third Avenue from Taission Boulevard to Spring Boulevard; Sprin„ Boulevard from TUrentytl.ird Aven
to Tvrentyfifth Place East; L4alabar Drive from Tti^rentythird AvE;nue to T."adrona Street; Highland
Drive from ~i~loodland to TV1~tyfifth place East; Hillside Drive from Highland Drive to Twenty-
fifth Place East; ZRloodland Drive from Hendricks Panic to TNentyfifth Flace East.,TH4adrona Drive
from 1~~Talabar Street to TLVentyfifth Place East, in the City of Eugene, Or.;gon, directing the
City Recorder to advertise for bids for tl.~ c;c~,struction of said sewer in accordance with
auch plans and specifdcations, and notifying property ot~rners when and where the bids therefor
will be opened and considered.
1rt~Ii~REAS, the Common Council of the said City of Eugene, on the )th clay of Nay, 1a~.9,
passed and Ordinance ITc. 8323 for the construction of said sewer in the street described and
set forth in the title of this Ordinance, and said Ordinance Uras approved by the TL~!ayor of the Ci
of Eugene on the 10th day of I~Iay, 1;~1i.9; and
1'THEuEAS, Section 3 of said Ordinance directed the City Engineer to r~.lce plans alid spec-
ifications for the construction of said sewer as specified in said Ordinance, and to file
the same i^rlth the City Records-;r, and
WHEREAS, in accordance Frith such instrubtions the City Engineer has prepared said plans
and speciz`~.cations and filed the saz~~e with the City Recorder of said City of Eugene on the

Section 1. That the plans ar~d specifications of the City Engineer for the construction

of a sanitary sourer in the P.~lalabar Hill District cn Streets listed as follows: T~~entythird
Avenue from Mission boulevard to Spring Boulevard; Spring Boulevard from Twc,•ntythirc? A-c~nue
to T~antyfifth Place East; PJlalabar Drive from Tt~:ntyth~.rd Avenue to 1:~iadrona Street; Highland
Drive from T'''loodland to Tti+rent~fifth Place East; Hillside Drive from Highland Drive to Twenty-
fifth Place East; 1'4roodland Drive from Iendricks Park to Twentyf'ifth Place East ; Itladrana Drive
from Nalabar Street to T~^rentyfifth Place bast, ir_ the City of Eugene, and doing such wo,~I: as
may be necessary to completely construct the same, are in all tll~zgs approved and ,adopted and
the said sevrer shall be constructed in accordance theretivith.
Section 2. That the .City Recorder by, and he is hereby, instructed to give notice to
contractors and property ol~vners as provided in Secti ons 52, 53, ~, 55, 56, 5uB a.nd 57 of
the Charter. of the City of Eugene, inviting bids for the construction of said se~^rers as
prescribed in and ir. conformity to said plans and specifications.
Section 3. That the Common Council declared that the said construction and the whole

thereof shall be let as one contract and the City Recorder is d~.~ected to state in the notice
to contractors and property of^mers that said contract ti^rill b~ let in one contract

and to also state therm the time axrl place when ans wh:re bids for the construction of said

sewer will be opened and eensidered by the Com.~non Council, and that at such time and place

property ovmers may file remonstrances agair_st letting said contract.

{ Sectior. ~}. That the party whose bid is accepted for said construction sign a contract for
I' said work within ten days from the time of the receipt by him of the notification of the accept-

ancd of hi.s bid, and the vrorlc thereon shall be commenced within ten days after the letting of si

' said contract, and shall be completed vrithir. six days thereafter, unless an exter_sion of the i~

j time therefor be granted by the Co:~;mon Council. That the pa~•ty tirhose bid is accepted shall also !

~ execute and deliver to the City a good ar_d suffieient bond, :°ritTz one or more sureties to be f

i approved by the Publ ~.c 1~Vorks Committee of the City, in an 2.mount equal to eighty per cent of his
contract price, as security for the faithf~zl and satisf~.etory fulfillmer_t of l.i s contract. f
Section 5. That each par~;y bidding f'or said construction 'shall accompany his bid with

~ a certified check or cash in an amount equal to five per cent of the amount of his bid, as ev-
{ idence of good faith, and sa5.d check, or the prodeeds thereor, or said money shall be retained j
~ uy the City until a vrritten contract is finallyT made; and ftzlly executed axed the bond furnished j

and delivered, all to be done within ten days after the award of said contract.
Section 6. VV~EREAS, the constructior_ contemplated and provided for by this Ordina nce is
a necessary construction and the sevrar system to be improved is in such condition that its 1
~ immediate improvement is essentail to is safety, i'c is, therefore, declared that an emergency

+ exists and that it is necessary for the immediate preservation of the public peace, health and j
! ~
~ safety, that this Or dir_ance take effect at once, and it is ordered that this act shall take

effect immediately upon its passage by the Council and approval by the P;Zayor~ I
