BACKGROUND On November 8, 2004, the council held a work session on the City’s application of LEED for Existing Buildings to ongoing operations and maintenance practices. On April 27, 2005, the council held a work session on sustainable design and construction practices for City buildings. The council’s discussion of issues during these two work sessions set the stage for development of a policy on sustainable buildings that encompasses both the initial design and construction of City buildings and the ongoing operation and maintenance of City facilities. As noted during these work sessions, staff is applying LEED guidelines to the design and construction of City building projects and to the operation and maintenance of City facilities. To date, the City has not pursued formal certification of any new or existing buildings. Currently, the City is engaged in a master planning process to renovate or replace City Hall. Adopting a formal policy on sustainable building will provide a context for a decision on the level of sustainability to be incorporated in the City Hall master plan. RELATED CITY POLICIES On February 28, 2000, the Eugene City Council adopted Council Resolution No. 4618 providing a definition and statement of intent regarding the application of sustainability principles to the City of Eugene. The City Council of the City of Eugene finds as follows: A. On February 28, 2000, the Eugene City Council adopted Resolution No. 4618 which defined “sustainability” and set out a statement of intent regarding the application of sustainability principles to the City of Eugene. That Resolution also affirmed the commitment of City elected officials and City staff to upholding those principles. B. The principles of sustainability recognize the interdependence of the built and natural environments, providing the framework and tools to build and operate facilities in an efficient, healthy, and ecologically responsible manner. Green buildings are important in that they seek to harness natural energy flows and biological processes, reduce or eliminate reliance on fossil fuels and toxic materials, and improve resource efficiency. C. When applied to the design, construction, maintenance and operation of buildings, sustainable principles encompass the following broad topics: efficient management of energy and water resources; management of material resources and waste; protection of environmental quality; protection of health and indoor environmental quality; reinforcement of natural systems; and integrating the design approach. D. It is in the public interest to adopt a sustainable buildings policy for buildings owned and occupied by the City in order to demonstrate the City’s commitment to enhance the region’s environmental resources, and to yield cost savings to the taxpayers through reduced operating costs. NOW, THEREFORE, based upon the above findings, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The Sustainable Buildings Policy for Buildings Owned and Occupied by the City attached as Exhibit A is adopted. Section 2 . A copy of this Resolution shall be appended to Resolution No. 4618. Section 3 . This Resolution shall become effective immediately upon its adoption. The foregoing Resolution adopted the ______ day of __________________, 2006. ___________________________________ City Recorder Resolution L:\CMO\2006 Council Agendas\M060710\S060710C-attA.doc Exhibit A Sustainable Buildings Policy For Buildings Owned and Occupied by the City Purpose The purpose of a Citywide policy on sustainable buildings is to demonstrate the City of Eugene’s com- mitment to environmental, economic, and social stewardship, to yield cost savings to the City’s taxpayers through reduced operating costs, to provide healthy work environments for staff and visitors, and to con- tribute to the City’s goals of protecting, conserving, and enhancing the region’s environmental resources. Additionally, the City is in a position to set a community standard of sustainable buildings practices. Policy 1. The City of Eugene shall incorporate principles of sustainability in the planning, financing, design, construction, operation, and maintenance of buildings owned and occupied by the City and associated facilities. a. All City of Eugene buildings and facilities should use the U.S. Green Building Council’s TM LEED Green Building Rating System for Existing Buildings (LEED-EB) as a guide for the sustainable operation and maintenance of City buildings. Implementing LEED-EB criteria on an inventory-wide basis is intended to maximize sustainability benefits within existing resources, and provide a means of benchmarking environmental and financial performance improvements in City practices. Certification of existing buildings under LEED-EB will be evaluated for tech- nical and economic feasibility and pursued at the highest feasible level of certification on a case- by-case basis as funding is available. b. All new construction and additions encompassing 10,000 gross square feet or more of building TM area should achieve a Silver certification level of the U.S. Green Building Council’s LEED Green Building Rating System for New Construction (LEED-NC). A higher equivalent rating (Gold or Platinum) should be sought where practicable as funding is available. c. New construction encompassing less than 10,000 gross square feet of building area should achieve the equivalent of at least a LEED Silver certification level where technically feasible. Projects of any size for which certification is not feasible due to technical reasons, should use LEED-NC as a guide to incorporate as many sustainable features as economically feasible. d. Building renovation projects should use LEED-NC as a guide and will be evaluated for certifica- tion on a case-by-case basis, as the feasibility of incorporating sustainable features within the context of the existing building will vary widely from project to project. 2. It is City policy that sustainability elements should be considered part of the standard costs of building, renovating, and preserving public assets. One of the goals adopted by the City Council is that ongoing financial resources will be adequate to maintain and deliver municipal services, including funding for the planning, design, construction, maintenance, and operation of City buildings and associated facili- ties. Budgeting for new construction, renovations and additions to City facilities should include the costs of incorporating sustainable features and achieving certification goals. 