April 9, 1928. ,Air."' ~ Minutes of the regular meeting of the Common Council held at 7;30 o'clock P.M. on April 9, 1928. ~here were present Mayor AL Williamson and all members of the Council. Meeting called to order by the W~yor. Minutes of the meetings of March 12, March 19, and March 26, 192~,apprdved. C A Wintermeier appeared as Attorney for n~s H J Manley claiming a damage aga.1,nst the City for the death of H J Manley and threatening suit unless the amounts claimed in the petition are paid. Said matter was referred to the JudiciaI' Committee and the City Attorney. As per the call, bi~s were opened as follows: Paving Orchard Street from the South line of ]'ranklin Boulevard to the North line of 19th Avenue, as follows: Hargrea~es and Lindsay ::3tein Bros. Guy F Pyle ~24562.00 228'74.00 22055.50 Such bids were referred to the Street C001mittee for report and it reported favor- abl~ on the bid of Guy F Pyle at $22055.50. On motion such report was adopted and the Mayor and Recorder were instructed to enter into a contract with such success- ful bidder for ,such contract v\I'lork. Bids were opened for the wideni~,g and depening of the Amazon Slough from a point 240 feet Vlest of Chambers Street to a point 2500 feet I~orth and West of the starting point as follows: Eugene Sand and Grave Co. L G Harmon i'ji2615.00 2592.10 I On motion, all bids were rejected. Bids were opened for the tileing and rocking the runwasy for aviation uses, Of the Aviation J:1'ield, as follovvs: Eugene Sand and Gravel Co. A C Mathews 1.50 per cubic yd. 1.64 per cubic yd. 0uch bids were referred to the Street Committee as to the bids for furnishing the gravel only for such work and the bid of the Eugene Sand and Gravel Co. a t ~pl. 50 per cubic yard was recommended. On motion such report was adopted. Commi t tee: The proposed Building Code Ordinance was read the second I time and laid over. The Judiciary Commi ttee regorted on the II1:?, tter of the objections to the nRodeo Show" to be held ,il'air Week and ::::tated it was outsi(ie the jurisdiction of the Judiciary Committee and recommended the matter be left alone. On motion, such recommendation was adopted. The Finance Commi ttee recommended :::!,ll bills as herein set out, be paid. On roll call such recommendation was adopted. Street Committee: The Street Co~~ittee reported on the matter of repairing the streets acljacent to the street car tracks al'J.Q recommended the City repair the same with its own equipment for those areas not rep~ired by the >jouthern Pacific Railway Go. On motion, such recommendation was ad.oJlted, He,(lclershott voting No. The S tree t C oHuni t tee reported on the mat te I' of the gas pumps on the parking and reco~nended. the Chief of Police be instructed to investigate the pumps and that all pumps not in use be ordered rerwved, the remaining pumps to be left as long as they are in use. The Street Committee reported on the wlidening of Willamette Street stating the majority of property owners thereon appears to be against it and recommended the matter be tabled. On motion, such recoi11f.1endation was aclopted. Fire and Water Committee: The Fire and Water Committee spoke on the applica- tion of the Terminal Auto Coat 5th and Willamette Street asking to install a curb gasoline pump and stated he heard of some inside pu@ps in the City. The whole matter was discussed. The Chief of Police was directed to report on inside pumps at the next meeting. Health Committee: The matter of bills presented for heat, light and water for the Rest Cottage was discussed, there appearing to be some misunderstanding be- tween the County and City in the matter. The .1\1ayor and the Health Committee agree to meet the County Court and settle the dispute. I The Chief of Police reported the barn West of Blair Boulevard on which he is to report, is in a sanitary condition except the ground is wet at this time of year. The Printing Committee had no report to make. The Sewer Committee recommended a storm sewer be constructed on the South side of 13th Avenue from Moss Street to the alley and the following resolution was offered and unanimously adopted: RESOLUTION BE IT RESOLVED b;y the Gommon Council of the City of Eugene that the City of Eugene construct a Storm Sewer on the South side of 13th Avenue from Moss Street to the Alley East of Moss Street. Be it further Resolved that the City :B:ngineer immediately prepare plans and spec if ica tions for such improvement wOl'k and the City Rec order advert i se com- petitive bids for such improvement work. Be it further Resolved that the said work be done by the City and that the same be paid for from the sewer fund. The Police Co~mittee had no report to make. I The Park Board reported on the ~uestion of leasing the Auto Park and recom- mended the same be not leased. Such recommendation was adogted. ~ '5~ ~ ~ ~ I The City Engineer was no t ready to re:port on the upkeep of the Villard and Aea te Street s parkings, and agreed to have a re:port at the next mee t ing. The Chief of Police reported all Richfield ;;;'igns have .been removed from the parkings. , f!