RECITALS: A. The Lane County Local Government Boundary Commission by its Notice dated June 23, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 29, 1998: Tax Lot 4500, Assessor's Map 17-04-23 4 1, located in the River Road area of north Eugene, west of River Road, south of Park Avenue, east of W alnut Avenue, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (Stuckey, EC ED 98-33). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. B. The Lane County Local Government Boundary Commission by its Notice dated June 17, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 20, 1998: Tax Lot 800, Assessor's Map 17-04-1442, located in the River Road area of north Eugene, west of River Road, north of Howard Avenue, Resolution - 1 east of Santa Rosa Avenue, and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Wise, EC ED 98-24). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. c. The Lane County Local Government Boundary Commission by its Notice dated June 19, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 18, 1998: Tax Lot 7706, Assessor's Map 17-04-24 3 3, located in the River Road area of north Eugene, west of River Road, south of Knoop Lane, east of Knapp Lane, and more particularly described on Exhibit C attached hereto and incorporated herein by reference. (Halgren, EC ED 98-25). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. D. The Lane County Local Government Boundary Commission by its Notice dated June 23, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 1, 1998: Tax Lot 7300, Assessor's Map 17-04-14 4 3, located in the River Road area of north Eugene, west of River Road, south of Howard Lane, north ofHom Lane, east of Sunny Drive, and more particularly described on Exhibit D attached hereto and incorporated herein by reference. (Michaelson, EC ED 98-34). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. E. The Lane County Local Government Boundary Commission by its Notice dated July 30, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective July 20, 1998: Tax Lot 5200, Assessor's Map 17-04-14 4 2, located in the River Road area of north Eugene, west of River Road, south of Howard Lane, east of Dalton Drive, and more particularly described on Resolution - 2 Exhibit E attached hereto and incorporated herein by reference. (Osborn, EC ED 98-40). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. F. The Lane County Local Government Boundary Commission by its Notice dated July 21, 1998, advised that pursuant to ORS 199.466, and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 29, 1998: Tax Lot 300, Assessor's Map 17-04-23 12, located in the River Road area of north Eugene, west of River Road, south of Howard Lane, north of Horn Lane, east of Dalton Drive and more particularly described on Exhibit F attached hereto and incorporated herein by reference. (Sizemore-Boless, EC ED 98-38). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. G. The Lane County Local Government Boundary Commission by its Notice dated August 14, 1998, advised that pursuant to ORS 199.466, and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 10, 1998: Tax Lot 1600, Assessor's Map 17-04-24 2 4, located in the River Road area of north Eugene, east of River Road, north of East Hilliard Lane, south of Hillcrest Avenue, and more particularly described on Exhibit G attached hereto and incorporated herein by reference. (Lujan, EC ED 98-47). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. H. The Lane County Local Government Boundary Commission by its Notice dated October 9, 1998, advised that pursuant to ORS 199.466, and ORS 199.519, the following described real property was annexed to the City of Eugene, effective October 5, 1998: Tax Lot 3300, Assessor's Map 17-04-23 4 2, located in the River Road area of north Eugene, west of River Road, south of Elkay Road, north of the Northwest Expressway, east of Glory Drive, and more particularly described on Exhibit H attached hereto and Resolution - 3 incorporated herein by reference. (Mainstream Housing, EC ED 98- 52). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. I. The Lane County Local Government Boundary Commission by its Notice dated October 15, 1998, advised that pursuant to ORS 199.466, and ORS 199.519, the following described real property was annexed to the City of Eugene, effective October 12, 1998: Tax Lot 7700, Assessor's Map 17-04-14 4 1, located in the River Road area of north Eugene, west of River Road, south of Rosewood Avenue, north of Howard Avenue, and more particularly described on Exhibit I attached hereto and incorporated herein by reference. (Fisher, EC ED 98-54). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. J. The Lane County Local Government Boundary Commission by its Notice dated November 4, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 4, 1998: Tax Lot 200, Assessor's Map 17-04-23 2 0 and Tax Lot 6500, Assessor's Map 17-04-23 12, located in the River Road area ofnorth Eugene, west of River Road, south of Audel Avenue, east of Virgil Avenue and more particularly described on Exhibit J attached hereto and incorporated herein by reference. (Cox, EC ED 98-56). