Initiation of the amendments does not commit the City Council to any outcome. BACKGROUND The Eugene-Springfield Metropolitan Area General Plan (Metro Plan) and the Eugene-Springfield Metropolitan Area Public Facilities and Services Plan (PFSP), a refinement plan, incorporate long-term utility projects and schedules. As described in its letter to the City Council (Attachment A), EWEB would like these plans to be amended to reflect more recent thinking about project placement and timing. As the projects are not all located within the Eugene Urban Growth Boundary, these amendments will require approval by multiple Metro jurisdictions. EWEB has hired the Lane Council of Governments (LCOG) to process the application and provide draft findings on behalf ofEWEB. Since LCOG managed both most recent updates to the Metro Plan and the PFSP, City staff expects the impact on City resources to be low. The rules for Metro Plan amendments are consistent for all three Metro jurisdictions. Staff believes these amendments are a Type I amendment, because there are too many locations referenced in the text to be considered "site specific." Type I amendments must be initiated by one of the three Metro governing bodies. When a citizen or, in this case EWEB, requests a governing body to initiate an amendment, that body must act within 60 days from when the staff report is submitted or the request will be considered denied. No public hearing is required. No reason for denial is required. Once the amendment is initiated, there will be a joint public hearing by the Planning Commissions, and a joint hearing by the governing boards before a decision is rendered. Initiation of the amendments does not commit the City Council to any outcome. RELATED CITY POLICIES The Metro Plan and PSFP contain the adopted policies and service strategies related to infrastructure improvements needed to meet the region's needs. EWEB would like the Metro Plan and PFSP to be updated to be consistent with its 2004 Water System Master Plan. Existing Metro Plan policies include the following: Eugene and Springfield and their respective utility branches, Eugene Water & Electric Board (EWEB) and Springfield Utility Board (SUB), shall be the water and electrical service providers within the UGB. Local governments shall continue to monitor, to plan for, and to enforce applicable air and water quality standards and shall cooperate in meeting applicable federal, state, and local air and water quality standards. Extend the minimum level and full range of key urban facilities and services in an orderly and efficient manner consistent with the growth management policies in Chapter II-C, relevant policies in this chapter, and other Metro Plan policies. Use the plannedfacilities maps of the Public Facilities and Services Plan to guide the general location of water, wastewater, stormwater, and electrical projects in the metropolitan area. Use local facility master plans, refinement plans, and ordinances as the guide for detailed planning and project implementation. Modifications and additions to or deletions from the project lists in the Public Facilities and Services Plan for water, wastewater, and stormwater public facility projects or significant changes to project location, from that described in the Public Facilities and Services Plan plannedfacilities Maps 1, 2 and 3, require amending the Pubic Facilities and Services Plan and the Metro Plan, except for the following: a. Modifications to a public facility project which are minor in nature and do not significantly impact the project's general description, location, sizing, capacity, or other general characteristic of the project; or b. Technical and environmental modifications to a public facility which are made pursuant to final engineering on a project; or c. Modifications to a public facility project which are made pursuant to findings of an Environmental Assessment or Environmental Impact Statement conducted under regulations implementing the procedural provisions of the national Environmental Policy Act of 1969 or any federal or State of Oregon agency project development regulations consistent with that act and its regulations; or d Public facility projects included in the PFSP to serve land designated Urban Reserve prior to the removal of the Urban Reserve designation, which projects shall be removedfrom the PFSP at the time of the next Periodic Review of the Metro Plan. Ensure that water main extensions within the UGB include adequate consideration of fire flows. LICMOl2006 Council AgendasIM060724IS0607242E.doc SUB, EWEB, and Rainbow Water District, the water providers that currently control a water source, shall examine the needfor a metropolitan-wide water master program, recognizing that a metropolitan-wide system will require establishing standards, as well as coordinated source and delivery systems. COUNCIL OPTIONS The council may approve or deny the request to initiate the Metro Plan and PFSP amendments requested by EWEB. If the council fails to act within 60 days, the request will be considered denied. The City Council may also condition the initiation on the premise that EWEB pay the filing fee that would have applied had it initiated the amendment independently (up to $7,959.60). This action would be consistent with recent requests by public agencies for initiation of amendments in Eugene. CITY MANAGER'S RECOMMENDATION The City Manager recommends that the City Council initiate the Metro Plan and Public Facilities and Services Plan amendments requested by EWEB, provided EWEB first deposits the filing fee with the City. Your timely attention to this request will be most appreciated so that EWEB can .meet its planned facility construction timelines. The purpose of the amendment is to reflect in the plans proposed changes in project description, location, and/or timeframe for all listed projects. EWEB updated its Water System Master Plan in 2004. This resulted in an update of needed facilities that are now in EWEB's Capital Improvement Plan. The PFSP should be updated to reflect these changes prior to EWEB completing these projects. Some of the projects that appeared on the original PFSP list have been completed and are therefore proposed for removaL Others have been added to reflect the need for increased capacity to serve new areas that are grOWIng. In addition, a new project is proposed, the Hayden Bridge Filtration Plant/Moe Hill Reservoir Systems Intertie, which will establish cOlll1ections between three water systems that could provide 10 million gallons per day of water exchange as an emergency backup for each water system. This project provides other benefits as well, including a significant cost savings in the scope and cost of the initial project to upgrade the 56-year old Hayden Bridge Filtration Plant to current industry standards. I understand that this process to amend the Metro Plan must be initiated by the Eugene City Council and that the amendment process may require participation by the Springfield City Council and/or Lane County Board of Commissioners because the request is to amend a functional plan of the Metro Plan. I understand that this proposal will be part of a Joint Planning Commission public hearing process as well.