3. Implementing LEED criteria and achieving certification will be at the highest level technically and economically feasible. The feasibility of incorporating sustainable features and achieving LEED certi- fications will be based on whether criteria can technically be implemented, and where there is a net Exhibit A to Resolution No. _____ L:\CMO\2006 Council Agendas\M060710\S060710C-attAa.doc economic benefit. Building sustainably may increase the initial cost of public building construction, renovation and, potentially, preservation. However, many sustainable features reduce long-term costs of building operation and maintenance. The City will use life-cycle cost and length of payback of ini- tial costs to determine economic feasibility. 4. The level of LEED certification for projects requiring the City to obtain financing will be identified at the time the project budget is adopted by Council. By establishing the level of LEED performance during the budget process, any additional costs of LEED certification can be included in the project financing. 5. Construction of buildings owned and occupied by the City may be exempt from LEED-NC certifica- tion based on a finding that certification would not be economically sustainable. The ability to fund public building projects must also meet the test of reasonableness. In the case where certification at the Silver level is not cost-neutral, the requirement for certification may be decreased to a ”Certified” level or waived a) if the costs related to certification are more than 10% above the estimated cost of construction without those measures, b) if the additional costs are related to sustainability goals and certification requirements which have not been formally accepted by an external organization provid- ing the majority of funding for a City project, or c) the City Manager determines that the interest of the public is best served by an exemption. To ensure the application of this exemption is used judiciously, a finding of the need for certification at lower than the Silver level or waiver of the certification re- quirement will be made prior to construction of a project. 6. A report evaluating the City’s implementation of sustainable building practices will be submitted to Council each year. To ensure that the City-wide application of the sustainable building policy is implemented in the most cost-effective way, the application of the policy needs to be monitored, and the performance of the various City programs with building activities evaluated and reported annually to the City Council. ATTACHMENT B Defining a Sustainable Buildings Policy For the City of Eugene Background On February 28, 2000, the Eugene City Council adopted Council Resolution No. 4618 providing a defi- nition and statement of intent regarding the application of sustainability principles to the City of Eugene (Attachment C). In adopting the resolution, the Council committed City elected officials and City staff to uphold the sustainability principles in Resolution No. 4618. The principles of sustainability recognize the interdependence of the built and natural environments, pro- viding the framework and tools to build and operate facilities in an efficient, healthy, and ecologically responsible manner. Green buildings seek to harness natural energy flows and biological processes, re- duce or eliminate reliance on fossil fuels and toxic materials, and improve resource efficiency. Specifi- cally, sustainable principles—when applied to the design, construction, maintenance and operation of buildings—encompass the following broad topics: efficient management of energy and water resources, management of material resources and waste, protection of environmental quality, protection of health and indoor environmental quality, reinforcement of natural systems, and integrating the design approach. Policy Considerations – What Activities are Included, What’s the Standard, How Will the Policy Be Implemented, What are the Exemptions Because of the wide variety of buildings and program activities across the City organization, there are a number of specific issues that need to be addressed to ensure that a sustainable building policy is effec- tive. Questions that must be resolved include the type and size of buildings to be covered, the potential for different funding sources to support green building practices and the extent of the City’s ability to control decisions on building projects. What Activities are Included? The City’s Sustainable Buildings Policy would apply to City owned and occupied buildings. While some local governments, including the City of Portland, also encompass “non-building” activities such as parks, open space, and street and utility infrastructure in an overall green building policy, this policy recommendation for the City of Eugene focuses on buildings, addressing these other activities only to the extent that they support individual buildings. Currently, City departments responsible for these other City activities are committed to adopting best management practices within each functional area. As there are currently no accepted standards to evaluate sustainability in these areas that are comparable to the LEED Green Building Rating System, the inclusion of these non-building activities in a Sustainable Buildings Policy is likely to have little, if any, environmental benefit over the “best management practices” approach now in place. The City’s Sustainable Buildings Policy can be expanded in the future if a more robust system for evaluating the sustainability of these non-building activities becomes generally accepted. It is recommended that the Sustainable Buildings Policy apply to all City-owned and occupied buildings, regardless of funding sources. However, there may be practical limitations on the ability to use external funding on sustainable building measures that are more than typical construction or operations costs, depending on restrictions of different funding sources. An example would be funding under a federal program that has narrow restrictions on how funds may be used. To recognize this