That the plans a.nd specifications of the City Engineer for the construction of a sanitary sewer on the South side of Twenty-fifth Avenue from High Street to the a7..ley between Portland and Willamette Street ~henc~=North in said alley to Twenty-fourth Avenue in the City of Eugene, and doing such work as may he necessary to completely construct the same, are in all things aproved and adopted and the said serer shall be constructed in accord- ance therewith. Section 2. That the City Recorder, be, and he is hereby, instructed to give notice ~ t~ contractors and property owners as provided in Sections 52, 53, 51t, 55, 56, 56B and 5? of the~~j 'i Charter of the City of Eugene, inviting bids for the construction for said sewers as pre- ;~ scribed in and. in: c onformity to said plans and specifications. .' Section 3. That the Common Council declared that the s aidcons~ruction and the whole thereof shall be let as one contract and the City Recorder is directed to state in the notice to contractors and property owners that said contract .will tie let in one contr~.ct, and to also state therein the time and ~+lace when and where bids for the cx~nstruction of said sewer will be opened and considered by the Common Council, and that at such time and place property II ,I owners may file remonstrances against let3,ing said contract. i Seddon 1~. That the party whose bid is accented far said c~nstructi~~ns sign a contract for said work within ten days from the time of the receipt by him of the notification of the !~' I: acceptance of his bid, and the work thereon shall he commenced within ten days after t he letting of said contract.; and shall be completed within sixty thereafter, unle ssan ex- tension of the time therefor be granted by the Common Council. The party w..ose bid is accepted shall also execute and deliver to the City a good and sufficient bond, with one 1 1 ~~ 1 i~ or more sureties to be approved by the Public Vtiorks Committee of the City, im an amourLt eoual to eighty per cent of his contract price, as seclarity for the faithful and satis- ~. ,._ factory fulfillment of his contract. Sectim 5. That each party bidding for said construction shall accompany his bid with a certified check or cash in an amount equal to five percent of the amount of his bid, as evidence of good faith, and said check, or the proceeds thereof, or said money • _-;_. shall re retained by the City until a ti^rritten contract is finally made, and fully executed and the bond furnished and delivered, all to be done within ten days after the award of said contract. Sectioh 6. i't~HtsREAS, the construction contemplated and provided f or by this Ordinance is a necessary construction and the sew er system to be improved is in such condition that its immediate improvement is essential to its safety, it is, therefore, declared that an emergency exists and that it is necessary for the immediate preservation of the nub_lic peace, health and safety, that this Ordinance take effect at :once, and it is orede red that this act shall take effect immediately upon its passage by the Council and approval by the Mayor.
