ORDINANCE NO. 20203
AN ORDINANCE VACATING IMPROVED PORTIONS OF
COMMERCE STREET AND WEST 13TH AVENUE IN THE
WEST PARK COMMERCIAL CENTRE SUBDIVISION; AND
PROVIDING AN EFFECTIVE DATE.
The City Council of the City of Eugene finds that:
On the 26th day of June, 2000, the City Council of the City of Eugene by Motion duly passed,
called a public hearing to be held at 7:30 p.m., Pacific Time on the 24th day of July, 2000, at the
Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances
could be heard as to the proposed Council initiated vacation, with the consent of the abutting
property owners, of the following described portions of street rights-of-way.
The improved portions of Commerce Street and West 13th Avenue in
the West Park Commercial Centre Subdivision, adjacent to Tax Lots
600,800,1100,1300,1500,1600,1700,1800,1900,2000,2100,
2200, 2300, Assessor's Map 17-04-33-41, as more particularly
described in Exhibits 1 and 2 to this Ordinance. (Cuddeback West
LLC; SV 00-1).
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene finds that due and regular notice of the
hearing was published and posted as by law required, and no valid objections were made at the
hearing or filed. The proposed vacation will not substantially affect the market value of the property
abutting the above-described portions of street rights-of-way and the public interest will not be
prejudiced by the vacation of the portions of street rights-of-way. The hearing was held on the 24th
day of July, 2000, at 7:30 p.m., Pacific Time, at the Council Chambers, City Hall, Eugene, Lane
County, Oregon, and all matters necessary to be done in the premises have been duly and regularly
completed.

Section 2. The herein above-described portions of street rights-of-way are hereby vacated
and the portions of street rights-of-way so vacated shall revert pursuant to the statutes of the State
of Oregon.
Section 3. Notwithstanding the provisions of the Eugene Charter of 1976 as to the effective
date of ordinances, this Ordinance shall not become effective until after (a) petitioner has submitted
to City a replat of the West Park Commercial Centre Subdivision that provides sufficient right-of-
way, including street and utility improvements, for relocation of Commerce Street between West 11 th
Avenue and West 13th Avenue; (b) the City has approved the replat and the replat has been recorded
with the Recorder of Lane County; and (c) the Eugene Water and Electric Board has notified City
that petitioner has made satisfactory arrangements to pay all of the costs associated with moving
utilities necessitated by the street vacation.
Section 4. Upon the effective date as provided in Section 3 above, the City Recorder is
hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon,
together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with
the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor.
Section 5. If the replat is not approved and recorded within two years from the date of
adoption of this Ordinance, then this Ordinance automatically shall be repealed unless the Council
extends the two-year period by amending the Ordinance.