situation, the policy provides that restrictions on the ability to invest specific funding sources in sustainable building initiatives be treated as exemptions to the adopted policy on achieving certification. However, the underlying intent is that LEED criteria be used as a guide in building construction and operation, and that integrated design and commissioning be considered as “best practices” applicable to City building activities. The City also provides some financial support for projects developed and owned by nonprofit and private entities. The proposed Sustainable Building Policy does not address these projects given the many differences among the types of projects, level of City involvement, and currently available green building standards. In order to meet the City’s interests in supporting sustainable development practices, development of policies for these projects need closer examination. Sustainable development has been included as a selection criterion in recent Requests for Proposals related to affordable housing and downtown development. In the area of affordable housing, staff is exploring options for further incorporating green building measures into these programs. Another consideration is whether the Sustainable Buildings Policy should make any distinction between new construction—including major renovations—versus the ongoing operation and maintenance of existing buildings. New construction or major renovation projects have an opportunity to include a wide range of sustainable building elements from the beginning of a project. By contrast, sustainability for an existing building often focuses on improving ongoing maintenance and operating practices, and upgrades to equipment and systems, rather than large-scale structural changes. Because of this difference in focus, many jurisdictions adopt sustainable building policies dealing only with construction, and not ongoing maintenance. The City of Eugene believes that both new construction and ongoing building operations are important, especially as the majority of a building’s environmental impact occurs during its active use over the life of the building. With approximately 125 buildings in the City’s inventory, the approach is to adopt sustainable practices as standard operating procedure applicable to all existing City buildings rather than focusing on individual buildings. The assumption is that the total benefits will be greater by improving the way services are provided to the entire building inventory, rather than addressing a single building at a time. What’s the Standard? TM It is recommended that the City adopt the LEED (Leadership in Energy and Environmental Design) Green Building Rating System as the verifiable standard for measuring the implementation of sustainable building practices. Created by the U.S. Green Building Council (USGBC), LEED is a voluntary, consen- sus-based national standard for developing high-performance, sustainable buildings. Members of the USGBC representing all segments of the building industry developed LEED and continue to contribute to its evolution. The City of Eugene has been an active member of the USGBC since 2000. LEED is an independent, third-party certification system created to: define "green building" by establishing a common standard of measurement $ promote integrated, whole-building design practices $ recognize environmental leadership in the building industry $ stimulate green competition $ raise consumer awareness of green building benefits $ transform the building market $ LEED provides a complete framework for assessing building performance and meeting sustainability goals. Based on well-founded scientific standards, LEED emphasizes state of the art strategies for sus- tainable site development, water savings, energy efficiency, materials selection, and indoor environmental quality. The USGBC has developed a suite of rating systems, each addressing a different type of building construction and maintenance, including new construction, commercial core and shell construction, tenant infill of an existing shell and the operation of existing buildings. 2 As stated on the USGBC website (www.usgbc.org/LEED), “LEED for New Construction and Major Renovations (LEED-NC) is a green building rating system that was designed to guide and distinguish high-performance commercial and institutional projects, with a focus on office buildings. Practitioners have also applied the system to K-12 schools, multi-unit residential buildings, manufacturing plants, labo- ratories and many other building types.” The City of Eugene used LEED-NC as a guideline in construc- tion of the Downtown Library and Fire Stations #1 and #11. The rating system that applies to the operation and maintenance of the City’s existing buildings is LEED for Existing Buildings (LEED-EB). The purpose of LEED-EB is to maximize operational efficiency and work-place environmental quality while minimizing environmental impacts. Rather than a one-time rat- ing, LEED-EB provides a performance-based benchmark for building owners and operators to measure current conditions and improvements to operations and maintenance on a consistent scale. In addition to the strategies noted above, LEED-EB also addresses whole-building cleaning and maintenance issues including chemical use, recycling programs and facilities, exterior maintenance programs, and systems upgrades to meet green building energy, water, indoor air quality, and lighting performance standards. A related policy question is whether certification under the LEED system should be required, or if LEED should be used as a guideline for building construction and maintenance without formal certification. Obtaining USGBC certification under LEED provides independent confirmation that a project’s sustain- ability goals have been achieved. However, the process of certification entails additional administrative effort and adds to a project’s overall costs. For existing buildings, certification must be renewed every three years, requiring periodic administrative expenditures that have minimal benefit on the actual per- formance of a building. The type and size of a project also has an impact on the feasibility of certification. For new construction or additions to existing buildings, the environmental performance of that