A RESOLUTION AMENDING RESOLUTION NO. 4472
APPROVING A MULTIPLE-UNIT RENTAL HOUSING
PROPERlY TAX EXEMPTION FOR PROPERlY LOCATED
AT 701 AND 725 EAST 14TH AVENUE AND 1357 AND 1377
HILYARD STREET (CARMICHAEL).
The City Council of the City of Eugene finds that:
A. On December 4, 1995, based on the Report and Recommendation of the
Director of the Planning & Development Department, the City Council adopted Resolution
No. 4472 approving the application of Arthur C. Carmichael, Jr. for a property tax
exemption under the City's Multiple Unit Rental Housing Property Tax Exemption program
for the improvements to be constructed upon the property located at 701 and 725 East 14th
Avenue and 1357 and 1377 Hilyard Street, Eugene, Oregon, and more particularly described
on Exhibit "A" attached thereto.
B. As one of the conditions of approval, the Resolution provided that the project
contain public benefits that included, but was not limited to six units to be completely "wheel
chair accessible," with all units adaptable to ADA standards. The Director of the Planning
& Development Department has issued a Revised Report and Recommendation indicating
that this condition should have stated that the project will include three units on the main
floor that will the ADA accessible immediately upon completion of the project, and an
additional three units on the main floor that will be adaptable to ADA accessible standards.
C. The Planning & Development Department Director, as designee of the City
Manager, has therefore recommended that the Council amend Subsection 3 of Section 1 of
Resolution No. 4472 to accurately reflect the number of units that will be ADA accessible
or adaptable.
NO~ THEREFORE,
BE IT RESOLVED BY THE CIlY COUNCIL OF THE CIlY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Based upon the revised recommendation of the Director of Planning and
Development and the above findings, Subsection 3 of Section 1 of Resolution No. 4472
adopted by the City Council on December 4, 1995 is amended to provide:
3. The project shall contain public benefits that include, but are not
limited to: three units (two 2-bedroom and one I-bedroom) on the main floor

that will be ADA accessible immediately upon completion of the project, and
three units (two 2-bedroom and one I-bedroom) on themain floor that will be
adaptable to ADA accessible standards, providing a possible six ADA
accessible units out of the 53 total units; enhancement of neighborhood
amenities through development of and provision of landscaping; and will
provide covered automobile parking with 40 parking spaces and plentiful
bicycle storage and parking. The applicant shall pay the low income housing
fee, which during years three through ten of the exemption period, will
generate $6,490 annually for the City's low income housing fund.
Section 2. Except as herein corrected, all other provisions of Resolution No. 4472
remain in full force and effect, and the City Recorder is requested to append a copy of this
Resolution thereto.
Section 3. The City Manager, or the Manager's designee, is requested to forward a
copy of this Resolution to the applicant, and to the other taxing districts affected hereby
within ten days from the date hereof, and to cause a copy of this Resolution to be filed with
the Lane County Assessor.

REVISED REPORT AND RECOMMENDATION
of the
Director of the Planning & Development Department
Arthur C. Carmichael, Jr. Application for
Multiple-Unit Property Tax Exemption
The Director of the Planning & Development Department of the City of Eugene
finds that:
On December 4,1995 Council approved Resolution No. 4472, granting a property tax exemption
to Arthur C. Carmichael, Jr. for a project to be constructed at 14th Avenue and Hilyard Street.
The Report and Recommendation and the Resolution contained an error. The error was found in
Section 2.2.1 of the Report and Recommendation. Section 2.2.1 stated: ( Six units to be
completely "Wheel Chair Accessible"; All units are adaptable to ADA standards)
Section 2.2.1 of the Report and Recommendation shall be corrected to read: ( The exterior will
be designed to include front and rear entry ramps, and wide hallways, corridors and
walkways on all levels. The elevator will also have sufficient accommodations. There will
be three (3) units, two-2 bedrooms, and one-l bedroom, on the main floor that will be ADA
"accessible" immediately upon completion of the project. There will be three (3) units,
two-2 bedrooms, and one-l bedroom, on the main floor that will be "adaptable" to ADA
"accessible". The developer will consult with the appropriate agency at the time of
conversion from ADA "adaptable" to ADA "accessible".
This will provide a possible 6 ADA "accessible" units out of 53, or approximately 11 % of
the total units constructed.
With this correction, ADA standards have been met, as well as all other requirements and criteria
set forth in the City's adopted Standards and Guidelines for Multiple-Unit Rental Housing
Property Tax Exemption.
