RESOLUTION NO. '15/1
A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER
PROPOSED WITHDRAWAL OF TERRITORY (CLARENBACH, EC ED 97-
25) FROM THE RIVER ROAD WATER DISTRICT AND RIVER ROAD
PARK AND RECREATION DISTRICT; AND PROPOSED WITHDRAWAL
OF TERRITORIES (STINGRAY, C ED 97-5; CONTEMPORARY, C ED 97-
6; HOGAN, C ED 97-7; STINGRAY DEVELOPMENT, INC. (WEST), C ED
97-8; AND ALBERT, ET AL, C ED 97-10) FROM THE SANTA CLARA
WATER DISTRICT.
RECITALS:
A. The Lane County Local Government Boundary Commission by its Notice dated
May 1, 1997, advised that pursuant to. ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective April 14, 1997:
Tax Lot 3200, Assessor's Map 17-04-14 1 4, located in the River
Road area of north Eugene, north of Hamilton and south of Kourt,
and more particularly described on Exhibit A attached hereto and
incorporated herein by reference. (Clarenbach, EC ED 97-25).
That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
B. The Lane County Local Government Boundary Commission by its Final Order No.
1096 dated February 6, 1997, advised that pursuant to ORS 199.490(l)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:
Tax lot 2300, Assessor's Map 17-04-11 2 4, located in the Santa
Clara area of north Eugene, west of River Road, south of
Greenfield A venue, east of Shirley Street, north and south of Dahlia
Lane, and more particularly described on Exhibit B attached hereto
and incorporated herein by reference. (Stingray, C ED 97-05).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
C. The Lane County Local Government Boundary Commission by its Final Order No.
1097 dated February 6, 1997, advised that pursuant to ORS 199.490(l)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:

Clara area of north Eugene, east of River Road, north of Wilkes
Drive, east of Scenic Drive, south of Dean Avenue, and more
particularly described on Exhibit C attached hereto and incorporated
herein by reference. (Contemporary, C ED 97-06).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
D. The Lane County Local Government Boundary Commission by its Final Order No.
1098 dated February 6, 1997, advised that pursuant to ORS 199.490(l)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:
Tax lot 4900, Assessor's Map 17-04-11 4 1, located in the Santa
Clara area of north Eugene, east of River Road, south of Azalea
Drive, north of Hunsaker Lane, west of Summer Lane, and more
particularly described on Exhibit D attached hereto and
incorporated herein by reference. (Hogan, C ED 97-07).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
E. The Lane County Local Government Boundary Commission by its Final Order No.
1099 dated February 6, 1997, advised that pursuant to ORS 199.490(l)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:
Tax lot 3800, Assessor's Map 17-04-03 3 0, located in the Santa
Clara area of north Eugene, west of River Road, south of Irvington
Drive, east of the Northwest Expressway, north of Irving Road, and
more particularly described on Exhibit E attached hereto and
incorporated herein by reference. (Stingray Development, Inc., C
ED 97-08).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
F. The Lane County Local Government Boundary Commission by its Final Order No.
1101 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:
Tax lot 2000, Assessor's Map 17-04-02 4 1, located in the Santa
Clara area of north Eugene, east of River Road, north and west of

River Loop #2, south of Limerick Avenue, and more particularly
described on Exhibit F attached hereto and incorporated herein by
reference. (Albert, et aI, C ED 97-10).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
G. The City has authority under ORS 199.510 and 222.520 to 222.575 to withdraw
the territories from the Districts without referring the withdrawal to the Boundary Commission.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. The City Council proposes that the territory bounded by the line running as
follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the
River Road Water District and River Road Parks & Recreation District:
Tax Lot 3200, Assessor's Map 17-04-14 1 4, located in the River
Road area of north Eugene, north of Hamilton and south of Kourt,
and more particularly described on Exhibit A attached hereto and
incorporated herein by reference. (Clarenbach, EC ED 97-25).
Section 2. The City Council proposes that the territories bounded by the lines running as
follows, which have heretofore been annexed to the City of Eugene, shall be withdrawn from the
Santa Clara Water District:
Tax lot 2300, Assessor's Map 17-04-11 2 4, located in the Santa
Clara area of north Eugene, west of River Road, south of
Greenfield Avenue, east of Shirley Street, north and south of Dahlia
Lane, and more particularly described on Exhibit B attached hereto

Section 3. Monday, June 2, 1997, at 7:30 p.m., Pacific Time, in the Council Chambers,
City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for hearing objections to
the withdrawals. The City Manager shall cause a Notice of the date, time and place and purpose
of the hearing, a copy of which is attached as Exhibit G hereto, to be published in the Register
Guard once each week for two consecutive weeks prior to the hearing and to be posted in four
public places in the City for a like period of time.
