WHEREAS, the Cor,mon Council of the said C~ ty of Eugene, on thel~ith day of April, 1949, passed Ordinance No. 9310 for the construction of said sewer 3.n the street described and set forth in the title of this Ordinance, and said Ordinance tiaras approved by the Mayor ~of the City of Eugene, on the 19th day of April, 1849; and WHEREl~i, Section 3 of said Ordinance directed the City Engineer to make plans and spec- l ifiications for the construction of said sewer~~. as specified in said Ordinance, and to f ile the same with the City R&corder, and WHEftEAS,i_n accordance with such instructions the City Eng':_neer has prepared said plans and specifications and filed the same with the City Recorder of said City of Eug c31e on t Y~ day of April, 1949, and the Co. men Council of the City of Eugene having examined and approved the same; Tl-~ CITY OF ETJGEPIE DOES ORDATPI AS FOLLCN+(S: Section 1. That the plans and specifications of the City L:ngineer for t he tens true tion of a sanitary sewer on Onyx S~reet froin_ Twentysixth to T~rehtveighth Avenue in the City of Eugene, and doing such vrork as may be necessary to completely construct the same, are in all things approved and adopted and the said sewer shall bt crnstrueted ir. a ccordance therewi th. Section 2. That the City Recorder tie, and he is hereby, instructed to give notice to contractors and pro;erty owners as provided in Sections 52, K3, 54, ~K, 56, 56B and 57 of the Charter of the City of Eugene, inviting bids for the crnstruction of saids ewers as pre- scribed in 'and in c nformity to said plans and. s pecifieati ens. Section 3. That the Common Council d eclared that the said construction and the whole thereof shall. be let as one contract and the City Recorder is directed. t o stcite in the notice to contractors and propert~r owners that said contract will be let in one contract, and to also state therein the time and place when and ~h ere bids for the construction d' said s etiver will be opened and considered b,y the Common Council, and that at such time and place property owners may file remonstrances against letting said contract. Section 4. That the part;.T whose bid is accepted for said construction sign a contract 1 for said work within ten days from the time of the receipt by him of the notification of the acceptance of :his bid, and the word thereon shall b e commenced within ten days after the letting of said ccmmtract, ari~ shall be completed within sixty days thereafter, unless an extension of the t ime therefor be granted by the Common Council. The party v+d~se b~d;is accept- ed shall also execute andcbliver to the City a good and sufficient bend, v~th ane or more suret ~8b to be approved by the Public Works Committee of the City, ?.n an amount equal to eighty per cent of his contract price, as s ecurity for the faithf~il and satisfactory fulfillment of his contract. Section 5. That each party bidding for said construction shall accompany his bid with a c ertified check or cash in an amount equal to five p~ cent of the amount of his bid, as e vidence of good faith, and said check, or the proceeds thereof, or said money shall be retained by the City until a 1Tritten c ontrac+~ is finally made, and fully executed and the bond furnished and delivered, all to be done vrithin t en days after the award of s aid contract. Section 6. ~1I~REAS, the construction contemplated and provided for by this Ordinance is a necessary ern struction and the sewer system to be improved is in such condition that its immediate improvement is essc;ntial t o its safety, it is, therefore, declared that an emergency exists and that it is necessary f or the immediate pros ~rvation of .the public peace, health and safety, that this Ordinance take effect at once. and it is ordered that this act shall take effect immediately upon its passage b;l the Council and approval by the Mayor.
