HomeMy WebLinkAboutResolution No. 4711 RESOLUTION NO. 4711 A RESOLUTION ESTABLISHING HAZARDOUS SUBSTANCE USER FEES FOR THE FISCAL YEAR COMMENCING JULY 1,2002. The City Council of the City of Eugene finds that: A. Pursuant to Article VII of Amendment IV to the Eugene Charter of 1976 (the "Amendment"), the City Council has previously adopted Resolution No. 4558 establishing fees to be paid by hazardous substance users within the City for the 1998 fiscal year, Resolution No. 4587 establishing fees to be paid by hazardous substance users within the City for the 1999 fiscal year, Resolution No. 4634 establishing fees to be paid by hazardous substance users within the City for the 2000 fiscal year, and Resolution No. 4667 establishing fees to be paid by hazardous substance users within the City for the 2001 fiscal year. B. In accordance with other requirements of the Amendment, the City Council, by ordinance, has adopted the City's Hazardous Substance Tracking Instructions, which provide guidance to hazardous substance users in completing and submitting the reports required by the Amendment. C. As a result of decisions of the Court of Appeals and Circuit Court in litigation involving the Amendment, the City revised the method of calculating the hazardous substance user fees. Section 3.694 of the Eugene Code, 1971, which was adopted on February 28, 2000, by Ordinance No. 20189, imposes a fee upon hazardous substance users in an amount per FTE to be established by resolution of the Council and paid annually, no later than May 1 of each year. Resolution - 1 D. The Toxics Board has recommended a fee of $10.79 per FTE be imposed for the fiscal year commencing July 1, 2002, in order to cover the expenses of the program for that fiscal year. Issues surrounding a shortage or surplus offunds at the end of the fiscal year will be addressed equitably for all participating hazardous substance users, in accordance with generally accepted accounting procedures. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. A fee of $10.79 per FTE is hereby imposed as the fee to be paid by hazardous substance users within the City of Eugene for the fiscal year commencing July 1,2002. The fee shall be due and payable by May 1, 2002. Section 2. As used in this Resolution, the terms "FTE," and "hazardous substance users" have the meanings ascribed to them in Section 3.692 of the Eugene Code, 1971. Section 3. The fees collected pursuant to this Resolution shall be used solely for the purpose of operating the Toxics Right-to-Know Program created by Amendment IV to the Eugene Charter of 1976 and implemented by subsequent ordinances of the City, commencing with the July 1,2002 fiscal year.
