RESOLUTION NO. 4557
A RESOLUTION CALLING A PUBLIC HEARING TO CONSIDER THE
PROPOSED WITHDRAWAL OF TERRITORY (BREEDEN LAND CO., C
EU 97-36) FROM THE JUNCTION CITY WATER CONTROL DISTRICT.
RECITALS:
A. The Lane County Local Government Boundary Commission by its Final Order No.
1110 dated June 5, 1997, advised that pursuant to ORS 199.490(1)(c), the following described real
property was annexed to the City of Eugene, effective July 21, 1997:
Tax lot 7000, Assessor's Map 17-04-03 1 4, Tax Lots 16500, 16600,
and 16700, Assessor's Map 17-04-03 1 3, and a portion of Tax Lot
200, Assessor's Map 17-04-03 00, located in the Santa Clara area of
north Eugene, north of Lynnbrook Drive and east of Berrywood
Drive, and more particularly described on Exhibit A attached hereto
and incorporated herein by reference. (Breeden Land Co, C ED 97-
36).
That property is contained in and is a part of the Junction City Water Control District. The
City desires that the property so annexed be withdrawn from that District and that the City assume
proportionate liability for the part of the District so withdrawn.
B. The City has authority under ORS 199.510 and 222.520 to 222.575 to withdraw the
territory from the District without referring the withdrawal to the Boundary Commission.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. The City Council proposes that the territory bounded by the line running as
follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the
Junction City Water Control:
Tax lot 7000, Assessor's Map 17-04-03 1 4, Tax Lots 16500, 16600,
and 16700, Assessor's Map 17-04-03 1 3, and a portion of Tax Lot
200, Assessor's Map 17-04-03 0 0, located in the Santa Clara area of
north Eugene, north of Lynnbrook Drive and east of Berrywood
Drive, and more particularly described on Exhibit A attached hereto
and incorporated herein by reference. (Breeden Land Co, C ED 97-
36).

Section 2. Wednesday, March 11, 1998, at 11 :30 a.m., Pacific Time, in the McNutt Room,
City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for hearing objections to the
withdrawal. The City Manager shall cause a Notice of the date, time and place and purpose of the
hearing, a copy of which is attached as Exhibit B hereto, to be published in the Register Guard once
each week for two consecutive weeks prior to the hearing and to be posted in four public places in
the City for a like period of time.
The foregoing Resolution adopted the 23rd day of February, 1998.

NOfICE OF HEARING
N<YrICE IS HEREBY GIVEN: On Wednesday, March 11, 1998, at 11 :30 a.m., Pacific
Time, in the McNutt Room, City Hall, Eugene, Oregon, a hearing will be held to hear objections,
if any there be, to withdrawal of the following described territory contained in the special district
as noted and heretofore annexed to the City of Eugene:
Junction City Water Control District:
Breeden Land Co.. C ED 96-36:
Tax lot 7000, Assessor's Map 17-04-03 1 4, Tax Lots 16500,
16600, and 16700, Assessor's Map 17-04-03 1 3, and a portion of
Tax Lot 200, Assessor's Map 17-04-03 0 0, located in the Santa
Clara area of north Eugene, north of Lynnbrook Drive and east of
Berrywood Drive, and more particularly described on Exhibit M
attached to the Resolution calling this hearing.
The City Council of the City of Eugene will determine at the hearing whether the
withdrawal is in the best interest of the City of Eugene, Oregon.
