A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER
PROPOSED WITHDRAWAL OF TERRITORIES (CLARENBACH, EC EU
97-25; SENGER, EC EU 97-31; ESCHLIMAN, EC EU 97-24; MURRAY, EC
EU 97-26; JINKS, EC EU 97-28; FULLER, EC EU 97-23; AND BAILEY
HILL CO., EC EU 97-37)) FROM THE RIVER ROAD WATER DISTRICT
AND RIVER ROAD PARK AND RECREATION DISTRICT; PROPOSED
WITHDRAWAL OF TERRITORIES (STINGRAY, C EU 97-5;
CONTEMPORARY, C EU 97-6; HOGAN, C EU 97-7; STINGRAY
DEVELOPMENT, INC. (WEST), C EU 97-8; ALBERT, ET AL, C EU 97-10;
McCANN, E EU 97-20; SHAPITKA, C EU 97-19; LYON, C EU 97-9; SMITH,
C EU 97-3; AND BROWN, C EU 97-1) FROM THE SANTA CLARA WATER
DISTRICT; AND REPEAL OF RESOLUTION NO. 4519.
RECITALS:
A. On May 12, 1997, the City Council adopted Resolution No. 4519 calling a public
hearing to be held on June 2, 1997 to consider the proposed withdrawal of territories identified
therein from the River Road Water District, River Road Parks & Recreation District, and Santa
Clara Water District. Notice of the time and place of the public hearing was duly published as
required by law, and at that time and place no hearing was held and the matter was postponed.
Resolution No. 4519 should therefore be repealed.
B. The Lane County Local Government Boundary Commission by its Notice dated
May 1, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective April 14, 1997:
Tax Lot 3200, Assessor's Map 17-04-14 1 4, located in the River
Road area of north Eugene, north of Hamilton and south of Kourt,
and more particularly described on Exhibit A attached hereto and
incorporated herein by reference. (Clarenbach, EC ED 97-25).
That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
C. The Lane County Local Government Boundary Commission by its Notice dated
May 16, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax Lot 1402, Assessor's Map 17-04-14 2 3, located in the River
Road area of north Eugene, south of Bushnell Lane and northeast

of Labona Drive, and more particularly described on Exhibit B
attached hereto and incorporated herein by reference. (Senger, EC
ED 97-31).
That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
D. The Lane County Local Government Boundary Commission by its Notice dated
April 7, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax Lot 1000, Assessor's Map 17-04-23 4 4, located in the River
Road area of north Eugene, north of Knoop Lane, east of Chestnut
Avenue, west of W alnut Avenue, and more particularly described
on Exhibit C attached hereto and incorporated herein by reference.

That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
E. The Lane County Local Government Boundary Commission by its Notice dated
April 14, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax Lot 2500, Assessor's Map 17-04-25 2 2, located in the River
Road area of north Eugene, north of Hansen and east of Knapp
Street, and more particularly described on Exhibit D attached hereto
and incorporated herein by reference. (Murray, EC ED 97-26).
That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
F. The Lane County Local Government Boundary Commission by its Notice dated
April 28, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax Lots 6600,6700,6900, and 7000 Assessor's Map 17-04-242

McClure, east of River Road, south of Oakleigh Lane, and more

That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
G. The Lane County Local Government Boundary Commission by its Notice dated
April 7, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax Lot 3500, Assessor's Map 17-04-14 3 1, located in the River
Road area of north Eugene, north of Howard Avenue, east of
Hemlock Street, south of Maxwell Road, and more particularly
described on Exhibit F attached hereto and incorporated herein by
reference. (Fuller, EC ED 97-23).
That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
H. The Lane County Local Government Boundary Commission by its Notice dated
June 6, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described
real property was annexed to the City of Eugene, effective June 6, 1997:
Tax Lot 108, Assessor's Map 17-04-23 1 1, located in the River
Road area of north Eugene, east of Betty Lane, south of Harvey
Avenue, west of Andersen Lane, and more particularly described
on Exhibit G attached hereto and incorporated herein by reference.

