Pare to Twentyfifth Place East in the City of Eugene, Oregon, and declaring and emergency.
THE CITY OF EUG~;NE DOES ORDAIN AS FGLLOI~~IS:
Section 1. The Cor,LTnon Council of the City of Eugene does hereby declare its intention

to build and c ~struct a sanitary sevrer in the INIalaber Hill District on Streets listed as
folloti~rs: Tv~rentythi rd Av~ue from niTissior~ Boulevard to Springy; Boulevard; Spring Bouleva rd
from Twentythird Avenue to TwentyfifthPlace East; Malabar Drive from TVrentythird Avenue to
Madrona Street; Highland Drive from V`loodland to Tvrentyfifth Place East; Hillside Drive from
Highland $rive to T"vrentyfifth Place East; Woodland Drive from Hendricks Parlc to Twentyfifth
,Place East; 1Viadrona Drive from P.2alabar Street to Tvrentyfifth Place East, in the City of
Eugene .
Section 2. That said sewer shall be c~mstr•ucted of first-class cement, vitrified pipe,
or other suitable material according to the plans and specifications of the City Engineer.
Section 3. The City Engineer is hereby directed to su~•vey out the Location of said
sewer, and prepare Mans ans specifications and a profile thereof; and to file the same with
the City Reeo~'der.
Secti~.n ~.. The ccnstructionof said sewers shall include all necessary manholes, veyes

and all things necessary andconvenient for the complete building thereof.
Section j. The cost of construction of said se~rrer shall be borne by and shall be assess-
ed to the lots, parts of lots and acreage properly liable therefor, and benefitted by the
ec,~nstruc.tion thereof in proporti ~n to the : e nefits accruing to each lot, part of lot or acrea.~ge
properly liable as shall be ascertained and determined by the Common Council of the City of
Eugene, except streat intersections, vrhich grill be paid for b-y, the City, ~.nd there will be in-
eluded as apart of the costs thereof, the Engineerts chargesfbr hs s~:rvices thereon, not
to exceed F~ of the c~r_ctract price therefofr, and•charges for interest on improvement ti~rarrants
advertisin for bids, ~:osta~e and supplies or mailing notices of assessments not to exceed 5~
of the c n~ra t price therefor
See~~.on ~. Upon the completion of the seiner, the Cor.~mon Council shall ascerta~:n the cost
thereof and assess that portion thereof against the lots, parts of lots or a.cre~,ge properly liab7
therefor or b<;ne±~.tted thereby in a ccordance vrith the provisions of the Charter of the City of
EuF;nn.e, and when said costs are so assessed the same shall be entered in the City Lien Docket,
and be further enforced as provided by the City Charter.
Section 7. 1AIHEREAS, the improvement contemplated and provided for b~T this ordirarce is

a necessary improvement and the district of the City in which said sewer is to be constructed
is ii1 such a. condition that the construction of said sewer is ess~:ntial to the health and
safety of the residents of said district, it is therefore declared that a<n er~erga~~cy exists and

it is necessary for the immediate preservation of the public peace, health and safety, that
this ordinance take effect i~~ediately upon its passage by the Council and approval by the
Mayor ,
