~4 Minutes of the regular meeting of the Common Council held on the 13th

r""\ day of November', 1928, meeti~ being on that date instead of Noveluber 12, 1928,
I which was the regular date for the City Council, but being a holiday, no meeting
I held until the following night. There we.t'e present at said meeti~ Mayor A. L.
Williamson and all members of the Common Council except Rugh and Monroe who
il were absent.

II The minutes of the meetings of October 8th and October 22nd, 19'28,
appro ved.
I,
L. P. Harmon ap-peared inquiring about payment under h.ESl contract for the
construction of the Outlet of the Polk St.t'eet Sewer, under which contract the
City Council, Harmon, and others have been sued. The City Attorney explained the
situation, stating before any money is di:sbu.Dsed, the Bond Company should be
notified and its consent secured to such payment, and W. P. Fell, as Agent of the
Surety Company, appeared and requested th(~ Cit}y Attorrey to write such matter as
he desires, and he would forward it to the Bonding Company. Such action was
approved.
This being the time set to open hids for the sale of Se'L'ies A-H- Improve-
ment Bonds, in the sum of $133,120.05, thEt. following bids were .received:
Gecr-ge H. Burr, Conrad & Broom, Inc.; Ferris & Hardgrove-;
Freeman, Smith & Camp Co.:
Par and accrued interest wi th .Lnterest at the rate of 5i%
per annum with a premium of $100.10 for each $100.00 par
valuE3 of bonds purchased, the_ City to furnish a certified
transcript Qf the proceedings, and the purchaser to furnish
his own legal opinion. - I

Said bids were .referred to the Finance Committee for report, and it
reported favorably on the bid of G,eor~e H. Burr, Conrad & Broom, Ine.; Ferris &
Hardgrove; Freeman, Smith & Camp Co., at par and accru.ed interest with interest
at the rate of .5i% per annum with a premium of $100.10 for each $100.00 par value
of bonds purchased, the City to furnish a certified transcript of the prooeedings,
ani the pl'llchaser to furnish his own legal opihion. On motion, such report was
I unanimously ado:pted, and the Mayor and Reoorder authorized to execute said bonds

Commit.tee reports were called for:--
The Judiciary Committee reported there has been no meeting between the
Committee and mE~mbers of the bicycle olubs looking to the licensing of bicycles
in the City. Further time was granted for such p1.U'p os,e.
The Jucliciar y C ommi t tee als 0 l' eported there has been no meet ing betweeJil
such Committee and the junk dealers of the City looking to the licensing of junk
,I dealers. FurthE~r t ilne was uanted en this matter also.

:i The Finance Committee reported favorably on the bills as presented, and

on motion, such report was adopted and the :Mayor and. Recorder directed to issue
warrants for the same. ..
The StJ:'eet Committee asked the City Engi.na'er to report on the matter of
the bleachers at; the Mill Race on Fran~li!.L Boulevard, and the Engineer stated the I
only way he has found to remedy the si tuat,ioll now exisitng, is to move the Mill
Race back from 1ts present location. After discussion the matter was referred
back to the Street Committee and the City Engineer wit-h ftt.rections to the
Engineer to 'bring in plans and spec,tfications for such work, toge therwi th an
estiaate therefc)r.

The report of W. H. .Nlexander as Building Inspector was ordered filed.
I A request was made for a Street light at the intersection of 25th Avenue and ~

Potter street. Said matter was referred to the Fire & Water Committee. C'-J

,Another communioation was received f'rom Harry T. Holden, relative to his 1-,/:
claim for dama~es to a pair of shoes, and the matter was ddlscussed. The Judiciary ~1
Committee recommended the matter be continued, and such recommendation was
unanimously adopted.
A Rooming-house premi twas grant,ed to M.rs. H. M. Laing to operate the
Tourist Hotel at 70 East Broadway.
Aerial permits were granted to J. F. Oldham for an aerial at 1660 Moss Street,
and to Sergeant A. L. Dumont for an aerial at 458 East 11th Avenue.
The City Eagineerreported on the; Murray petition relati.ve to the assessmeat
for fill and sidewalk improvemen ts at t,he c orner of 5th Avenue and Hi~ Street,
and after discussion, said matter was laid over until the next meeting of the
Council.
The Street Committee reported on tJ::e matter of the trees and sidewalk on the
East side of Olive Street between 19th an'd 20th Avenue and recommended that the
sidewalk be buil t on the property line. After discussion, such ma tter was duly
carried, all voting ase, except Washburne, who voted nay.
The Street Committee, thro~h the Engineer, reported on the .(1latter of' the
petition of Mr. Ruch and others, aS1}:ing that Agate Street pavemen t between 13th
and 14th Avenues pe repaired, the Engineer stating nothing could be done relative
to such matter until spring. No fu.rthe r ac tion was hadd,
The Fire & Water Committee, Health, Printing, and Police Committees had no
reports to make.
The viewers, in the proposed widening of Railroad Boulev~rd from Van Buren
I Street to Ri vel' Road, made their report which was duly filed and an Ordinance
adopt ing the same,was read the{ first time and lai d over.
The Judiciary Committee presented an Ordinance creating stop streets oa 19th
Avenue a~d 13th Avenue in the City, which was read the first time and referred
back to trh1 Judi ciary C ommi ttee.

A letter was received from L. L. Ray as Attorney for Mrs. Bertha Near, asking
for damages for an alle~ed personal injury received on ~th Avenue East. Said
matter was ~eferred to the Judiciary Committee and the City Attorney.
The Ore&:on Seed & Feed .company a:'ppeared stating it desires to change its
1 0 ca ti.on to the Love property on 5th Avenue West, just west of Willamette Street,
and asked th e Council for a permi t to install machinery and remodel the building.
After diJ3cussion, the matter was referred to the Inspector of buildings, the
City Attorney, and the Fire & Water Committee to bring in a report thereon,at the
next me eting of the C ounc il. '
The following Resolution was offered and unanimously adopted:
RESOLUTION-
Whereas, litigation has been commenced against the City of' Eugene and the
members of the Common Council and certain other officers because of the:- mSlnner
of the construction of the outlet of the Polk Street sewer, and
Whereas, such litigation is deemed to be of sufficient importanc.e to warrant
the employment of additional counsel to assist the City Attorney in defending the
I ' various defendants,
Therefore,

BE I.T RESOLVED BY THE COMJl.WN COUNCIL OF THE CITY OF EUGENE
that Charles A. Hardy be employed to assist the City Attorney in defending the
defendant s, other than LJ P. Harmon in such litigation, at whatever compensation
shall be reasonable in view of the services which he shall render.

An Ordinance amending Ordinance No. 6780, entitled "An Ordinance providing ~'lf::"
for the making of an exclusi ve f ranchi se for the hauling of garbage, ru bbish and
refuse, in the City of Eugene with Bray Bros., and providing that no other pers04,
firm 'or corporation Shall be permitted a license to haul garbage, rubbish and
refuse for hire upon the Street s of the City of' Eugene,-" passedb y the Common
Council and approved by the Mayor April 9, 1928, and amending Section 4 of said
Ordinance by adding the words "Any person, firm or corporation hauling garbage
refuse or rub b ish not produoed by himself, shall be deeme d to be hauling:.fbr hire.
No Garbage. from tlB Ci ty of Eugene shall be placed elsewhere than at the ~arbage
depository provided-by the Contractor herein". and providing for an emergency,
was read the first time and passed its second and third readi~gs by title by
unanimous consent under suspension of the rule- and was placed on its final passage.