~ '",~ , ,;C Ib The Mayor appointed Ivlontey Lesley plumbing and sani tary Inspector in lieu of Walter Ross. On motion such nomination was confirmed. This being the time to hear objections to the opening of Almaden Street from 6th Avenue to 8th Avenue, Florence M Stevens appeared and protested in writing to the terms of said report. After discussion the matter was referred to the Judiciary Committee. Before the close of the Session the Judiciary Committee report ed on such matter and recommended such objections be over-ruled and the report adopted. On motion, such recommendation VlaS adopted. J 1\1 Moore invited the Mayor and Council to attend the opening of his new slaughter house on April 12, 1928. Sucn invitation was accepted. A/petition was received for a storm sewer in the alley between Moss and Villard Sts from 13th to 15th Avenues. Said matter was referred to the Sewer Committee and the City Engineer for report. A petition against the widening of 8th Avenue' West was received. As there is u no petition on file to wi'den said street the matter was held over. Oil contracts were received from the Shell Oil Co., the Standard Oil Co. and the General Petroleum Corporation to furnish gas and oil to the City for the ensu- ing year; the matter was referred to the Finance Committee and aditional bids were cffalled for. I Reports from the Police 1~tron, the Meat and Milk Inspector and the Inspector of Buildings were presented and fi~d. A plat of ~unset Terraces was filed, approved and adopted by Ordinance as herein set out. An application by the Terminal Auto Co. to cut the curb at 521 Willamette Street was referred to the Gouncil on the refusal of the City Engineer to approve the same. Said matter was referred to the Street Committee. The City Attorney reported on a meeting of the Mayor, members of the Health Committee and members of certain Granges pertaining. to the new meat Ordinance and the same was discussed, The City Attorney was directed to re-draft Section 5(:0t: the meat Ordinance reducing the fee to $1.00 to those selling meat in the City. Vote be ing had, Councilmen Viashburne and Read voted IINo, 11 others l1aye." The City Attorney spoke on the expense reauired to publish the notices of election in the three annexation issues and stated the notices have been published once giving the names of all members of the Boards and stating if there is no ob- jection, he will cut down the notices in succeeding issues by omitting names of members of the Boards, thus saving expense. The Mayor asked Prdsident of the Council, Washburne, to take the Chair. Mr. VHlliamson thenc spoke sta ting the Redwood Empire Pacific Coast Caravan is to tour the State and expects to be in Eugene on Monday, April 30, 1928 and an invitation I has been extended to the City to' help them celebrate. The Mayor suggested we accept the inv:btation and get out the Municipal Band and join with the Chamber of Commerce~::in maktng the matter a complete success. On motion, such recommendation was approved. Melvin Hanson and other camp owners a:ppeared and asked the City close the Auto Camp. The matter was dise~ssed and they were informed the City is to operate the camp at least the coming SUllliiler. One sidewalk improvement ordinance v~s read the first time and passed its second and third reading by title by unanimous consent under suspension of the rule and was placed on its final passage. I An Ordinance levying assessments for paving the alley between 12th and 13th Avenues ,from Alder to Kincaid Street, having been read the first time on March 26, 1928, and registered notices sent, and having been read the second time the notice of protest by 1-( L Edwards filed j,n writing was read, considered, and over- ruled. An Ordinance acce:pting and ratifying the accel')tance of the bis. of v'im. Hardgreaves and Fred Lindsa~y, doing business as Hara:greaves and Lindsay for paving the alleys between Oak and Pearl Streets and 12th and 13th Avenues, v~s read the first time and passed its second and third readings by title by unani- mous consent under suspension of the rule and was placed on its final passage. The protest of Florence H stevens was read, and after' due consideration, was overruled. It then passed its second. and third readings by ti tIe by