RECITALS: A. The Lane County Local Government Boundary Commission by its Notice dated March 13,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective February 23,2001. Tax Lot 2100, Assessor's Map 17-04-14-14, located in the River Road region of north Eugene, west of River Road, south of Silver Lane, north of Kourt Drive, east of Grove Street, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. (Corey, EC ED 01-06) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. B. The Lane County Local Government Boundary Commission by its Notice dated March 14,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective February 26,2001. Tax Lots 100 and 200, Assessor's Map 17-04-24-21, located in the River Road region of north Eugene, east of River Road, west of the Willamette River, south of Merry Lane, north of Arbor Drive and more particularly described on Exhibit B attached hereto and incorporated herein by reference. (Christian, EC ED 01-07) Resolution - 1 That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. c. The Lane County Local Government Boundary Commission by its Notice dated August 2,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 7, 2001. Tax Lots 200 and 2400, Assessor's Map 17-04-14-13 and 17-04-14- 14 respectively, located in the River Road region of north Eugene, west of River Road, south of Silver Lane, north of Kourt Drive, east of Grove Street, and more particularly described on Exhibit C attached hereto and incorporated herein by reference. (Dickenson, EC ED 01-12) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. D. The Lane County Local Government Boundary Commission by its Notice dated August 3, 2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 29,2001. Tax Lot 2900, Assessor's Map 17-04-14-23, located in the River Road region of north Eugene, west of River Road, west of Bushnell Lane, north of Maxwell Road, east of Labona Drive, and more particularly described on Exhibit D attached hereto and incorporated herein by reference. (Ensley, EC ED 01-15) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. E. The Lane County Local Government Boundary Commission by its Notice dated August 7, 2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 11,2001. Tax Lot 204 and a portion of Tax Lot 300, Assessor's Map 17-04-23- 41, located in the River Road region of north Eugene, west of River Road, south of Elkay Drive, north of Sunnyside A venue, and more particularly described on Exhibit E attached hereto and incorporated herein by reference. (Tibbitts/Gildea, EC ED 01-20) Resolution - 2 That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. F. The Lane County Local Government Boundary Commission by its Notice dated August 7,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 18, 2001. Tax Lots 800 and 1200, Assessor's Map 17-04-14-32, located in the River Road region of north Eugene, west of River Road, north of Maxwell Road, east of Bushnell Lane, and more particularly described on Exhibit F attached hereto and incorporated herein by reference. (Community Markets, Inc., EC ED 01-21) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. G. The Lane County Local Government Boundary Commission by its Notice dated August 15,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective July 30,2001. Tax Lot 2703, Assessor's Map 17-04-14-13, located in the River Road region of north Eugene, west of River Road, north of Hamilton Drive, south of Kourt Drive, east of Grove Street, and more particularly described on Exhibit G attached hereto and incorporated herein by reference. (Smith, EC ED 01-35) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. H. The Lane County Local Government Boundary Commission by its Notice dated September 19,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective September 19, 2001. Tax Lot 1700, Assessor's Map 17-04-23-13, located in the River Road region of north Eugene, west of River Road, west of Fairway Drive, north of West Hilliard Lane, east of North Park Avenue and more particularly described on Exhibit H attached hereto and incorporated herein by reference. (Shields, EC ED 01-34) That property is contained in and is a part of the River Road Water District and River Road Resolution - 3 Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. I. The Lane County Local Government Boundary Commission by its Notice dated September 19,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective September 19,2001. Tax Lot 4000, Assessor's Map 17-04-14-43, located in the River Road region of north Eugene, west of River Road, south of Howard Avenue, north of Horn Lane, west of Oak Drive, east of Lake Drive, and more particularly described on Exhibit I attached hereto and incorporated herein by reference. (Zabel, EC ED 01-29) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. J. The Lane County Local Government Boundary Commission by its Notice dated October 11,2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective October 