Minu tes of the regular monthly session of the Common Council, held at 7:30 o'clock P. M., February 9, 1931. Council was called to order by Mayor H. E. Wilder with all Councilmen Present, except Reid. Minutes of the regular meeting of January 12th, 1931, and of the adjourn- ed meeting of January 26th, 1931, were read and approved. Counc ilrnan Large, Chairman of the Finance Commi t t ee, rec ommended that the estimate of E. N. Peterson for the improvement of Thirteenth Avenue from Olive street to Charnel ton Street by constructing a sewer be paid in the sum of $168.14. On motion, the recommendation was adopted. The ayes and nays we're called, all councilmen voting aye, nay, none, absent Reid. ~ ,- "I~ The Judiciary Committee by Chairman Edwards reported that they had let the contract to G. H. Tyson for auditing the City books as the next best bidder, on accowit of the very slight differenoe between his bid and the lower bid, the Ci ty having taken into consideration his past experience in audi ting the city records and familiarity with the city methods as more than offsetting the slight difference in cost. On mos~ion, the act of the committee was confirmed by the council. The Judiciary Committee also reported that they recommended that the City Attorney be not employed in the trial of the Dutchuk case. The recommend.ation was adopted by the Covncil. The Fire and Wat er Commi t tee, by Chairman Hendershott, reported favorably a petition for the installation of two fire hydrants on Victoria Heights to be installed at the points where fire plugs have been provided, and a motion was made, seconded, and carried to adopt the recommendation. The Heal th Commi t tee, by Chai rman Zumwal t, re ported progre ss on the garbage ordinance and also called attention to a nuisanc.e at 23rd and Alder" Streets. The Police Committee, by Chairman Simon, made a report of activities of the Police Department during th~ month of January. . Mayor Wilder reported too t there was a vacancy on the BCfa!',d", of Appeals, by reason of Lee Cook having left the City, and appointed to succeed him Edgar Martin. The appointment was on motion confirmed by the Councll. The Mayor also reported, after conference wi th the Park Board, a recom- mendation that the double cabin in Riverside Park be fixed up as permanent living Quarters for Park Superintendent Farmer at an estimated cost of $200. Motion ,was made, seconded, and carried that this be done. At this time Mayor Wilder was excused from attendance and President of the Council, E. Large, presided over the ensuing mat tel's of the Counc il. ' Mr. R. A. McCully presented a reQuest for extension of time for the payment of assessments against the North 60 feet of Lot 4, Block 14, James HUddles ton Extended Addit,ion, owned by O. F. Knox, shown in Lien Docket 5, page 243, in Book L, page 171, and a motion was made, sedonded, and carried that the exten- sion of time be granted qn condition of a present payment to be made of all interest to date and one-fourth of the principal balance wi th the remaining three- fourths to be paid in three eQual annual payments in February of 1932, 1933, and 1934. Reports of the Building Inspector and the Eugene Public Library for the month of January were read and placed on file. A petition for the opening of Mill Street, from the South line of Lot 5, Block 10, Original PIa t of Eugene to the South line of Fifth Avenue if produced East and Fifth Avenue East from the East line of Lot 8, Block 10, Original Plat of Eugene to the west, line of ThUll Street, if produc:ed South was read, and motion was made, seconded, and carried that the Council proceed with this matter accord- ing to char ter. A peti ti on for a Street Lig? tat, 22nd and Jefferson Stree ts was referred 'to the Fire ana Water GOfIllui ttee. M. D. Koupal presented a reQuest for an aerial at 2242 Fairmount Blvd., and on motion the same was granted. The application of J. F. Strai t for hotel permit at 88 West 8th Avenue, approved by Chief of Police, R. W. Hall, was on motion granted. ,-~ r 42 '. The following resolution to open, layout, and establish the alley between Monroe street and Adams Street and First Avenue to Second Avenue in Eugene, Lane County,'OJ:,egon, was read, and motion made, seconded, and carried to adopt the same ~ '~~ ..