construction can be controlled more directly than remodeling or renovating a portion of an existing building. For small construction projects, such as a park restroom, limited economy of scale and the cost of certification may have a sig- nificant impact on the economic feasibility of certification. The City’s existing building inventory, which includes buildings from 100 square feet to 130,000 square feet, range from open air picnic shelters to highly complex buildings like the Library. A number of the City’s existing buildings have no centralized heating and air conditioning system, and limited operational requirements. As LEED certification is weighted on the performance of heating and cooling systems and adoption of sustainable maintenance practices, the potential to formally certify many of our existing buildings is limited. In fact, most non-occupied buildings do not have centralized heating and cooling systems or significant plumbing and electrical systems, and interior finishes are often minimal. As a result, non-occupied build- ings and other structures that clearly do not have the potential for LEED certification would be exempt from meeting the certification requirement. However, LEED should still be used as a guide in addressing site impacts, type and procurement of construction materials, and other aspects of the LEED criteria that improve the sustainability of the construction and maintenance of non-occupied buildings. Given these considerations, the recommendation is that all City new construction (which would include additions to existing buildings) of 10,000 square feet or larger achieve a Silver certification under LEED- NC. To put it into context, buildings of 10,000 square feet or larger account for about 75% of City- owned space. For new construction less than 10,000 square feet, the feasibility of certification will be evaluated on a case-by-case basis. With smaller projects below the 10,000 square foot threshold, the costs associated with certification through the USGBC would represent a significantly higher percentage of the total project budget than for larger projects. A new building comprising 50,000 square feet, for example, 3 would have a project budget of nearly ten times that of a 5,000 square foot building and could more readily absorb the costs associated with LEED certification. Building renovation projects should use LEED-NC as a guide. The ability of a renovation project to incorporate sustainable features, even a large scale renovation, can be significantly dependent on the character of the existing building. Each renovation project is a unique situation, and should be evaluated for certification on a case-by-case basis, as the feasibility of incorporating sustainable features within the context of the existing building will vary widely from project to project. Likewise, certification of existing buildings under LEED-EB is desirable and will be evaluated on a case- by-case basis. In terms of the City’s existing building inventory, the primary goal of the sustainable building policy is the overall improvement of the performance of buildings, and secondarily the certification of individual buildings where practicable. Another policy question is what level of certification should be required. LEED has four levels of certifi- cation – Certified, Silver, Gold and Platinum – with increasingly stringent criteria and potential impacts on project costs. The few studies that have been done on construction projects within the US indicate that in most cases, a Silver rating can be achieved without significantly increased costs. The increased cost of achieving a Gold rating falls within the range of 0% to 10% of total project costs, with a 4% to 5% increase above a Silver rating being a reasonable expectation. The estimated additional cost of meeting LEED criteria presume that the designer is experienced in sustainable design, and that sustainable build- ing elements are incorporated at the start of the design process. The recommendation is that, for new construction, certification be at the Silver level, with a higher level of certification sought where judged economically advantageous over the life of a building and where funding can be obtained to meet any construction cost increases. For other construction and existing buildings that are to be certified, the level of certification must be evaluated on a case-by-case basis to achieve the optimal environmental, social and economic benefits. Major new construction projects will typically require special budgetary action, either through dedication of existing resources, or some form of public financing. In either case, the level of LEED certification can be adopted by Council as part of the budget process. City construction tends to be non-typical of the general commercial construction industry, such as fire stations, parking garages, maintenance buildings, pools and so on. The types of design and construction features to meet LEED criteria will vary widely for these different types of buildings. Addressing the level of LEED performance during the budget process will ensure that any expected additional costs for LEED certification at higher than a Silver level will be included in the project financing. How Will the Policy Be Implemented? The Sustainable Buildings Policy will be implemented by including integrated design, life cycle assessment and commissioning as standard operating practices in the design, construction and operation of City buildings. Integrated Design provides a framework for applying the principles of sustainability to building design. Integrated design considers a building’s design, structure, and systems in a holistic manner in an effort to optimize their interaction for economic and environmental benefits. Integrated design looks beyond the traditional, linear design process and simple questions of system sizing and specification, and sees the building's design, structure, lighting, and HVAC as integral to occupant comfort, satisfaction and operat- ing performance. Effective integrated design considers and solves a variety of relevant issues simultane- ously. Life Cycle Assessment (LCA) evaluates the environmental impacts of a given product, process, or activity through all stages of its life cycle. LCA can also include life-cycle cost