.. ~. ~; , 340~~=~~ ORDINAt1CE N0. 9127 An Ordinance adopting the plans and specifications of the City Engineer for the con- struction of a sanitary sewer on the 6oath side of Twenty-ninth Avenue from Ferry Street to the West City limits (a-'.ley between Lawrence and Wa:~~hington Street), in the City of Eugene, Oregon, directing the Ci~sy Recorder to a~lvertisel for bids for the construction of said sewer in accordance vrith such plans and specifications, and notifying property owners I when and where the bids therefor will be opened and considered. ~~ ;~ i WHEREAS, the Gommon Cpimco; pf. the said City of Eugene, on the 10th day of October, _ ~ 199, passed Ordinance No. 9426 for the construction of said sewer in •t he~~treet described and set forth iz the title of t:'.is Ordinance, a.nd said Ordinance was approved by the Mayor of .the City of Eugene on the7.lth day of October, 1919; and j WHEREAS, Sect~.on 3, of said Ordinance directed the City Engineer to make plans and. j G specifications for the cnstruction of s:~id sewer as specified in said ordinance, and to file the same with the City Recorder, and ~ j WHEREAS, in accordance with such in:;tructions the City Engineer has prepared said plans and spec ificaticns and filed the same with the City Recorder of said City of Eugene on the ~ day of October, 1919, and the Common Council of the City of Eugene having examined and approved the same; ~' ~~ THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: '~~ Section 1. That the plans and specifications of the City Engineer for the construction '~, ,~ of a sanitary sewer on he South sidd of Twenty-ninth Avenue from Ferry Street to the West City Limitd (alley between Lawrence and Washington Stre?t) in the City of Eugene, and I'. i. doing .such work as may be necessary to c~~mpletely construct the same, are in a]1 things ~~ I; approved and adopted and thesaid server shall becohstructed in accordance therevrith. Section 2. That the City Recrder be, and. he:~is hereby, instructed to give notice to contractors and property owne rs as provided in Section 52, 53, SJ~, 55, 56, 5bB and 57 !,' of the Charter of the City of Eugene, Inviting bids for the construct on fosaid sewers j as preseribed in and in cnformity to said plans and specifications. ~'i .. ,~ Section3. That the Common Council declared that the sadi construction and the whole ~± thereof shall be let as one contract and the City Recorder is directed to state in the '. h notice to contractors and property owners thy. t said contract will be let in one contract, and to also state therein the time and pla.c~r when and where bids for the construction of said sewer will be opened and considered by the Common. Council, and that at such time and place property woners may file remonstrances against letting said contract. ' ,. Section ~. Section 5. That each Harty bidding for said cr nstruct nn shall accompany his hid with a certified check or cash in an amount equal to five per cent of the amount of his ~~ ffiid, as evidence of good faith, and said check, or the proceeds thereof, or said. money shall ~~ be retained by the City until a writtencontract is finally made, and fl:lly executed and ~~ { the bond furnished and d elivered, all to be done within ten days after the award of said constract. u 1 i Section 6. WHE=~ZE.AS, the construetior~ contemplated and provided for ry this ordinance is a necessary construction and the sewer system to be improved is in such ©ndition that its immediate improvement is essent~.l to its safety, it is, therefore, declared that an emergency exists and that it is necessary for the immediate preservation of the pu?~lic z~eace, health and safety, that this ordinance take effect at once, and it is ordered that this act shall take effect immediately upon _its -passage by the Council and approval by the 114ayor.
