' ORDIATANCE N0. 9320
An Ordinance regulating the playing of pool, billiards, cards or any such similar game, and
regulating any rcom or resort inv~.ch such games are played in the City of Eugene and" fixing a
license on card tables, pool tables and billiard tables, establishing method of investigation of
applicant for license, fixin g a penalty and declaring anemer gency, and repealing conflicting
ordinances.
THE CITY OIi' EU G~?NE DOES ORDAIN AS FOLLO~YS
Section 1. A regylatory license fee is hereby established for card tables, pool tables and
billiard tables as follows:
For the first .card table, X10.00, each additional table, ~n5.00. For the first pool table

X10.00, each additional table, .?5.00. The license fee shall be paid armually in advance on the

Section 2. It shall be unlav~rful to inst~?11, to keep or maintain in any pool room, card room
or similar room or resort any card table, ;pool table, or billiard table, without having first
applied for and received from the City Recorder a license therefor.
Section 3. All applications for said licenses shall be approved by the Common Council
of the City of Eugene before a license is issued. Upon receiving an application, the Recorder-
Treasurer of the City of Eugene shall submit the application to the Chief of Police. The Chief
of Police shall investigate the statements contained in the application and make such oilier and
further investigation as he may deem necessary, and within tvro t^reeks after the receipt of the
application, he shall return the application to the Recorder-Treasurer, together with a report
of hi.s findi~:gs cone~r'"Wing the statements contained in the a.pplicaticn and a record, if any,
and pertaining to the arplicatnt or t o the premises concerning any violation of either the
Federal or State statutes or municipal ordinances by such applicant or upon such premises. A
copy of such record shall be attached to his report. The Reocrder-Treausrer shall, upon receipt
of the report. of the Chief of Police, transfer the report, application and any accompannyin~
exhibits attached theretom to the Common Council for approval or rejection.
Section La.. The owner of a license to maintain and operate card room is given-the right to
rene~ral or reissuance o f such license at the same or at a different place of business, upon
full compliance t~~rith the ordinances oP the City of L'ugene governing the licensing of card rooms,
but shall have nn prnver to sell, assign or convey right of renez=ra.l or reissuance to any other
perso~i. Hovrever, the Council may, in its descretior., permit the salo and trasfer of a license
in the' case of the death or b<;nkruptc~l of the licensee, or upon the presentation of bona fide
petition of sale, if its investigation reflects that the pr ospective purchaser can qualify under
terms of this ordinance.
Section 5. ATo pool room, card room or similar resort in the City of Eugene shall be per-

tied to have or maintain any booth, enclosure or room other that its main room, in which cards,
dice or other games may. be "played, and it is herby made unlativful for any person or persons to
tain in any poolroom, cardroor~, or simi lar resort in the City of Eu .gene, any booth, enclosure,

screened off portion of such room or other obstructed portion shut off from observation, from
its main room in which games of cards, dice or other devices can be played shut off from ob-
ser~aation from any portion of the main pool rooza, card room or sililar place. All rooms must
be open and accessii~le at all times to inspection.
Section 6. It is hereby made unlawful for any person or persons to ~~ay cards, dice or
other games, or permit the same to be done in any pool rocm, enclosure, booth or behind any
screen or other obstruction, it being the purpose of this ordinance to require all ~ ame s
herein described to be played in such a manner that they may at all times be inspected anal
seen from all and any porti n of the pool room, card room or similar place.
Section 7. It shall be unlawful for any person, firm or corporation z,rit bin the City of
Eugene, to ~:eep open on the first day of the week, commonly called Sunday, any billiard room,
pool room, dance hall or any place vrhere any game of chance is played or any public place where
similar
any dame of cards is played f'or amusement or othertivise, or any public place of amusement.
Section 8. Any officor, manager, employed; or agent having control of any pool room, card
room, or similar resort izi the City of Euger_e, which shall be maintained or ;operated in vio-
lation of the provisiavs of this ordinance shall be deemed guilty of a violation of .the terms of
this ordinance and punishable as hereinafter provided.
Section 9. Any person violating any of the provisions of this ordinance shall be subject,
upon conviction in the ~4unicipal Cou rt, a fine of not exceeding two hundred dollars, and for
costs of prosecution.
Section 10. 1~~"tIEFrEAS, there are orl bane, at the present time, applications for the issuance
licenses for card rooms and billiard rooms, and ~~~~REAS, it is the belief of the Common Council
that further issuance of 1censes to card rooms and billiard rooms within the City of Eugene
without investigation would endanger the peace, health and safety of the City of Eugene,
IT IS THEREFORE DECLl,.RED that it is necessary for the immediate peace, health and safety
of the City ol^ Eugene that this ordinance take effect at ones, and an emergency is hereby declared
to e List, and it is ordered that this ordinance shall become ef~'ective upon its passage by the
Common Council and its approval by the Mayor.
Section 11. All ordinances or parts of ordinances in conflict and Ordinance TIo. 883~
particularly be, and they are hereby repealed.
