Minutes of the regular meeting .of the Common Council, held at the hour of
7:30 o'clock P. M., on February 10, 1930. There were present the Mayor and all
members of the Council, except Washburne and Lamb. Meeting was called to. order
by Mayor Wilder. '
Attorney Fred E. Smi th offered in behalf of the property owners to settle
the assessment against the Knight property at 20th & Alder Streets on the basis
of $500, and the matter was referred to the Judiciary Committee and the City
Attorney with power to act.

Mr. McChesney appeared before the Council wi th a communication from the
Hod Carriers, Building and General Laborers of Local Labor Union No. 685, asking
the adopting of the scale of wages to become effective April lst,1930, a,nd
presented a communication embodying the request, signed by the President and Re-
cording Secretary of the Labor Union. After some discussion the matter was laid
over for later consideration.
Chairman Large of the Finance Committee recommended that the Ci ty purchase
a cash register for the City Treasurer's office for the sum of $665.00, to be
paid $150.00 in cash on delivery and $360.00 July 1st, 1931, and $155.00 ,July
1st, 1932. Motion was made, seconded, and carried to adopt the recommendation of
the :finance c ommi ttee.
The request of the Health Officer, Dr. Kerron, that a place be assigned to
him for the use of his car near his office was referred to the Police Committee
and Mayor.

A Communication fromH. E. Slattery to the Mayor, asking that the pending
garbage case in the supreme court be submitted at once, was read, and Attorney
Wells, representing Bray Brothers, talked on the subject, and on motion it was
ord,ered that the matter be left in the hands of the City Attorney to proceed
according to his own jud@nent.

Attorney S. M. Calkins stated that he had received a proposal from the City
of Cottage Grove through its Attorney H. E. Lombard that t,he two Cities join in
a suit to test in the Supreme Court the validity of the law restricting the vote
on the bond measures to tax payers. It was the consensus of opinion that t,he
City was not justified in going into this question at this time, as the matter
will probably be decided in the Supreme Court through other channels.
A letter from the Aetna Casualty & Surety Co., authorizing the City of
Eugene to pay Hargrea ve s and Lindsay for the paving of Columbia Street from 23rd
to Reed Avenue $1220.00, was read, and a motion was made and seconded, after
recommendation of the City Engineer as to the amount, that they be allowed at
this time the sum of $11,940. The ayes and nays were called, all councilmen
voting aye, nay, none, absent Washburne and Lamb.

The recommendation of the Eugene Milk Producers Association, that the City
Council prohibit the sale for human conswnption of buttermilk containing a neutra-
lizer and that all cuI tured or manufactured buttermilk be made from Grade "A"
skimmed or whole milk, was referred to the health committee.
An Ordinance prohibiting the homogenization of milk or cream in such a
manner as to artificially extend the natural cream line, and give an apparently
greater butter-fat content than is actually contained in said product was read
the ,first time, and passed its second and third readings by title by unanimous
consent under suspension of the rule, and was placed on its final passage. The
ayes and nays were called, Councilmen vot ing aye, six, nay, none, absent Wash-
burne and Lamh. The Ordinance was declared passed and numbered 7741.
The request of Andrew Holton for the return of the papers in his claim
against the City amounting to $26.17, cost of cleaning out a clogged sewer, was
presented, and Council directed that the papers be retained by the City Recorder.
The bill of J. O. Burgess, in the ~nount of $70.10 for lahor and material
on Franklin Street Bridge Sewer affair, was presented, and it appearing that this
bill had been before the council on previous occasions in the past and heretofore
denied, no action was taken at this time.
The City Engineer was instructed to secure an ordinance for the protection
of sewers against the dumping of oil and grease and sand and earth in the sewers
and providing for inspection of service stations, garages, laundries, grease
racks, washing racks, or any factory depositing s,olid substances into the City
Sewers.
Reports of Dr. Kerron, Health Officer,R. W. Rundlett, Building Inspector,
and the Hobi Airways Company were presented and placed on file. "

Whereas it appears tha t the Records 01' Council proceedin.gs ,under dates 01'
August 12th and 25th, September 9th and 23rd, October 14th and 28th, November
12th and 25th, December 9th, 23rd, and 30th, January 13th and 27th, were duly
read and approved at the ensueing regular meetings 01' the Common Council,
And Whereas, it appears that a record of the approval of said minutes was no
entered at the time of said approval, it is now therefore resolved that the
Recorder anke due entry at this time in the minutes reciting that the minutes of
the Council mee tings of said da tes were and are hereby duly approved.

The following Resolutions opening streets were read, and a motion was made,
seconded, and carried to adopt the same:

In the Matter 01' the Opening of Almaden Street from Sixth ,Avenue to Eighth
Avenue.
WHEREAS, the Common Council 01' the City of Eugene by resolution duly adopted
February 27th, 1928, determined to open, layout, and establish Almaden Street
from Sixth Avenue to Eighth Avenue in the City of Eugene, Oregon,
And Whereas, the report and plat of the City Engineer for the opening of
said street was duly made and filed and duly adopted by the City Council by
Ordinance No. 6&62, passed and approved February 27th, 1928,
And Whereas, the Viewers duly appointed by said Ordinance No. 6662 made and
filed a report of their findings of benefits and damages to the property benefitted

and the property damaged by the opening 01' said street,

And Whereas, due notice of the consideration of said report was given and
thereafter said report was duly adopted by Ordinance No. 6778, passed and approve
on April 9th, 1928,
And Whereas, the damages ~d benefits as shown by sai,d. viewer's report were
equal and exactly offset each other, except that the said viewers recommended that'
a credit be given to Florence Stevens of $71.15 as the price 01' the sidewalk

NOW THEREFORE, be it resolved by the Common Council of the City of Eugene
that all things necessary to be done in the acquiring of said property for street
purposes has been done, and that said Fifteenth Street from Lawrence Street West t the
East line of Hollenbeck's Addition is hereby opened, laid out, and established,
and the City Engineer directed to prepare and deliver to the City Recorder and
accurate plat of said street and the property appropriated for public use, and the
recorder is dil~ected to file for record with the County Clerk of Lane County,
Oregon, said plat and a copy of this resolution to be recorded in the Deed Records
of Lane County, Oregon.
