1~n Ordinance to construct a sanitary sewer on Onyx Street from T~ventysixth t o Twentyei~hth
Auenue in the City of Eugene, Oregon and declaring an emergency.

Section 1. The Common Council of the City of Eugene does hereby declare its intention to
build and construct a sanitary sewer on Onyx S+reetfrom Twentysixth to Twsntyei~hth Avenue
in the Cit,,y of EugP.ne, Oregon.
Section 2. That said sewer shall be constructed of first-class cement, vitrified pipe, or.
other suitable mater9_al according to the plans and s pecifications of the City Engineer.
Section 3 . The City Engineer is hereb~~ directed t n sure*ey out tye location of said s ewer
and prepare plans and specifications and a profile thereof, and to file the same with the City
Recorder.
Section ~ . The construction of said s;e'Ners shall include all necessary manholed, wyes,
and all things necessary and convenient for the comple to building thereof .
Section 5. The cost of the construction of said s ewer shall be borne by and shall be
assessed to the- lots, parts of lots and acreage properly liable therefor, and benefitted by
the construction thereof in proportion to the benefits accruing to e ach lot:, part of lot or
acr^?.~e roperly liable a.U :hall be ascertained and determined by the Common Council of the
City of Eugene, except street intersections,~iich will be paid for by the City, and there shall
be included as a part of the costs therF.of, the Engineer's charges for his services thereon,
not to exceed 5~ of the contract price t'n.erefor, and c harges for interest on improvement warr-
ants, advertising for bids, postage and szpplies for mailing notices of assessments not to ex-
coed 5N of the contract price therefor. '
Section 6. Upon the completion of the severer, the Common Council. sYiall ascertain the
cost thereof and assess that portion thereof against the lots, parts of lots or acreages pro-
perly Liable therefor or benefitted thereb;~ in accordande w ith the provisions of the Charter
of the City of Eugene, and when said costs are soassE,ssed the same shall be entered in the
City Lien Docket, and be further enforced as provided by the City Charter.
Section 7. V'IHEREAS, the improvement contemp]_ated and provided for bythis ordinance is
a necessary improvement and the district of the City inz~hich said sewer i-s to be constructed
is in such a condition that the construction of said sevrer is essential to the health and
safety of_ the residents cf said district, it is therefore declared that an emergency exists a.nd
it is necessary for the immediate preservations of the public peace, health and safety, that
this ordinan oe take effedt immediately upon its passage b;T the Council and approval by the Mayor.
