HomeMy WebLinkAboutResolution No. 4507 RESOLUTION NO. !15!21 line: A Resolution furthering annexation to the City of Eugene of the territory bounded by a Tax Lots 200, 400, 500, Assessor's Map 18-03-03-40; Tax Lots 3600, 3700, 4100, 4200, 4700, 4800, 4900, 5000 Assessor's Map 18-03-03-11; Tax Lots 201, 1300, 1400, 1500, 1600, 1700, 1800, 1900, 2000, 2001, Assessor's Map 18-03-03-14, located in the southern Glenwood area, known as Area A and more particularly described on Exhibits A-I thru A -4 attached hereto and incorporated herein by reference (Wildish Industrial Development Corp. et. al., A 96-31). The City Council of the City of Eugene finds that: The annexation of the territory to the City would constitute a "minor boundary change" under the boundary commission law, ORS 199.410 to 199.519. By authority of ORS 199.490(1)(a) and ORS 199.505, the City Council of the City may initiate the annexation with a delayed effective date. The Council intends to withdraw from those Districts that part of the territory that lies within the Glenwood Water District, Willamalane Park & Recreation District, by authority of ORS 199.510 and 222.520 to 222.575 in the event the annexation is consummated and jurisdiction of the subject portion of the Glenwood area is not transferred to Springfield through an amendment to the Metropolitan Plan prior to the effective date of the annexation. Pursuant to the provisions of Sections 9.150 to 9.160 of the Eugene Code, 1971, the Planning Department has conducted an investigation of the application, and the Planning Commission held a public hearing thereon on October 1, 1996. Based upon the testimony and submittals at that hearing and the Planning Department staff notes and Planning Commission minutes of September 30, October 1, and October 7, 1996 the Planning Commission found the application to be consistent with the City's adopted criteria for annexations and recommended approval of the annexation request. No appeal of the Planning Commission's decision and recommendation of October 7, 1996 has been filed in accordance with the provisions of the Eugene Code, 1971. Now, therefore, having considered the Planning Commission's decision and recommendation of October 7, 1996, which incorporated the Planning Department Staff Notes and Planning Commission minutes of September 30, October 1, and October 7, 1996, and based thereon, and upon the evidence and record submitted therewith, and the testimony before the Planning Commission and Council, the City Council hereby approves the Planning Commission's Resolution - 1 decision and recommendation, and, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. Based upon the above fmdings and reasons which are adopted herein, the City Council hereby initiates the annexation, affirms the Planning Commission's decision and recommendation of October 7, 1996, adopts the findings and conclusions in support of the annexation set forth in the Planning Department Staff Notes and Planning Commission minutes of September 30, October 1, and October 7, 1996, approves the annexation request, and advises the Boundary Commission that: 1.1 In the event the annexation is consummated, the City will initiate separate proceedings to withdraw the properties from the Glenwood Water District and Willamalane Parks and Recreation District, subject to the provisions of ORS 199.510(2)(a) unless prior to that time the Metro Plan is amended to transfer jurisdiction of the subject portion of the Glenwood area to Springfield. 1.2 Approval of this annexation is not intended to predetermine the outcome of the pending Glenwood Jurisdictional Study. 1.3 Future transfer of this territory from the City of Eugene to the City of Springfield will occur if future amendments to the Metro Plan direct that such a transfer shall occur. and requests that the Boundary Commission approve the annexation and to provide in its Final Order that the annexation shall become effective on January 3, 2000. Section 2. The City of Eugene does not object to the annexation of the within described territory to the Lane County Metropolitan Wastewater Service District. Section 3.
