~rith such plans and specifications, acid notifying property
owners when and where the bids therefor will b e opened and cons idered ..
WHEREAS, the Common Council of the said City of Eugene, on the 18th day of April, 199,
passed Ordinance No . 9308 for the cons traction of said sewer in'the street described and set
forth in the title of this Ordinance, and said Ordinance eras approved by the Ddayor of the City
of Eugene on the 19th day of April, 19I~9; and
WHEREAS, Section 3 of said Ordinance directed the City Engineer to make p]_ans and speci.-
fications for the construction of said sewer as specified in s aid Ordinance, and to file the
same with the City Recorder, and
WHEREAS, in accordance with such instructions the Cit~T Engineer has prepardd said plans
and specifications and file the same with the City Recorder of said City of. Eugene on the
day of April, 1Q49, and the Common Council of the City of Eugene having examined and
approved the same;
THE CITY ~OF EUGEr1E DOES ORDAIN AS FOLLOt~tS:
Section 1. That the plans and specifications of the City Engineer for the construction
of a s anitary s ewer on Emerald Street frg~m Tvrentysixth to Twentyeighth Avenue in the City of
Eugene, and doing such work as may be necessary to completely construct the sane, are in all
thi~igs approved and adopted and the said -.sewer shall be constructed in accordance therewith.
Section 2; That the City Recorder be , and 'pis is hereby, instructed to g ive notice to
contractors and property owners as provided in Sections 52, 53, ~~t, 55, 56, ~6B and 57 of the
Charter of the City of Eugene, inviting bids f or t he, .constructiol of said s evrers as prescribed
in and in conformity to said plans and specifications .
Section 3. That the Common Council declared that the said c onstruction and the whole there-
of shall be let as one contract and the City Recorder is directed to state in the notice to
contractors and property. owrners that said crntract will be let in one contract, and to also
state therein the tir:e and place when and wherebids for the construction of said sevrerw ill
be opened and considered by the Cor~mon Council, and that at such time and place property
owners may f~1e remonstrances against letting said contract.
Section 1G. That the party whose bid is accepted for said construction sign a contract
for said work within ten days from the time of the receipt by him of the notification of the
acceptance of his bid, and the vrork thereon shall be commenced within ten days after the
letting of said contract, and s hall b e completed within s ixth da.gs:= thereaf~t~r, un~.ess an
extension of the time therefor be granted b y the Common Council. That the party whose bid
is accepted shall also execute and deliver to the City a good and sufficient bond, with one
or more sureties to be approved by the Public Works Committee of the City, in an'amount equal

to eig~nty per cent of his contract price, as security for the f aithful and satisfactory ful-
fullment of his contract.
Section 5. That each party bidding for said construe tion shall a ccompany his bid ~ri th a
certified check or cash in an amount equal t o five p.er cent of the amount of his bid, as ev-
idence of good faith, and said check, or the proceeds thereof, or said money shall be retained
bar the City until a written contract is finally made, and fully esecuted and the bond furnished
and' delivered, all to be done within ten days after the avrard of said contract.
Section 6. 11~HEREAS, the construction_,-eontemplated..iand -provided for by this Ordinance is
a nece::ssary construction. and the sewer systems to be improved is in such condition that its
immediate improvement is e esential to its safety, it is, therefore, declared that an emergency
exists and that it is necessar~r for the ir,.mediate preservation of the public peace, health
and safety; that tha_s ®rdinance take effect at one, and i t is ordered that this act shall
take effect immediately upon its p2:ssage by the Council by the Council and approval by the
~a,jor .