-1 ~ u RESOLUTION 1 RESOL1TED: That the Common Council of the City of Eugene, Oregon, deems I , . it expedient and necessary to open, layout, and establi sh the alley between Monroe Street and Adams Street ~nd First, A venue to Second Avenue in Eugene, Lane County, Oregon, and that t,he City Engineer be and is hereby directed to make a survey of the same, to mark the boundaries thereof, to make a plat thereof and make and file a written report containing a full and complete description of such alley and the boundaries thereof and of the portions of each lot, part of lot or . tract of land lj 0 be appropriat ed therefor. Hall and directing the Mayor and City ReCOr(ler t,o execute conveyances and accept a mortgage in pursuance of the offer was read the first time, and passed its second and third readings by title by unanimous consent under suspension of the rule, and was placed on its final passage. The ayes and nays were called, all present voting aye, nay, none, absent Reid. The Ordinance was declared passed and numberedo8013. u An Or(Unance levying assessments for the construction of a concrete side- walk on the East side of Willamette street from 16th Avenue to Hospital Drive was read the first t,ime, and due notice of hearing of objections having been given ob- jections were ealled for. Mike Dewey and Calvin Pryor personally appeared before the Council an(1 ent ered their objecti ons to said assessment, and writ ten obj ection of L. E. Henniger and G. L. Teshner were read, toget,her with a written request of F. X. and G. F. Schaefers for an additional ten days in which to present a formal protest against the proposed assessments. Whereupon a motion was made, seconded, and carried that the proposed ordinance and proposed assessments be continued on consideration of the same and objections thereto until the next regular meeting of the Council on February 24th. ,Eight Sidewalk Assessment Ordinances were read the first time and laid I o ve r. The following resolution was presented: If RESOLUTION Whereas, on the 27th day of October, 1930, the City Attorney was author- ized by the Council to proceed with the various interested parties in the matter of a settleaent> of the purchase price of 4.71 acres at the Aviation Field, and pursuan t e thereto an agreement was reached 1"01' the transfer of said land to the Ci t' at a consideration of $1500.00, and in carrying out the necessary completion of negotiations the City Recorder and Mayor issued City Warrant No. 35889 to W. B. Dillard, Count;y- Glerk, and the City Treasurer has cashed said warrant and now holds the same as an investment of the Sinking < Funds of the City with the under - standing that the same shall be held by him and paid out of the Aviation Fw:;i.d Levi. s, subsequent to the payment of all warrants to Stien Bros. in accordance with their c ontrac t. .~' . , Now, Therefore, be it resolved that all acts and things done and recited herein be and are hereby ratified and confirmed as had done and pe'rformed under full authority and approval of the Common Gouncil and of the same force and effect as if now done a t this time. n The motion was made, seconded, and carried to adopt the resolution. An offer of Raffie y Rug h to se 11 to the C it y a trac t of about 18 acre s on the East side of South Willamette Street, referred to as the Tschanz and Dunn tracts, for a consideration of ~2500 with a cash payment of $500 and balance on long interest period: subject to Gity Liens and Taxes, was referred to the Finance and Judiciary Committees. Councilman Lamb moved that t.he City grant to Claude Jackson, Mechanic, leave of absence to take a three days course in the Portland Ford School for mechanics with an est;imated allowance of $30.00 for expenses, and that the Recorde be authorized to advance his expenses out of the revolving fund. Motion was seconded. The ayes and nays were called, all councilmen voting aye, nay, none, absent Reid. 1 , ;... ,'I; ~, .. ~ 43 --- ---.- Councilman Simon of the Police Oommittee reported that a Pound Master had: been employed, 'and that it will be necessary to provide a proper pound for the keeping of dogs, and Councilman Hendershott moved that the City allow him to use one of the small buildings in Riverside Park. Motion was seconded and carried. Chairman Large of the finance'committee recommended that the following bills be paid.
