AN ORDINANCE CONCERNING PROHIBITION OF EXTREME
FIGHTING; REPEALING SECTION 4.740 OF THE EUGENE CODE,
1971; AND AMENDING SECTION 4.990 OF THAT CODE.
The City Council of the City of Eugene finds that:
A. On January 8, 2007, the City Council adopted Ordinance No. 20375 adding
Section 4.740 to the Eugene Code, 1971, which prohibited extreme fighting except for
matches in which the participants and the promoter comply with rules established by the
City Manager.
B. In June of 2007, the Oregon Legislature adopted Senate Bill 492, (OR Laws
Chapter 585, 2007) which provides that ordinances regulating mixed martial arts
adopted by cities and counties before February 1, 2007, may not be enforced once the
Superintendent of State Police adopts administrative rules regulating mixed martial arts
matches. The definition of "mixed martial arts" contained in Senate Bill 492 includes the
conduct defined in the Eugene Code as "extreme fighting."
C. On July 1, 2008, amended Oregon Administrative Rules 230-010-0000 et
seq., regulating mixed martial arts matches, became effective.
D. Because the State of Oregon now has sole jurisdiction to regulate mixed
martial arts, including the conduct defined in the Eugene Code as extreme fighting,
Section 4.740 of the Eugene Code, 1971, which contains the provisions prohibiting
extreme fighting, should be repealed.
THE CITY OF EUGENE DOES ORDAIN AS FOllOWS:
Section 1. Section 4.740 of the Eugene Code, 1971, is repealed.
Section 2. Subsection (1) of Section 4.990 of the Eugene Code, 1971, is
amended to delete the penalty reference to Section 4.740 in the list of penalties; and
Subsection (11) of Section 4.990 of the Eugene Code, 1971, is repealed.
Section 3. The City Recorder, at the request of, or with the concurrence of the
City Attorney, is authorized to administratively correct any reference errors contained

herein or in other provisions of the Eugene Code, 1971, to the provisions added,
amended or repealed herein.
