ADMINISTRATIVE ORDER NO. 53-06-06-F
of the
City Manager of the City of Eugene
ADOPTING A PAYDAY LOANS BUSINESS LICENSE FEE
SCHEDULE.
The City Manager of the City of Eugene f"mds as follows:
A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to
determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits. In addition, Section 3.552 of that Code
specifically authorizes the City Manager to establish fees in order to implement the newly
adopted provisions regulating payday loans as set forth in Sections 3.550 to 3.560 of that Code.
B. Pursuant to that authority, on August 11, 2006 I issued Administrative Order No.
53-06-06 and notified the Mayor and City Councilors that I intended to adopt the Payday Loans
Business License Fee Schedule as set forth in the Notice attached as Exhibit A thereto, to
become effective September 1, 2006.
C. The Notice was also posted at two locations at City Hall and published in the
Register Guard, a newspaper of general circulation within the City, on August 15, 2006,
provided to persons who had requested notice, and was made available for inspection by
interested persons at the offices of the City Manager, 777 Pearl Street, Eugene, Oregon 974021
during normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of
holidays). The Notice provided that written comments would be received thereon for a period of
15 days from the date of posting and publication. No comments were received within the time
and manner required by the Notice.
D. Based upon the above findings, and the findings in Administrative Order No. 53-
06-06, I find that the proposed fees are consistent with applicable policies and directives of the
City Council, including the requirement that the fees charged recover the City's costs of
providing the services, and the Payday Loans Business License Fee Schedule attached as Exhibit
A hereto should be adopted as the fees to be charged for the services set forth therein.
On the basis of these findings, I ~rder that:
1. The Payday Loans Business License Fee Schedule attached as Exhibit A hereto is
hereby adopted, effective as of September 1, 2006.
2. The City Recorder is directed to forward a copy of this Order to the Mayor and
City Councilors. -f1...
