Minutes of the regular monthly session of the Co~non Council, held at 7;30 0' clock P. 1\1., :March 10, 1930. Counci 1 was called to order by Mayor H. E . Wilder with all Councilmen present, except Reid. ; ,t.< .~ ; ty:. Minutes of the regular meeting of February 10, 1930, and of the adjourned meeting of February 24, 1930, were read and approved.. Attorney Dan Johnston appeared for the Prudential Insurance Company asking that they be allowed to protect their interest in the South 56 feet of Lot 6, Block 17, Hendrick's Amended Addition, recently purchased on March 1st at the tax foreclosure sale, stating that they would be willing to meet all payments due and taxes paid by the City. On motion it was ordered that the request be granted and that the Mayor and Recorder execute proper deeds upon payment of the amoun t s due. - . A request of the John Knox tabernacle to put up a banner across the street was referred to the Building Inspector. Mr. M. 1'.1. 1\1iller, Government Mil];;: Inspector, addressed the Council upon the subject generally and milk conditions in Eugene, and recommended certain changes in the City Ordinance to conform to the government regulations. The following resolution was read by Mr. Washburne, Chairman of the JucUciary Committee, and on motion, duly seconded and carried, was adopted: RESOLurION Whereas, heretofore there has been pr'esented to the Common Council of the I City of Eugene, a petition asking that the City Council as such, take some steps to alleviate the labor situation, by reqUiring contractors and others to pay 62;} cents per hour for common labor, which petition was presented by the Central Labor C.ouncil on behalf of the Hod Carriers and general laborers, Local No. 685, and vTrlEREAS, the Judiciary Committee and the City Attorney have made a careful investigation of the matter and have had a meeting with the petitioners, and said committee reports that the Council is without power to do more than recommend better wage conditions, and WHEREAS, it appears to the Common Council that the character of the work is such that no laborer is able to put in a full year's work, and that the wage paid, taken together with the inability to work throughout the year, has placed a very great hardship upon the trade mentioned, and WHEREAS, there is now among the ordinances of the City of Eugene one which goes as far in the establishment of a wage scale as the City can legally go, THEREFORE, the City of Eugene, through its Common Council, upon advice from its judiciary committee, desires to extend to the petitioners their sympathy and I their desire to aid in any way that the law will permi t them, and do hereby re- commend to all contractors and others that wherever it is possible to raise the wage scale that it be done, to the end that all of our citizens shall have a living wage, and the general prosperity of the City advanced. Eighteen affidavits were submitted in behalf of Chief Strait in defense of his position anti in charges preferred against him, and these affidavits were read befor e the Counei 1. The motion was seconded and the ayes and nays were called, Councilmen voting aye, Washburne, Large, and Monroe; Councilmen Simon, Lamb, Hendershott, and Zumwalt declined to vote. With the consent of the Council, the motion just submitted was withdrawn. We, the Police Committee of this council, wish to bring to you for your consideration and approval a resolution which, after an extensive investigation into the operations and morale of the officers of the police department of this city and in view of the faet the investigation has not been pragmatic and in every conclusion we have tried to be fair and conscientious to all parties concerned and especially to the City of Eugene.. We feel we are justified in our prayer for your approval of the following resolution. Therefol"e, be it Resolved, That the City Council of Eugene, Oregon, be placed on recbr<i in appro val of the recomfaenda tions of the police commi ttee in the I discontinuance of the services of the Chief of Police James Strait. '; The discontinuance shall begin on the 11th day of March, 1930. Chairman Fred E. Lamb Geo. A. Simon Councilmen Simon moved the adoption of the resolution which was seconded, and the ayes an<l nays were called, Councilmen vot,Lng aye, 'i7ashburne, Simon, Hender- shott, and Zumwal t, nay, Large and Monroe, and motion was declared carried. The following resolution for the Ol?ening of 12th Avenue between Willamette Street and Olive Street was read and on motion was seconded and carried to adopt the same. RESOLUTION FOR trHE OPENING OF TWELFTH AVEIJUE BETVnEEN WILLJlJ\:IE'TTE STREET AIm OLIVE STREET IN EUGENE, OREGON. RESOLVED: That the Common Council of the City of Eugene~ Oregon, deems it expedient ani necessary to open, layout, and establish Twelfth Avenue \'Jest between Willamette Street and Olive Street in Eugene, Lane County, Oregon, and that the City Engineer 'be and is directed to make a survey of the same, to mark the boundaries thereof, to aake a plat thereof, and make and file a written report of the portions of each lot, part of lot or tract of land to be appropriated there- I containing a full and complete clescriptioll of such street and its boundaries, and for. A report of Hobi Airways for the month of January was placed on file. A communication of the Internal Re'Tenue departmen t of Portland rela ting to paymen t of rent for local revenue offiee, expressing the opinion tha t the q,u..estion o'f rent.al shou.ld. be considered. when a proposal of the renewal of' their ~ 30~ lease is made in April or May, was placed on file. I Recorder reported the reque st of VV.. A. Minion to purchase the old building on, the North 35 feet of Lot 3, Block 5, ~heshire's First Addition, and stated that Mr. Minion was willing ,to pay ~5 .00- for the old lumber, but recommended that the City give him the lumber on condition that he clean up the premises and clear ~ oU,t the old blackberry vines in return f.or the lumber, and on motion it was so 0 or~ered. ~~~ . . Dr. Simon reported that he had been assured that the junk on the lot at 5th :.:,',,: an,d Olive Streets would be all ,cleaned Uf) before May 1st. The City Recorder reported that on the 1st ofc1~rch he had purchased at the County Tax Sale several tracts of land on which the City of Eugene is holding liens, the amount of purchase price being $828.78, and that a deed from the County and receipted tax bills had been received, and the deed placed on record with the County Clerk. The Recorder presented an offer of Edwin L. Whisler to purchase from the City certain tracts recently acquired by, the City by Sheriff deeds and tax sale proceedings and offering to pay the full amount of liens and taxes and interest penalties and, costs. Said offer being accompanied by a certified check of $1000.00., Councilman Lamb moved that a permanent committee, consisting of the Judiciary Cl..ommittee, the City Engineer, and the City Attorney, 'be appointed to consider questions relating to property, assessments, and taxation, and that the present offer be referred to said comilli ttee fOl'" investigation. The Communication from the Commission of Public Works of the City of Portland relating to width of driveways to service stations was read, and the subject of driveways as relating to the City of Eugene was referred to the Street committee, and City Engineer. I A resolution Memorializing Congress of the United states to Enact House Joint Resolution 167, Directing President of the United States to Proclaim October 11 of each year as IIGeneral Pulaski's Memorial Dayll for the observance and cOl~lemoration of the death of Brigadier General Casimir Pulaski was referred to the printing committee. A petition for the opening of Van Buren Street from Sixth Avenue to Blair S tre e t, being one of the street s already cons idered by the planning commission, was held, pending further report from the planning commission. Mayor Wilder stated that Chief Strait would be off on the 11th day of March, 1930, as Chief of Police, and that it was necessary to fill the vacancy and nominate for the consideration of the council 1~. R. W. Hall as Chief of Police, to be paid a salary of $160.00 per month. Motion was made and seconded that the appointment be confirmed 'by the council with the understanding that the appoint- ment may be rescinded should it appear that the appointee has not the required qualifications for the office. Chairman Large of the finance committee reco@uended for payment the follow- ing bills, and a motion was made and seconded that said bills pe paid.