analysis in which the net present 4 value of design options are assessed as investments. LCA is an inclusive approach to assessing the envi- ronmental and financial impact of a program, facility, or group of facilities, and encompasses planning, design, construction, operation, and maintenance over the useful life of a facility. The goal of LCA is to achieve the highest, most cost-effective environmental performance possible over the life of the project. When integrated design and life cycle assessment are combined, better and more affordable development strategies emerge. The City should use life cycle costs assessments that are available for sustainable building practices and materials. Due to the developing nature of sustainable building practices and appearance of new technologies, life cycle cost information may not be available for the full range of sustainable design or program options. In this case, the economic criteria may be applied that sustainable measures be initially cost neutral, or for long-term cost saving measures with higher initial costs, have a payback period of up to 10 years. Another aspect of implementing a sustainable building policy is the adoption of Commissioning as a standard practice. Commissioning is a way of ensuring that specific performance standards for building systems are included in the project specifications, and that a building’s systems are meeting those per- formance criteria once a project is completed. Commissioning is an added project management tool, and can increase the initial cost of construction. However, proper implementation of commissioning should decrease the long-term operating cost of a building’s heating and cooling system and overall energy use. For existing buildings, adoption of commissioning as an operating practice would be a new program, with a benefit/cost impact dependent on the nature of each specific building. Commissioning is a LEED requirement for any building, new or existing, to achieve certification. For building projects or existing buildings not required to achieve certification, commissioning should be evaluated on a case-by-case basis, and implemented if there will be an overall positive benefit. Commis- sioning is not expected to be of benefit for non-occupied buildings, due to the minimal electrical and mechanical systems typically used in un-staffed facilities. What are the Exemptions? Technical exemptions have been discussed above, related to limitations due to funding sources and type of construction that lacks building systems needed for certification. For “certifiable” projects, any policy may have unintended consequences when applied to “real life” situations. Exemptions should be de- signed to allow resolution of unforeseen problems, while supporting the underlying goal of the sustainability of City buildings. An important underlying assumption is that sustainable buildings have significantly lower ongoing operations and maintenance costs. Some sustainable building practices may have higher initial costs, compared to standard construction practices. The more “cutting edge” the technology—such as photo- voltaics or building-scale wind generation—the higher this initial cost premium may be. Using LEED criteria as a standard will help achieve the expected long-term cost savings, as the LEED rating system emphasizes efficiencies in building heating, cooling and electrical systems, reduced water use, and low- maintenance finishes and grounds that significantly reduce operating costs. However, the expectation that sustainable building practices can be “cost neutral” may not be true in all cases. The recommendation is that, in the case where certification at the Silver level is not cost-neutral, the requirement for certification may be decreased to a “Certified” level or waived a) if those costs are more than 10% above the estimated cost of construction without those measures, b) if the additional costs are related to sustainability goals and certification requirements which have not been formally accepted by the organization providing external funding, or c) the City Manager determines that the interest of the public is best served by an exemption. To ensure the application of this exemption is used judiciously, a finding of the need for certification at lower than the Silver level or waiver of the certification requirement will be made prior to construction of a project. 5 Monitoring and Evaluation To ensure that the City-wide application of the Sustainable Buildings Policy is implemented in the most effective way, the application of the policy needs to be monitored, and the performance of the various City programs with building activities periodically evaluated and reported to the Environmental Policy Team. The evaluation and reporting team would also recommend the form and frequency of reports to the Environmental Policy Team. A report on the City’s sustainable building performance for new construction and existing buildings will be provided to the City Council annually. A cross-department team, coordinated by the Facility Management Division, would be charged with developing an evaluation tool and a reporting process. The members of the team would represent all parts of the organization that are responsible for implementing the sustainable building policy. The team would be charged with developing a report on new construction and renovation projects that identifies the number and value of certified, non-certified and exempt projects, and the level of performance of certified and non-certified projects. In terms of the City’s existing building inventory, the primary goal of the sustainable building policy is the overall improvement of the performance of buildings, and secondarily the certification of individual buildings where practicable. The evaluation and reporting team would be charged with developing a tool to evaluate the current status of the City’s buildings in relation to the LEED-EB prerequisites and criteria. This evaluation would provide an inventory-wide baseline that would assist City departments in deter- mining what LEED criteria any specific building meets or needs improvement, which improvements may have the most potential for environmental and economic returns, and the economic and practical feasibil- ity of certification in the future.
