AMENDMENT OF SYSTEMS DEVELOPMENT CHARGES FOR REGIONAL
WASTEWATER SYSTEM ADOPTED BY ADMINISTRATIVE ORDER NO.
58-16-14-F.
The City Manager of the City of Eugene finds as follows:
A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the
City of Eugene to determine and set fees and charges to be imposed by the City for services, goods,
use of municipal property, and licenses and permits. EC 7.710(5) and Section 2.4 of the Systems
Development Charge (SDC) Methodologies authorize the City Manager to adopt by administrative
order pursuant to EC 2.020, a change in the amount of a reimbursement fee or an improvement fee
if the change in amount is based on: (1) the periodic application of an adopted specific cost index
(inflationary adjustment); or (2) a modification to any of the factors related to rate that are
incorporated in the established methodologies. However, pursuant to Section 2:4 of the SDC
Methodologies, revisions of such fees in an amount greater than five percent within any 12 -month
period must be established by resolution of the Council.
B. The SDC Methodologies were adopted by Resolution No. 4900 effective May 7,
2007, and have subsequently been amended by Resolution Nos. 4929, 4977, 4991 and 5100.
Inflationary adjustments to the Regional Wastewater System have been adopted, most recently by
Administrative Order No. 58-16-14-F, effective July 1, 2016, which resulted in an increase in SDC
rates ranging from about 1.57% to 1.69%, depending upon the strength of wastewater discharge
associated with development categories. In addition, the Metropolitan Wastewater Management
Commission (MWMC), recently adopted a Resolution recommending that the cities of Eugene
and Springfield implement amendments to the MWMC Capital Improvements List and MWMC
SDC Fee Schedule for the Regional Wastewater System effective March 1, 2017.
C. In accordance with the procedures set forth in EC 2.020 and 7.710(5) of the Eugene
Code, 1971, and the recommendation of the MWMC, and after considering the applicable policies,
enactments and directives of the City Council, the amount charged for these services by the City
in, the past, the full costs of providing these services supported by the fees, the amounts charged
by other comparable providers, and the revenue needs of the City as determined by the adopted
City budget, on February 15, 2017, I issued Administrative Order No. 58-17-02 proposing to
implement MWMC's recommended amendments to the MWMC Capital Improvements List and
MWMC SDC Fee Schedule for the Regional Wastewater System as shown on Exhibit A attached
to that Order.
D. The amendments to the MWMC Capital Improvements List and MWMC SDC Fee
Schedule for the Regional Wastewater System are based on a modification to factors related to
rate that are incorporated in the SDC Methodologies and result in a maximum increase of 2.384%
for residential and commercial low strength discharge, and decreases ranging from 0.758% to

4.614% for commercial and industrial discharge depending upon the strength of wastewater
discharge. As such, the amendments do not result in a revision of fees in an amount greater than
five percent within a 12 -month period.
E. Notice of the proposed amendments was given by providing copies of
Administrative Order No. 58-17-02, including Exhibit A (the proposed amendments) and Exhibit
B (the Notice), to the Mayor and City Councilors and making those documents available for
inspection by interested persons at the office of the City Engineer, Public Works Department, 99
East Broadway, Suite 400, Eugene, Oregon, 97401. In addition, on February 20, 2017, the
documents were posted at two locations at City Hall, and the Notice of the proposed adjustments
was published in the Register -Guard Newspaper. Persons who requested notice of the
amendments were mailed informational postcards on February 21, 2017, as notification of the
proposed amendments.
F. Notice provided that written comments would be received for a period of 15 days
from February 20, 2017 (the date of posting and publication), and from February 21, 2017 (the
date informational postcards were mailed). No comments were received within the time or in the
manner set forth in the Notice.
G. I find that the proposed amendments set forth in Exhibit A are consistent with
adopted policies of the City, are in conformity with applicable state law, and are authorized by EC
7.710(5) and Section 2.4 of the SDC Methodologies.
On the basis of these findings, I order that:
1. The adjusted MWMC Systems Development Charges set forth in Exhibit A
attached to this Order are to be implemented effective March 10, 2017.
2. The unamended MWMC Systems Development Charges shall remain in full force
and effect.
