Minutes of the regular meeting of the Common Council, held at the hour of In 7:30 o'clock P. M., on December 9, 1929. There were present the Mayor and all ~ members of the Council, except Lamb. Mee ting called to order by the Mayor. "- Edward J. Yenne req,uested that the Council approve the transfer of the plumb- ing license issued to Yenne and Kil-born, I'llr. Yenne having purchased the interest of Mr. Kilborn. A motion was made and seconded that the transfer be permi tted upon Mr. Yenne presenting to the Council the written approval of Mr. Kilborn. Mr. Calkins, City Attorney, reported that Frank Tripp had purchased two lots within the boundry of the aviation f'ield at the County Tax Sale- and was asking the Ci ty to pay him $200, and that the price would be raised unle ss the lots were purchased immediately. Mr. Calkins recommended that the council take steps to condemn these lots. A motion was made, sec onded, and carried adopting his recom- me nda tion. The rec order was instruct ed. to find out what it would co st for a search letter as to the City title to the Air Port property. A communication from S. M. Calkins called attention to the possible req,uire- ment of signals attracting attention to the closed ends of lOth and Mill Streets to avoid possible accidents. The matter was referred to the Police Committee. A motion was made, seconded, and carried that the, Recorder deliver to Ne Page ~. McKenny Company all of the warran ts for the installation of the ornamental street lights, except that there be held~ack $560 which is the amount estimated by the City Engineer to complete the ins talla tion, and that warran.t No. 33438 heretofore drawn in the sum of $1,683.20 be cancelled, and in lieu thereof two warrants be issued. f'or $1,123.20 and $560.00 respectfully to enable the City to hold back the amount specifi ed. A petition of the Oregon Seed & Feed Go. to install a Toledo truck scale at the Southeast corner of their building locat.ed at 285 East Fifth Street was on moti on g-ran ted. I Notification of A. G. Enright of Goldson, Oregon, that he had paid his assess- men t for the sidewalk on Lot 3, JDlock 3, Hendri c]e' s Amended Addi tion under pro tes t and s ta t ing that the ~ is breaking up, and that he expected the City to provide a good and sufficient walk, was referred to the City Engineer. Reports of Chester M. Lawrence, Milk & Food Inspector, R. W. Rundlett, Build- ing Inspector, and the Hobi Airways Company were read and filed. The Bill and Communication of W. Zarewski for sewer repairs in the sum of $8.25 was referred to the sewer committee. A communication from R. W. Smyth, Cashier of the State Bank of Park Rapids, Minn. sugge sting the sale or lea se of a tract belongi ng to the ir Client, Henry E. Stevens, adjoining the present municipal air port was read, and the recorder was instructed to obtain their idea as to prices. Chairman Large of the Finance cOfi@ittee recommended that warran ts be drawn in payment of the Engineer est,ima te s as follows:- The estimate of Oscar Snow for the Paving of Madison Street from Eighth Avenue to West Broadway. $2,275.88 The estimate of Hargreaves and Lindsay for the paving of the alley between lOth & 11th Avenues from Van Buren to Tyler Street. $1,046.58 The ayes and nays were called, all Councilmen voting aye, nay, none, absent Lamb.. One sidewalk Improvement Ordinance was read the first time, and passed its second and third read ings by title by unanimous consent under suspensi on of the rule, and was placed on its final passage. I An Ordinance levying assessments for reassessing paving a portion of Villard S t re e t from Franklin Boulevard to 19th Avenue in the City of Eugene, Lane County, Oregon, was read and due notices have been given by publication and posting of the consideration of said ordinance for the hearing of objections. Written objections of M. B. Gilmore & J. :M. Devers and of Roy H. Hewitt & Susie A. Hewitt appearing by Fred E. Smith, their attorney, were read, and Attorney Smith discussed the proposed reassessment before the Council, and on motion it was ordered that the considera- ti on thereof 'be cont inued unt il the next mee ting of the Council. The ayes and nays were called, all Councilmen voting aye, nay, non, -:.c absent Lamb. ~rhe Ordinance was declared passed and numbered 77.07., .~ 00 An Ordinance declaring a public necessity and directing the City Attorney to insti tute an action for condemnation of eertain lots for public use, and appoint- ing viewers to make a report as to the value thereof and the rights and interest of the persons having interest therein, was read the first time, and passed its second and thil:,d readings by title by unanimous consent under suspension of the rule, and was j)laced on its final passage. The ayes and nays were called, all Councilmen voting aye, nay, none, absent Lamb. '1.1he Ordinance was declared passed and numbered 7708. An Ordinance regula ting the use, conduct and. control of vehicles upon the streets and Alleys of the City of Eugene, and prescribing penalties for the viola- ti on thereo:f, and repealing Ordinance s Numbered 3890, 5:695, 5993, 6118, 6264, 6590 and 7536, and all ordinances or parts of ordinances in conflict herewith, and declaring an emergency was read, and on motion Section 5 thereof was amended by .the addition of the words fifoI' more than two hour'slT after the word continuously, and by substituting one o'clock A. M. for Ten o'clock A. .M. and the word rlsaid" for the word flfollowingfl in the four th line. On motion seconded and carried the Ordinance was a.mended by changing the word flsixrl in section 8, sub-division (a) to read "seventhl', and by striking out su:b-division (a) of Section 9. Ci ty Attor'ney Calkins stat ed tha t 1'1r's. Ida Hosford had sustained a broken ankle on account of sidewalk conditions on West 11th Street, and Councilman Large I was on motion directed to take steps for the settlement of any claim of damages. City Attol~ey Calkins stated that M. M. Monroe was not going forward with the construction of. sidewalks under contract jobs awarded to him. A motion was made, seconded, and carried that the Ci ty Engineer be instructed to compel immedia e compliance with his contract or adjust differences and cancel his contract' if necessary.