unanimous consent under suspension of the rule and was placed on its final passage. An Ordinance providing for the issuance and sale of ',~50, 000.00 Sewer Bonds, 1926, was read the first time and passecL its second and third readings by title by unanimous consent under suspension of the rule and was :placed on its final passage. An Ordinance pr'oviding for the making of an exclusi ve contract for the haul- ine; of garbage, rubbish and refuse, having been read the first time on March 26, 1928, it passed its second and thir'd readings by ti tIe by unanimous consent under suspension of the rule and was placed on its final passage. Three sidewalk improvement ordinances were read the first time and passed their second and third readings by title by unanimous consent u!lder suspension of the rule and were placed on their final passage. An Ordinance adopting and approving the plat of Sunset Terraces a Replat of portions of Lots 2,3,4, and 5, Fairmount, an Addition to the City of Eugene, was read the first time and passed its second and third readings by title by unani- mous consent under suspension of the rU~Le and. was 111aced on its final passage. I An Ordinance adopting the survey, ])la t an d report of the City Engineer as to the proposed opening and establishment of ~yler Street from 8th Avenue to 60.3 feet South of 9th Avenue, was read the fitst time and passed its second and third readings by title by unanimous consent under suspension of the rule and was ~laced on its final passage. '5~ ,I An Ordinance adopting the surveYt plat and report of the City Engineer as to the proposed opening of Polk Street from 12th Avenue to the South Ci ty Limi ts, was ~,~;~ read the first time and passed its second and third readings by title by unanimous ~~ consent under suspension of the rule and was placed on,its final passage. The ayes L~ and nays were called, all present voting aye, naYt none. The Ordinance was declared passed and numbered 6786. The following resolution was offered and unanimously adopted: RESOLUTION. Whereast it appears to the Oommon Council of the City of Eugene that hereto- fore Lot No.2, in Block No. Q in Hendrick's Amended Addition to Eugene, Lane County, Oregon, was sold for delinquent taxes for the year 1919, which suit was filed January 14, 1924, and pursuant to said suit sheriff's deed to Lane County, Oregon, was issued dated Aue;ust 9, 1924, and recordecl September 9, 1927, cohveying to Lane CountYt Oregon, title to said property under such tax foreclosure, and Whereas, thereafter and on October 17, 1925t Lane County re-conveyed said property to Oren C Davis and that the said Oren C Davis subsequently conveyed said property to William A Taylor and Juetta T Taylort husband and wifet And it Further appearing to the Common Council that said property v~s encum- I bened with certain municipal liens, to-Wit; Sewer assessment levied January 26, 19t3t on which there is unpaid ~25.4l and interest from January 26, 1913, docketed in B00k 2, at Page 180 of the Lien records of the City of Eugene, and Whereas, said property is likewise encumbered with a municipal lien in the sum of ~70.14 for grading and graveling the street opposite said property, with interes from August 8,1921, which lien is docketed at Page 456 of Volume 3 of the docket of City liens of the City of Eugenet Oregon, and Whereast application has been made to the City Council by William A Taylor and Juetta A Taylor for the cancellation of such liens for the reason that upon the sale of the property to Lane County such liens were in fact cut off and render- ed void but that said liens constitute a cloud against applicants' propertYt and \ihereas, the City Attorney has been authorized by the Gommon Council to make a suitable settlement with the owner of said property for the cancellation of said liens, and the City attorney has agreed with the present owners that upon the pay- ment of ~25.00 to the City of Eugene that such liens shall be cancelled upon the lien docket of the City. . THEREFORE be it resolved by the Common Council of the City of Eugenet Oregon, that the City Treasurer be and he is hereby directed to cancel upon the lien docket of the City of ~ugenet that certain sewer assessment in the sum of 025.41 and I interest from January 26, 1913, docketed at page 180 of Volume 2, and also that certain assessment for grading and graveling in the sum of ;;p'70.14 docketed August S, 1921, at pa@ 456 of Yollime33 of the City lien docket, be and they are hereby ~ 5i6 I - - , -C-'~:' ~- -:::::;e~n::::c::: same is satisfied cancelled and satisfied of record, and the City Treasurer is to endorse on his lien docket opposite each entry, that the 10 in full.
