RESOLUTION NO. 4889
A RESOLUTION AUTHORIZING THE INDEPENDENT
POLICE AUDITOR TO HIRE, SUPERVISE AND MAKE
OTHER EMPLOYMENT DECISIONS REGARDING THE
AUDITOR'S SUPPORT STAFF.
The City Council of the City of Eugene finds:
A. On November 8, 2005, the City electors approved Ballot Measure 20-106 which
added a new Section 15-A, "External Review of Police" to the City Charter. Section 15-A
provides, that notwithstanding Section 16 of the Charter, that the City Council is granted the
authority to hire, supervise and specify the salary of the Independent Police Auditor established
by Section 15-A.
B. Section 15-A further provides, that notwithstanding Section 16 of the Charter, the
City Council may authorize the auditor to: (a) receive, classify and route complaints about sworn
police officers and civilian police employees; (b) contract with persons or entities to perform
outside investigation of such complaints; (c) monitor the City's internal investigations, including
but not limited to access to all evidence developed as part of the investigation and participation
in investigative interviews related to such complaints, and require the City to undertake
additional investigation; (d) make recommendations to the City Manager or designee following
the investigation; (e) prepare reports on complaints, trends and police practices in general; and
(f) act as a liaison to and provide staff support for the Civilian Review Board, which the Council
is authorized by Section 15-A(2) to appoint.
C. The electorate approved the amendment to the Charter, Section 15-A, to provide a
process for review of complaints involving police employees that is independent of the chain of
command of the City Manager and the Chief of Police.
D. The budget approved by the City Council for the office of the Independent Police
Auditor, for this fiscal year, provides for the three positions required to perform those many
responsibilities.
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon as follows:
Section 1. The Independent Police Auditor shall have exclusive authority to hire,
supervise, and to make all other emplOYment decisions regarding the auditor's support staff.
Section 2. No change relating to the authority to hire and supervise the auditor's staff
shall be made without formal action of the City Council amending this Resolution.

This Resolution shall become effective immediately upon its adoption.
The foregoing Resolution adopted the 14th day of August, 2006.
