HomeMy WebLinkAboutResolution No. 4682 RESOLUTION NO. 4682 A RESOLUTION CALLING A SPECIAL CITY ELECTION ON SEPTEMBER 18, 2001, FOR THE PURPOSE OF REFERRING TO THE LEGAL ELECTORS OF THE CITY OF EUGENE A CHARTER AMENDMENT CONCERNING THE PROCESS FOR ELECTION OF THE MAYOR AND CITY COUNCILORS. The City Council of the City of Eugene finds as follows: A. It would be in the public interest to submit to the legal electors of the City a measure amending Section 20 of the Eugene Charter of 1976 to authorize the election of the Mayor and City Councilors by means of instant runoff. NOW, THEREFORE, based upon the above findings, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. A city election is called for the purpose of submitting to the qualified electors of the City a measure attached as Exhibit 1 hereto, concerning the amendment of Section 20 of the Eugene Charter of 1976 by numbering the current language as subsection (2) and by adding a new subsection (1) to provide that the Mayor and City Councilors shall be elected by preference voting. F or the purposes of this paragraph, preference voting means a system of voting for candidates for nomination or election authorized by section 16, Article II of the Oregon Constitution, under which an elector may express the elector's first, second or additional choices among the candidates for nominations or election. The Charter amendment would grant the Council the discretion to determine when preference voting should be used, including whether to postpone its use until after the Legislature expressly authorizes its use. Section 2. The City Council orders a special city election to be held in the City of Eugene, Oregon, on the 18th day of September, 2001, in accordance with the provisions of Chapter 254 of the Oregon Revised Statutes, and the ballots shall be counted and tabulated and the results certified as provided by law. Section 3. The City Recorder is directed to give not less than ten (10) days' notice of the city election by publication of one (1) notice in the Register Guard, a newspaper published in the City and of general circulation within the City. The foregoing Resolution adopted this 25th day of June, 2001. ~JL,! t::2J , City Recorder Resolution Measure No. Section 20 of the Eugene Charter of 1976 is hereby amended by numbering the current language as Subsection (2) and adding a new Subsection (1), to provide as follows: Section 20. Election. (1) The City Council shall provide by ordinance that the Mayor and City Councilors shall be elected by preference voting. For the purposes of this subsection, preference voting means a system of voting for candidates for nomination or election authorized by section 16, Article II of the Oregon Constitution, under which an elector may express the elector's first, second or additional choices among the candidates for nomination or election. The City Council shall determine when preference voting should first be used. (2) Immediately after the votes at any municipal election have been canvassed, the city officer in charge of administering elections shall issue to each person declared by the canvasser to have been elected at the election a certificate of election. The certificate shall be prima facie evidence of the facts therein stated, but the city council shall be the judge of the election and qualifications of the mayor and councilors, and in case of a contest between two or more persons claiming to be mayor or councilor, shall determine the contest.
