RECITALS: A. The Lane County Local Government Boundary Commission by its Notice dated October 30, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 18, 1997: A portion of Tax Lot 701, Assessor's Map 17-04-1324, located in the River Road area of north Eugene, north of Carolyn Drive, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (McCowen, EC ED 97-50). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so a~exed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. B. The Lane County Local Government Boundary Commission by its Notice dated October 29, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 18, 1997: Tax Lot 4400, Assessor's Map 17-04-24 3 1, located in the River Road area of north Eugene, north of Park Avenue, south of Sunnyside Drive, and west of River Road, and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Lockhart, EC ED 97-49). Resolution - 1 That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. c. The Lane County Local Government Boundary Commission by its Notice dated November 18, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 22, 1997: Tax Lots 200 and 300, Assessor's Map 17-04-144 3, located in the River Road area of north Eugene, south of Howard Lane, east of Oak Drive, and west of Santa Rosa Street, and more particularly described on Exhibit C attached hereto and incorporated herein by reference. (Benchmark Northwest, EC ED 97-52). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. D. The Lane County Local Government Boundary Commission by its Notice dated December 8, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective September 23, 1997: Tax Lot 4000, Assessor's Map 17-04-25 4 2, located in the River Road area of north Eugene, west of Willow Avenue, and more particularly described on Exhibit D attached hereto and incorporated herein by reference. (Smith, EC ED 97-54). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. E. The Lane County Local Government Boundary Commission by its Notice dated September 30, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective September 30, 1997: Tax Lot 500, Assessor's Map 17-04-24 3 4, located in the River Road area of north Eugene, southeast of Hawthorne Avenue, north of Knoop Lane, and west of River Road, and more particularly described on Exhibit E attached hereto and incorporated herein by reference. (Scott, EC ED 97-55). That property is contained in and is a part of the River Road Water District and the River Resolution - 2 Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. F. The Lane County Local Government Boundary Commission by its Notice dated October 27, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective October 27, 1997: Tax Lot 100 Assessor's Map 17-04-23 4 1, located in the River Road area of north Eugene, north of north of Sunnyside Avenue and south of Elkay Drive, and more particularly described on Exhibit F attached hereto and incorporated herein by reference. (Fleck, EC ED 97-63). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. G. The Lane County Local Government Boundary Commission by its Notice dated November 3, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 3, 1997: Tax Lot 7600, Assessor's Map 17-04-24 2 3, located in the River Road area of north Eugene, north of Elkay Road and east of Hoover Lane, and more particularly described on Exhibit G attached hereto and incorporated herein by reference. (Hawkins, EC ED 97-68). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. H. The Lane County Local Government Boundary Commission by its Notice dated December 1, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective December 1, 1997: Tax Lot 300, Assessor's Map 17-04-15 1 0, located in the River Road area of north Eugene, north of Bushnell Lane and south of Belt1ine Road, and more particularly described on Exhibit H attached hereto and incorporated herein by reference. (Gaudette, EC ED 97-78). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn Resolution - 3 from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. I. The Lane County Local Government Boundary Commission by its Notice dated November 25, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 25, 1997: Tax Lot 7500, Assessor's Map 17-04-23 2 2, located in the River Road area of north Eugene, north of Virgil Avenue and east of Park Avenue, and more particularly described on Exhibit I attached hereto and incorporated herein by reference. (Morthan Homes, EC ED 97-71). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. J. The Lane County Local Government Boundary Commission by its Notice dated December 29, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective December 29, 1997: Tax Lot 1500, Assessor's Map 17-04-23 2 0, located in the River Road area of north Eugene, north of Cornwall Avenue, south of Kelly Lane, and east of Park Avenue, and more particularly described on Exhibit J attached hereto and incorporated herein by reference. (Phillips, EC ED 97-83). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. K. The Lane County Local Government Boundary Commission by its Notice dated December 29, 1997, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective December 29, 1997: Tax Lot 4300, Assessor's Map 17-04-23 4 1, located in the River Road area of north Eugene, south of Park Avenue and east of Walnut Avenue, and more particularly described on Exhibit K attached hereto and incorporated herein by reference. (Stuckey, EC ED 97-82). That property is contained in and is a part of the River Road Water District and the River Road Parks & Recreation District. The City desires that the property so annexed be withdrawn Resolution - 4 from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. L. The Lane County Local Government Boundary Commission by its Final Order No. 1109 dated June 5, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective July 21, 1997: Tax lot 400, Assessor's Map 17-04-01 2 3, located in the Santa Clara area of north Eugene, east of River Road, north of River Loop #2, west of Banner Street, and more particularly described on Exhibit L attached hereto and incorporated herein by reference. (Ott, C ED 97-35). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. M. The Lane County Local Government Boundary Commission by its Final Order No. 1110 dated June 5, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective July 21, 1997: Tax lot 7000, Assessor's Map 17-04-03 1 4, Tax Lots 16500, 16600, and 16700, Assessor's Map 17-04-03 1 3, and a portion of Tax Lot 200, Assessor's Map 17-04-03 0 0, located in the Santa Clara area of north Eugene, north of Lynnbrook Drive and east of Berrywood Drive, and more particularly described on Exhibit M attached hereto and incorporated herein by reference. (Breeden Land Co, C ED 97-36). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. N. The Lane County Local Government Boundary Commission by its Final Order No. 1111 dated October 9, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 24, 1997: Tax lot 1001, Assessor's Map 17-04-02 4 1, located in the Santa Clara area of north Eugene, north of Jason Street and south of River Loop, and more particularly described on Exhibit N attached hereto and incorporated herein by reference. (Foster, C ED 97-42). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Resolution - 5 o. The Lane County Local Government Boundary Commission by its Final Order No. 1114 dated August 7, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 22, 1997: Tax lot 405, Assessor's Map 17-04-02 4 1, located in the Santa Clara area of north Eugene, north of River Loop, west of Scenic Drive, south of Dublin Avenue, and more particularly described on Exhibit 0 attached hereto and incorporated herein by reference. (Cook, C ED 97-46). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. R The Lane County Local Government Boundary Commission by its Notice dated November 4, 1997, advised that pursuant to ORS 199.466 and 199.519, the following described real property was annexed to the City of Eugene, effective August 19, 1997: Tax lot 1300, Assessor's Map 17-04-02 1 4, located in the Santa Clara area of north Eugene, east of River Road, north and east of Dublin Avenue and east of Scenic Drive, and more particularly described on Exhibit P attached hereto and incorporated herein by reference. (Presley, EC ED 97-51). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Q. The Lane County Local Government Boundary Commission by its Final Order No. 1115 dated October 9, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 24, 1997: Tax lot 103, Assessor's Map 17-04-12 2 0, located in the Santa Clara area of north Eugene, south of River Loop No. 1 and east of Admiral Street, and more particularly described on Exhibit Q attached hereto and incorporated herein by reference. (Andersen, C ED 97-56). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. R. The Lane County Local Government Boundary Commission by its Final Order No. 1117 dated October 9, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 24, 1997: Resolution - 6 Tax lot 102, Assessor's Map 17-04-02 1 2, located in the Santa Clara area of north Eugene, north of Spring Creek Drive, west of Scenic Drive, south of Calumet Avenue, and more particularly described on Exhibit R attached hereto and incorporated herein by reference. (Anderson Development, C ED 97-58). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. s. The Lane County Local Government Boundary Commission by its Final Order No. 1120 dated December 4, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective January 20, 1998: Tax lots 2300, 2400, and 2500 Assessor's Map 17-04-11 1 3, located in the Santa Clara area of north Eugene, west of River Road, north of West Myoak Drive, south of Ferndale Drive, and more particularly described on Exhibit S attached hereto and incorporated herein by reference. (Meier, C ED 97-74). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. T. The Lane County Local Government Boundary Commission by its Final Order No. 1118 dated December 4, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective January 20, 1998: A portion of tax lot 6400, Assessor's Map 17-04-10 1 2, located in the Santa Clara area of north Eugene, east of Arrowhead Street, south of Spearmint Avenue, and more particularly described on Exhibit T attached hereto and incorporated herein by reference. (Shephard, C ED 97-72). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. u. The Lane County Local Government Boundary Commission by its Final Order No. 1119 dated December 4, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective January 20, 1998: Tax lots 501, 502, 503, and 1000, Assessor's Map 17-04-02 2 1, located in the Santa Clara area of north Eugene, east of River Road, north of Kingsbury, and more particularly described on Exhibit D Resolution - 7 attached hereto and incorporated herein by reference. (Ruhoff, C ED 97-73). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. v. The Lane County Local Government Boundary Commission by its Notice dated December 3, 1997, advised that pursuant to ORS 199.466 and 199.519, the following described real property was annexed to the City of Eugene, effective December 3, 1997: Tax lot 1307, Assessor's Map 18-03-0320, west of Henderson and south of 1-5, and more particularly described on Exhibit V attached hereto and incorporated herein by reference. (Cooney, C ED 97- 80). That property is contained in and is a part of the Willamalane Park and Recreation District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. W. The City has authority under ORS 199.510 and 222.520 to 222.575 to withdraw the territories from the Districts without referring the withdrawal to the Boundary Commission. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The City Council proposes that the territory bounded by the line running as follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the River Road Water District and River Road Parks & Recreation District: A portion of Tax Lot 701, Assessor's Map 17-04-13 24, located in the River Road area of north Eugene, north of Carolyn Drive, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (McCowen, EC ED 97-50). and, Tax Lot 4400, Assessor's Map 17-04-24 3 1, located in the River Road area of north Eugene, north of Park Avenue, south of Sunnyside Drive, and west of River Road, and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Lockhart, EC ED 97-49). The City Council proposes that the territory bounded by the lines running as follows, which have heretofore been annexed to the City of Eugene, shall be withdrawn from the Willamalane Park and Recreation District: Tax lot 1307, Assessor's Map 18-03-03 2 0, west of Henderson and south of 1-5, and more particularly described on Exhibit V attached hereto and incorporated herein by reference. (Cooney, C ED 97- 80). Section 4. Monday, February 2, 1998, at 7:30 p.m., Pacific Time, in the Council Chambers, City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for hearing objections to the withdrawals. The City Manager shall cause a Notice of the date, time and place and purpose of the hearing, a copy of which is attached as Exhibit W hereto, to be published in the Register Guard once each week for two consecutive weeks prior to the hearing and to be posted in four public places in the City for a like period of time.