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate ,liability for the part of the Districts so withdrawn. K. The Lane County Local Government Boundary Commission by its Notice dated January 6, 1999, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective December 15, 1998: Tax Lot 4400, Assessor's Map 17-04-14 4 2, located in the River Road area of north Eugene, south of Maxwell Road, west of Dalton Drive and more particularly described on Exhibit K attached hereto and incorporated herein by reference. (Weber-Foote, EC ED 98-58). Resolution - 4 That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. L. The Lane County Local Government Boundary Commission by its Notice dated August 6, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective August 3, 1998: Tax Lot 5900, Assessor's Map 17-04-23 2 2, located in the River Road area of north Eugene, west of River Road, south of Nantucket Avenue, east of Northwest Expressway, and more particularly described on Exhibit L attached hereto and incorporated herein by reference. (Dietrich, EC ED 98-46). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. M. The Lane County Local Government Boundary Commission by its Notice dated January 12, 1999, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective January 11, 1999: Tax Lot 600, Assessor's Map 17-04-23 12, located in the River Road area of north Eugene, west of River Road, north of Horn Lane, east of Sunny Drive, and more particularly described on Exhibit M attached hereto and incorporated herein by reference. (Gansen, EC ED 99-01). That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. N. The Lane County Local Government Boundary Commission by its Final Order No. 1138 dated August 6, 1998, advised that pursuant to ORS 199.490(1)( c), the following described real property was annexed to the City of Eugene, effective September 21, 1998: Tax Lot 7500, Assessor's Map 17-04-11 1 3, arid Tax Lots 1600, 2201, and 2202, Assessor's Map 17-04-11 1 4, located east of River Road, south of County Road, north of Camrose Street, and more particularly described on Exhibit N attached hereto and incorporated herein by reference. (Riviera Baptist Church, C ED 98-43). That property is contained in and is a part of the Santa Clara Water District. The City desires Resolution - 5 that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. o. The Lane County Local Government Boundary Commission by its Final Order No. 1122, dated February 5, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective March 23, 1998: Tax Lot 2500, Assessor's Map 17-04-03 4 0, located in the Santa Clara area of north Eugene, west of River Road, north of Irvington Drive, west of Stark Street, and more particularly described on Exhibit 0 attached hereto and incorporated herein by reference. (Hammer, C ED 98-03). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. P. The Lane County Local Government Boundary Commission by its Final Order No. 1123, dated February 5, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 20, 1998: Tax Lot 401, Assessor's Map 17-04-02 1 1, located in the Santa Clara area of north Eugene, east of River Road, south of Calumet Avenue, north of Spring Creek Drive, west of Scenic Drive, and more particularly described on Exhibit P attached hereto and incorporated herein by reference. (Moran, C ED 98-05). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Q. The Lane County Local Government Boundary Commission by its Final Order No. 1124, dated February 5, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 20, 1998: Tax Lot 700, Assessor's Map 17-04-1123, located in the Santa Clara region of north Eugene, west of Stark Street, east of Northwest Expressway, north of Bobolink Avenue and more particularly described on Exhibit Q attached hereto and incorporated herein by reference. (Dickerson, C ED 98-06). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate Resolution - 6 liability for the part of the District so withdrawn. R. The Lane County Local Government Boundary Commission by its Final Order No. 1128, dated April 2, 1998, advised that pursuant to ORS 199.490(1)( c), the following described real property was annexed to the City of Eugene, effective May 18, 1998: Tax Lot 5308, Assessor's Map 17-04-11 1 3, located in the Santa Clara region of north Eugene, west of River Road, north of West Myoak Drive, and more particularly described on Exhibit R attached hereto and incorporated herein by reference. (Bartzat, C ED 98-15). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. s. The Lane County Local Government Boundary Commission by its Final Order No. 1129, dated April 2, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective May 18, 1998: Tax Lot 402, Assessor's Map 17-04-0243, located in the Santa Clara region of north Eugene, north of Wilkes Drive, and east of River Road, and more particularly described on Exhibit S attached hereto and incorporated herein by reference. (Arneson, C ED 98-16). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. T. The Lane County Local Government Boundary Commission by its Final Order No. 1130, dated April 2, 1998, advised that pursuant to ORS 199 .490( 1)( c), the following described real property was annexed to the City of Eugene, effective May 20, 1998: Tax Lot 3447, Assessor's Map 17-04-12 2 0, located in the Santa Clara region of north Eugene, east of Lenox, north of Federal Lane and more particularly described on Exhibit T attached hereto and incorporated herein by reference.(Kempf, C ED 98-17). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. u. The Lane County Local Government Boundary Commission by its Final Order No. 1136, dated June 4, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real Resolution - 7 property was annexed to the City of Eugene, effective July 20, 1998: Tax Lot 2600, Assessor's Map 17-04-11 4 2, located in the Santa Clara area of north Eugene, west of River Road, north of Federal Lane, west ofF ederal Place, east of Quiet Lane, and more particularly described on Exhibit D attached hereto and incorporated herein by reference. (Marsonette, C ED 98-31). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. v. The Lane County Local Government Boundary Commission by its Final Order No. 1137, dated June 4, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective July 20, 1998: Tax Lot 7700, Assessor's Map 17-04-11 4 2 located west of River Road, east of Newcastle Street, south of Irving Road, and more particularly described on Exhibit V attached hereto and incorporated herein by reference. (King,C ED 98-32). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. w. The Lane County Local Government Boundary Commission by its Final Order No. 1140, dated August 6, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 4, 1998: Tax Lot 200, Assessor's Map 17-04-123 3 located in the Santa Clara area of north Eugene, east of Green Lane, and more particularly described on Exhibit W attached hereto and incorporated herein by reference. (Holvey/Kast C ED 98-45). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. x. The Lane County Local Government Boundary Commission by its Notice dated November 4, 1998, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective November 4, 1998: Tax Lot 6700, Assessor's Map 17-04-11 1 3 located in the Santa Resolution - 8 Clara area of north Eugene, west of River Road, south of Ferndale Drive, west of Quiet Lane, east of Oak Leaf Drive, north of Federal Lane, and more particularly described on Exhibit X attached hereto and incorporated herein by reference. (Graham, EC ED 98-50). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Y. The Lane County Local Government Boundary Commission by its Final Order No. 1139, dated August 6, 1998, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 4, 1998: Tax Lot 1700, Assessor's Map 17-04-12 3 3 located in the Santa Clara area of north Eugene, west of Stark Street, south of Bobolink Avenue, and more particularly described on Exhibit Y attached hereto and incorporated herein by reference. (Scott C ED 98-44). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. z. The Lane County Local Government Boundary Commission by its Notice dated December 28, 1998, advised that pursuant to ORS 199.463 and ORS 199.452(1), the following described real property was annexed to the City of Eugene, effective December 21, 1998: Tax Lot 700, Assessor's Map 17-04-1230 located in the Santa Clara area of north Eugene, east of River Road, north of Ware Lane, east of Summer Lane, and more particularly described on Exhibit Z attached hereto and incorporated herein by reference. (Gibson, EC ED 98-61). That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. AA. The Lane County Local Government Boundary Commission by its Notice dated December 16, 1998, advised that pursuant to ORS 199.463 and ORS 199.452(1), the following described real property was annexed to the City of Eugene, effective December 15, 1998: Tax Lot 100, Assessor's Map 17-04-03 0 0 located in the Santa Clara area of north Eugene, west of River Road, east of Northwest Expressway, north of Irvington Drive, south ofShenstone Drive, and more particularly described on Exhibit AA attached hereto and Resolution - 9 incorporated herein by reference. (Wilson, EC ED 98-59). That property is contained in and is a part of the Junction City Water Control District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. BB. The City has authority under ORS 199.510 and 222.520 to 222.575 to withdraw the territories from the Districts without referring the withdrawals to the Boundary Commission. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The City Council proposes that the territory bounded by the line running as follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the River Road Water District and River Road Parks & Recreation District: Tax Lot 4500, Assessor's Map 17-04-23 4 1, located in the River Road area of north Eugene, west of River Road, south of Park Avenue, east of W alnut Avenue, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (Stuckey, EC ED 98-33). and Tax Lot 800, Assessor's Map 17-04-1442, located in the River Road area of north Eugene, west of River Road, north of Howard Avenue, east of Santa Rosa Avenue, and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Wise, EC ED 98-24). and Tax Lot 7706, Assessor's Map 17-04-243 3, located in the River Road area of north Eugene, west of River Road, south of Knoop Lane, east of Knapp Lane, and more particularly described on Exhibit C attached hereto and incorporated herein by reference. (Halgren, EC ED 98-25). and Tax Lot 7300, Assessor's Map 17-04-1443, located in Resolution - 10 the River Road area of north Eugene, west of River Road, south of Howard Lane, north of Horn Lane, east of Sunny Drive, and more particularly described on Exhibit D attached hereto and incorporated herein by reference.
