HomeMy WebLinkAboutResolution No. 4669 RESOLUTION NO. 4669 A RESOLUTION AMENDING THE USER CATEGORIES TO DETERMINE HUL T CENTER RENT AL RATES AS DEFINED IN RESOLUTION NOS. 3442, 3475, 3800, 4017, 4034 AND 4454. The City Council of the City of Eugene finds that: A. The Council has previously defined what constitutes "Local Non-Commercial Performing Arts Organizations," "Local Independent Professional Artists," "Resident Companies" and "Commercial" as user categories for the Hult Center in Resolution Nos. 3442, 3475, 3800,4017, 4034 and 4454. B. The residency requirements for "Resident Companies" were amended by Resolution No. 4454, which also provided that further designation or removal of status would be by Administrative Order of the City Manager. C. The City's Cultural Services Division staff has recommended that the categories of users be amended and redefined to more accurately meet the current needs of the community. A copy of those categories and definitions are attached hereto as Exhibits A and B. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. Based upon the above findings, which are incorporated herein by reference and adopted, the City Council of the City of Eugene amends the user categories used to determine Hult Center rental rates as set forth in Exhibits A and B attached hereto. Resolution - 1 Section 2. To the extent the user categories established and defined in Resolution Nos. 3442,3475,3800,4017,4034 and 4454 conflict with those in Exhibits A and B hereto, those prior categories are repealed. Except as amended or repealed herein, the unamended portions of those Resolutions remain in full force and effect. Section 3. Future adjustments to the user categories established herein and additions to, or removal from, Residency status shall be made by Administrative Order of the City Manager. The foregoing Resolution adopted this 23rd day of April, 2001. '- ~ ~, Deputy City Recorder Resolution - 2 Licensee Criteria Used to Determine Hult Center Rental Rates Resident Company Those organizations which meet the residency requirements set forth in Section 1 of Exhibit B attached to this Resolution and have been designated a Hult Center Resident Company by Administrative Order of the City Manager. Local Performing Arts Any performer or performing group residing or based in the Eugene/Springfield area seeking to rent space in the Hult Center for the purpose of presenting a performance featuring local talent. Local Promoter/Non Performing Any person or organization residing or based in the Eugene/Springfield area seeking to rent space in the Hult Center for the purpose of presenting a non-performance-oriented event (e.g. conference, meeting, lecture, graduation, religious service, reception, dinner, wedding). Commercial Any local or non-local person or organization including, but not limited to, professional entertainment industry promoters, who does not meet any of the above-listed criteria and seeks to rent space in the Hult Center for the purpose of presenting a performance or non-performance event. Exhibit A Hult Center for the Performing Arts Residency Criteria, Benefits, and Scheduling Practices for Arts Organizations Local, not-for-profit organizations that perform in the Hult Center for the Performing Arts (Center) provide a base of performances for the Center which helps the Center to flourish and fulfill its mission of offering a broad cultural experience to the citizens of Eugene and its surrounding areas. They give to us, our children, and their children, an opportunity for artistic experience that would not otherwise be available. Both the Center and local performing arts organizations will develop strength and financial stability so long as they continue to cooperate, and provide excellent leadership, beautiful, exciting, artistic and interesting performances, professional artistic direction, and long-range planning. Audiences will grow under this cooperation and leadership, and the patron will benefit. The economic development and cultural diversification of the community will be strengthened, and the unification of the resources of the Center and local performing arts organizations will add to the Center's growth. In recognition of their artistic excellence and their value as cultural assets to the people of the City of Eugene, the City should offer residency to qualified local, not- for-profit organizations that perform at the Center. THEREFORE, 1. Those performing organizations that meet the fo llowing requirements may app ly for residency status. 1.1 Demonstrate recognized artistic excellence; 1.2 Have a 501 (c)3 status; 1.3 Have a local/community based Board of Directors; 1.4 Have at least three years of continuous existence III Eugene as a performing arts organization; 1.5 For the most recent three seasons, have a subscription season in the Hult Center, or a multiple event season with at least three events in either Silva Concert Hall or Soreng Theater and a total of six performances (as of July 1, 2001, existing Resident Companies which have not met this criteria in the past will be granted a transition period of three years to achieve this performance/production standard; by the 2003-04 season all Resident Companies shall be in compliance); 1.6 Recognize the Hult Center, either by name or logo, on any marketing or promotional material; 1.7 Promptly pay costs of using the Hult Center so that all current debts are cleared on or before Exhibit B-1 June 30 of the fiscal year; 1.8 Employ paid artists, performers, and crews; 1.9 Demonstrate an educational component; offer low- or no-cost student performances at the Hult Center or at other locations in the area; and 1.10 On July 1, submit to the Center an annual report recapping residency qualifications. The organizations must continue to fulfill the above requirements in order to maintain residency status. 2. The benefits of residency status include the following: 2.1 Resident Company rates and fees; 2.2 Discounted equipment rental rates; 2.3 Local stage labor rates; 2.4 No rental fee for non-dress rehearsals; 2.5 Institutional recognition as a Resident Company; 2.6 Advance scheduling priority; 2.7 Guaranteed facility use based on a negotiated Standard Schedule; 2.8 Permission to use donated food at scheduled season events; 2.9 Discounted merchandise percentage; 2.10 No deposit requirement; and 2.11 PUF waiver on youth events, by application. 3. Cooperation will continue between the Center and the resident company staff in the area of scheduling, marketing, promotion and financial management. Communication between the Center and resident companies will help guide these efforts. 4. Provision for Resident Company priority scheduling will be based on the following time line: a. The calendar will open no later than 21 months prior to the beginning of the season being scheduled (Le. October 1,2001 for the season beginning July 1, 2003). b. A Resident Company shall submit a letter of intent to be used as the basis for Part A. of the license agreement no later than January 15 prior to the beginning of the season. c. License Agreements will be issued prior to subscription sales. 5. The Hult Center is committed to partnerships with a complement of resident companies and also Exhibit B-2 recognizes that a performing arts center can only be successful if the schedule of attractions and productions presented is balanced and includes quality presentations of all forms and genres of the performing arts. It may be necessary to negotiate dates being held by a resident company in the event that a week-long popular entertainment opportunity arises. 6. All initial applications for residency status shall be submitted to the Center, with substantiating documents on or before an annual date to be established by the City's Cultural Services Division. Upon receipt of a complete application, Center staff will review the application for compliance with this policy and other adopted policies applicable to the Center and the City, and forward a recommendation to the City Manager for final approval. 7. Status as a resident company commences on July 1, and continues to June 30 of the following year. Thereafter, all approved resident companies will be reviewed annually by Center staff for compliance with this policy at which time the companies will provide an annual report. Resident company status shall continue uninterrupted so long as the resident company remains in compliance with the criteria listed above. 8. Upon finding exception with applicable criteria, Center staff shall notify the City Manager and the resident company of its non-compliance and potential change in status. In the event the Center's staff determines that a resident company is no longer qualified for such status, it shall request the City Manager to withdraw approval. The City Manager shall review the staff recommendation and any submissions received from the resident company. Upon finding the resident company has failed to fulfill the requirements to maintain residency status the City Manager shall withdraw its recognition as an approved resident company. Exhibit B-3
