II Reports of Hobi Airways Company for the month of September and the Public II Library for the month of October were placed on file. II A letter of protest was read from the Circuit Judge and Count.y Court II against the p.r'oviding of hi tching racks on the street abutting the court house Ii I on the north. I I The fol.lowing resolution, reducing the assessment against Lot One in Block I i Six of Cheshi.r'e's Addition, Eugene, Oregon, from $459.70 to $247.55, was on II II motion duly ad,opted; " Ii RES 0 L UTI 0 N ,I Ii 'I II Whereas, by Ordinance No. 4195, passed by the Common Council and approved ,! Ii by the Mayor on June 23, 1924 , the City of Eugene did levy an assessment for the I' Ii !I construction of a cement sidewalk on the South side of First Avenue betwee~ il II Madison Street and the curb line on Jefferson Street, and also on the West side II I, ,I I, " of Jefferson Street between the curb line of First Avenue and Second Avenue in " :[ I, II Eugene, Oregon, against Lot One (1), in Block Six (6) of Cheshire's Addi tion to II II I I, the City of Eugene, Oregon, in the sum of $459.70, and " " " Ii Ii Whereas, it now appears that said assessment was excessive and erroneous, :1 and that in fact the cost of said improvement was the sum of $247.55, and :, I I, " II Whereas, by reason of said erroneous assessment said. described property :1 II was ove I' assessed to the extent and in the sum of $212 .15. j; 'I Now Therefore, be it resolved that the Common Council of the City of Eugene, Oregon, does hereby reduce said original assessment to the extent and in the sum of $212.15. Said reduction to be considered as made as of the date when ii said original assessment was made, to-wit, June 23, 1924, leaving the amount assessed against said property at said time $247.55. The Recorder and Treasurer are hereby authorized and directed to ma:ke such correction on the Lien Docket and records of the City of Eugene, Oregon. A pe tition for the vacation of a :portion of Maple AITenue was read and filed. Attorney Fred E. Sini th calledattentlon to the'leaITes on the sidewalks making walking <4Lngerous for the ,old peo,ple. The City Attorney stated that he, would prepare an ordinance covering this subject. Councilinan Rei d appears in Counc il. 'I Forty-nine sidewalk Assessment Ordinances, having been read the first I time on November 12th, and registered notices for protest having been sent, and I! II now no protests being received, said ordinances were read the second time, and passed their third readings by ti tle by unanimous consen t under suspension of the rule, and were placed on their final passage. The ayes and nays were called, II all Councilmen voting aye, nay, none. The Ordinances were declared passed, and numbered from 7653 to 7701, both numbers inclusive. An Ordinance levying assessments for paving the alley between lOth Avenue and 11th Avenue from Van Buren Street to Tyler Street, in the City of Eugene, Oregon, was read the second time and due notices of hearing having been given, ob jec tions were called :for. A written objection o:f S. A. Dan:ford was read, and oral objections were made by Stillman A. Connor and Owen F. Herring. After due ~ "~ 2G3' consideration, a motion was made, se c ond ed, and carried that the .Council finds that said objections are unwarranted and are hereby denied. The ordinance was I read the third time and placed upon its final passage. The aye s and nay s wer e called, all Councilmen voting aye, nay, none. An Ordinance adopting a form for the issuance of Interim Power and Light Bonds in the sum of $200,000.00, which are a unit of the $1,250,000.00 Water and Light Bonds authorized by the electors of the Ci ty of Eugene, Ivlay 27, 1929, was read the first time, and passed its second and third readings by title by unan- imous consent under suspension of the rule, and was placed on its final passage. The ayes and nays were called, all Councilmen voting aye, nay, non e . The Ordin- ance was declared passed, and numbered 7704. An Ordinance reassessing the paving abutting on the South 100 fee t of Lot 4, Block 19, Fai I' moun t, in Eugene,' Lane County, Oregon, for the paving of Villard Street from Franklin Boulevard to 19th Avenue in the City of Eugene, and fixing a time and place for the hearing of objections and directing the giving of notices, was read the first t,ime, and passed its second and t,hird. readings by title by unanimous consent under suspension of the rule, and was placed on its final passage. The ayes and nays were calle d, all Councilmen voting aye, nay, none. The Ordinance was declared passed, and numbered 7705. Five Sidewalk Improvement Ordinances were read the first time and laid over. A resolution providing for the notice of proposed vacation and fixing Monday Decem'ber 13th as a time for the hearing was on motion duly adopted, and following is a copy of said resolution: I IN THE MATTER OF THE PETITION TO VACATE A PORTION OF 1~PLE AVENUE IN THE CITY OF EUGENE, eREGON ,I RESOLUTION Whereas, a petition has been filed by M. H. Barr and Hettie Barr, his wife, and W. J. Miller and Myrtle Nliller, his wife, praying for a vacation of t,hat portion of Maple Avenue in the City of Eugene lying North of the North line of 15th Avenue East and South of the South line of 'vVoodland Avenue in said Ci ty, said portion" lying 'between Lot 22 of Block 35, Fairmount Addition to Eugene, Oregon, and Lot 1, Block 1, Victoria Heights, an Addition to Eugene, Lane County, Oregon, and it appears from said petition that the petitioners are the owners of all the property adjacent to that portion of said street proposed to be vacated, and that said petitioners are the onl"y persons interested in said vacation and that said vacation will be to the best interest of the said City of Eugene and to the public and that said portion of said street is a deep gully and is dangerous and difficult to maintain.