That property is contained in and is a part of the River Road Water District and the River
Road Parks & Recreation District. The City desires that the property so annexed be withdrawn
from those Districts and that the City assume proportionate liability for the part of the Districts
so withdrawn.
I. The Lane County Local Government Boundary Commission by its Final Order No.
1096 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective Apri11, 1997:
Tax lot 2300, Assessor's Map 17-04-1124, located in the Santa
Clara area of north Eugene, west of River Road, south of
Greenfield Avenue, east of Shirley Street, north and south of DaWia

That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume

J. The Lane County Local Government Boundary Commission by its Final Order No.
1097 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following

That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
K. The Lane County Local Government Boundary Commission by its Final Order No.
1098 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective April1, 1997:
Tax lot 4900, Assessor's Map 17-04-11 4 1, located in the Santa
Clara area of north Eugene, east of River Road, south of Azalea
Drive, north of Hunsaker Lane, west of Summer Lane, and more
particularly described on Exhibit J attached hereto and incorporated

That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
L. The Lane County Local Government Boundary Commission by its Final Order No.
1099 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective April1, 1997:
Tax lot 3800, Assessor's Map 17-04-03 3 0, located in the Santa
Clara area of north Eugene, west of River Road, south of Irvington
Drive, east of the Northwest Expressway, north of Irving Road, and
more particularly described on Exhibit K attached hereto and

desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
M. The Lane County Local Government Boundary Commission by its Final Order No.
1101 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective April 1, 1997:
Tax lot 2000, Assessor's Map 17-04-02 4 1, located in the Santa
Clara area of north Eugene, east of River Road, north and west of
River Loop #2, south of Limerick Avenue, and more particularly
described on Exhibit L attached hereto and incorporated herein by

That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
N. The Lane County Local Government Boundary Commission by its Final Order No.
1105 dated April3, 1997, advised that pursuant to ORS 199.490(1)(c), the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax lot 2400, Assessor's Map 17-04-03 4 0, located in the Santa
Clara area of north Eugene, north of Hyacinth Street and Irvington
Drive, and more particularly described on Exhibit M attached
hereto and incorporated herein by reference. (McCann, C. ED 97-
20).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
o. The Lane County Local Government Boundary Commission by its Final Order No.
1104 dated April 3, 1997, advised that pursuant to ORS 199.490(1)(c), the following described
real property was annexed to the City of Eugene, effective May 21, 1997:
Tax lots 1300 and 1400, Assessor's Map 17-04-02 4 3, located in
the Santa Clara area of north Eugene, north of West Anchor Drive,
east of River Road, south of Irvington Drive, and more particularly
described on Exhibit N attached hereto and incorporated herein by
reference. (Shapitka, C ED 97-19).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.

P. The Lane County Local Government Boundary Commission by its Final Order No.
1100 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective May 21, 1997:
Tax lots 2200 and 2300, Assessor's Map 17-04-02 3 4, located in
the Santa Clara area of north Eugene, west of River Road, north of
Irvington Road, west of Byron Street, east of Revell Street, and
more particularly described on Exhibit 0 attached hereto and
incorporated herein by reference. (Lyon, C ED 97-9).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
Q. The Lane County Local Government Boundary Commission by its Final Order No.
1094 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective May 21, 1997:
Tax lot 1201, Assessor's Map 17-04-02 4 3, located in the Santa
Clara area of north Eugene, west of River Road, south of Irvington
Road, north of W Anchor Avenue, and more particularly described
on Exhibit P attached hereto and incorporated herein by reference.

That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
R. The Lane County Local Government Boundary Commission by its Final Order No.
1093 dated February 6, 1997, advised that pursuant to ORS 199.490(1)(c), the following
described real property was annexed to the City of Eugene, effective May 21, 1997:
Tax lot 200, Assessor's Map 17-04-02 4 1, located in the Santa
Clara area of north Eugene, east of River Road, north of River
Loop #2, north and east of Scenic Drive, and more particularly
described on Exhibit Q attached hereto and incorporated herein by
reference. (Brown, C ED 97-1).
That property is contained in and is a part of the Santa Clara Water District. The City
desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
s. The City has authority under ORS 199.510 and 222.520 to 222.575 to withdraw
the territories from the Districts without referring the withdrawal to the Boundary Commission.

NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. The City Council proposes that the territory bounded by the line running as
follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the
River Road Water District and River Road Parks & Recreation District:
Tax Lot 3200, Assessor's Map 17-04-14 1 4, located in the River
Road area of north Eugene, north of Hamilton and south of Kourt,
and more particularly described on Exhibit A attached hereto and
incorporated herein by reference. (Clarenbach, EC ED 97-25).

Tax Lot 1402, Assessor's Map 17-04-142 3, located in the River
Road area of north Eugene, south of Bushnell Lane and northeast

Section 3. Resolution No. 4519 adopted on May 12, 1997, is hereby repealed.
Section 4. Monday, July 14, 1997, at 7:30 p.m., Pacific Time, in the Council
Chambers, City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for hearing
objections to the withdrawals. The City Manager shall cause a Notice of the date, time and
place and purpose of the hearing, a copy of which is attached as Exhibit R hereto, to be
published in the Register Guard once each week for two consecutive weeks prior to the
hearing and to be posted in four public places in the City for a like period of time.
The foregoing Resolution adopted the 23rd day of June, 1997.
