Minutes of the adjourned meeting of the Common Council, held at the hour
of 7:30 o'clock P. M. on January 27,1930, there being present all Councilmen
except Reid, Monroe, and Zumwalt. The meeting was called to order by Mayor

A report from ~he City Engineer and the City Attorney recommending that the
assessments against certain property on Villard Street for the improvement of
Fairmount Bou"1evard for paving stand as now of r'e'cord, and that the request of
Fred E. Smith, presented to the Council on January 9th be denied, was read and
motion made, seconded, and carried to adopt the recomm'endation.
Councilman Monroe appeared in Council at this time.
The petition for the appointment of Julian Strait to the City Police force
was discussed in Council without action.

An ordinance assessing cost of sidewalk intersection to the City of Eugehe,
having been read the first time on January 13th, was read the second time, and
passed its third reading by title by unanimous consent under suspension of the
rule and was placed on its final passage. The ayes and nays were called, all
present voting aye, nay, none, absent Reid and Zumwalt. The Ordinance was declar-
ed passed and numbered 7740.
A report of Mayor Wilder on City finances was presented and placed on file.
The recorder presented a resolution providing the transfer of $625.55,
remaining in the fund from sale of Fire Department Equipment Bonds, to the General
Fund, to be used ip. reducing the outstanding warrant debt, and $148.20 from the
Aviation Park Bond Fund to the General Fund for the reduction of Outstanding
Warrant Debt, and for the transfer of $1,275.00, balance from the sale of Park and
Ter~inal Bonds, to the Park Terminal Bond Sinking Fund, and for the transfer of th
balance in the Public Comfort Sta tion Fund to the Comfort Sta tion Bond Sinking
Fund, was read and a motion was made, seconded, and carried to adopt the resolutio ,
and directing the Treasurer to make such transfer. Following is the Resolution:

RESOLUTION
It appearing that there is held by the City Treasurer the sum of $625.55
Fire Department Equipment money and that the same was authorized for purchase
of equipment and never used ~nd has been lying in this fUnd for nine years, and
that the General Funds have paid in the meantime for many items in excess of this
amount, it is ordered that said sum be transferred by the Treasurer to the General
Fund and be used by him to reduce outstanding General Warrant Debt.
It further appearing that there is held in the Aviation Park Bond fund the
sum of $148.20, which has remained in said fund since 1920, and that said fund
was voted for the purpose of acquiring land for an aviation field and that the
general fund has paid out more than that sum for lands for said purpose, it is
ordered that said sum be t.ransferred to the General fund and that the Treasurer
use the same to reduce outstanding general warrants debt.

'It further appearing that there is held in the Park and Terminal Bond fund
the sum of $1,275.00, and that the same has remained in said fund since Sept.
1925, and that the purpose for which said fund was provided has been accomplished
and that no further demand will be made for said fund, it is ordered the said
sum of $1275.00 be transferred in the Park Terminal Bond, Sinking Fund to be used
toward the redemption of said bonds when due.
It further appearing that there remains in the Public Comfort Station fund
the sum of $144.93, that said station was completed in 1926 and that said sum is

in excess of the building requirement, it is ordered said sum be transferred into
the Comfort Sta.tion Bond Sinking Fund.

A resolution was presented by Councilman Hendershott, directing the City
Attorney to appeal the case of the City of Eugene, versus, B. F. Keeney and others,
to the -.Supreme Court, and authorizing the Mayor and Recorder to sign the Notice
of Appeal, and for the Recorder to furnish the necessary undertaking on Appeal.
A motion was ma.de, seconded, and carried to adopt the following resolution:

RESOLUTION
BE IT RESOLVED by the Common Council of the City of Eugene, Oregon, that
the Ci ty Attorney be and he is hereby directed to prepare an appeal to the
Supreme Court of the State of Oregon in the case of City of Eugene versus B. F.
Keeney and other s, and the Ci ty Rec order and the Mayor be and they hereby are
directed to sign the Notice of Appeal, and the .Recorder be and he is hereby
directed to fU.t"nish an undertaking on appeal with sufficient sureties, in order
to enable the City Attorney to go foreward and prosecute such appeal to a con-
clusion.
The Recor'der presented the correspondence wi th bond agents regarding consent
of the surety to the payment of Hargreaves and Lindsay for the Columbia Street
Paving. Under the advise of the City Attorney that the consent as set out in
their Ie t tel' 'was not absolu te in its terms and insufficient to bind the surety,
the Counci 1 deci ded that it would be necessary for the contractor to secure an
unconditional release of the City, before the payment can be made.
On motion, the Council adjourned.