9, 2001. Tax Lot 5100, Assessor's Map 17-04-23-41, located in the River Road region of north Eugene, west of River Road, south of Park Avenue, east of Chestnut Drive, north of Knoop Lane and more particularly described on Exhibit J attached hereto and incorporated herein by reference. (O'Bryant, EC ED 01-42) That property is contained in and is a part of the River Road Water District and River Road Park and Recreation District. The City desires that the property so annexed be withdrawn from those Districts and that the City assume proportionate liability for the part of the Districts so withdrawn. K. The Lane County Local Government Boundary Commission by its Final Order No. 1180 dated June 7, 2001, advised that pursuant to ORS 199.490(1)( c), the following described real property was annexed to the City of Eugene, effective July 23,2001. Tax Lot 100, Assessor's Map 17-04-12-30, located in the Santa Clara region of north Eugene, east of River Road, north of Hunsaker Lane, east of Echo Lane, and more particularly described on Exhibit K attached hereto and incorporated herein by reference. (Homolka, C ED 01-16) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate Resolution - 4 liability for the part of the District so withdrawn. L. The Lane County Local Government Boundary Commission by its Notice dated August 9, 2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 25, 2001. Tax Lot 601, Assessor's Map 1 7-04-02-11, located in the Santa Clara region of north Eugene, east of River Road, north of Spring Creek Drive, west of Scenic Drive, and more particularly described on Exhibit L attached hereto and incorporated herein by reference. (Scott, EC ED 01-22) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. M. The Lane County Local Government Boundary Commission by its Notice dated August 7, 2001, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective June 5, 2001. Tax Lot 4701, Assessor's Map 17-04-11-42, located in the Santa Clara region of north Eugene, west of River Road, north of Irving Road, south of Federal Way, and more particularly described on Exhibit M attached hereto and incorporated herein by reference. (Mustoe, EC ED 01-19) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. N. The Lane County Local Government Boundary Commission by its Final Order No. 1188, dated August 2,2001, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 17, 2001. Tax Lots 4402, Assessor's Map 17-04-12-30, located in the Santa Clara region of north Eugene, east of River Road, south of Hunsaker Lane, west of Ross Lane, and more particularly described on Exhibit N attached hereto and incorporated herein by reference. (Keleher, C ED 01-33) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Resolution - 5 O. The Lane County Local Government Boundary Commission by its Final Order No. 1189 dated October 4,2001, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 19,2001. Tax Lots 2200, Assessor's Map 17-04-11- 42, located in the Santa Clara region of north Eugene, west of River Road, north of Federal Lane, west of Quiet Lane, and more particularly described on Exhibit o attached hereto and incorporated herein by reference. (Higgins, C ED 01-40) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. P. The Lane County Local Government Boundary Commission by its Final Order No. 950 dated February 6, 1992, advised that pursuant to ORS 199.490(1)(c), the following described real property is annexed to the City of Eugene, effective February 6,2002. Tax Lots 3200, Assessor's Map 17-04-04-00, located in the Highway 99 Industrial Corridor in North Eugene, on the northwest corner of Highway 99 and Enid Road intersection, and more particularly described on Exhibit P attached hereto and incorporated herein by reference. (R & B Equipment Company, C ED 92-2) That property is contained in and is a part of the Junction City Water Control District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The City Council proposes that the territory bounded by the line running as follows, which has heretofore been annexed to the City of Eugene, shall be withdrawn from the River Road Water District and River Road Parks & Recreation District: Tax Lot 2100, Assessor's Map 17-04-14-14, located in the River Road region of north Eugene, west of River Road, south of Silver Lane, north of Kourt Drive, east of Grove Street, and more particularly described on Exhibit A attached hereto and incorporated herein by reference. Monday, February 11,2002, at 8:00 p.m., Pacific Time, in the Council Chambers, City Hall, Eugene, Oregon, is hereby fixed as the date, time and place for hearing objections to the withdrawals. The City Manager shall cause a Notice of the date, time and place and purpose of the hearing, a copy of which is attached as Exhibit Q hereto, to be published in the Register Guard once each week for two consecutive weeks prior to the hearing and to be posted in four public places in the City for a like period of time.
