Minutes of the adjourned meeting of the Common COlUlcil, held at the hour of 7:30 o'clock P. M., February 24, 1931. Council was called to order by Mayor H. E. Wilder wi th all Councilmen present. The Judiciary Committee, by Chairman Edwards, recommended, after conferring with t,he University and City School Heads and considering the Cities interest" that it did not seem advisable for the City to accept the offer for the purchase of the 18 acre tract on South Willamette Street, and that the matter be dropped. On motion the recommendation was adopted. Chairman Large of the Finance Co[,runi ttee recommended that the following bills be paid.. An estimate of the Eugene Sand and Gravel Co. for the 'improvement of Taylor Street from Eighth Avenue to 231 feet North of Eighth Avenue by grading and graveling in the sum of $680.20. An estimate of A. C. Mathews for the improvement of Indiana Ave. from Agate Street to Columbia Street by grading and graveling in the sum of $716.85. On motion, the recommendation was adopted. Chairman Hendershott of the Fire and Water'Committee recommended that the petition for a. light at the intersection of 22nd 'and JeffeI'son Streets and also a~petition introduced at this time for a light in the center of Block Four, Skinner's Donation be granted. On motion the recommendation was adopted. Chairman Zumwalt of the Health Committee reported consideration cif nuisance complaints at locations on"South Alder Street, 21st and Tyler Streets, relating to an old dila.pidated builCiing and a trash nuisance on Alder' Street near the Bible University in City Outlook. r' City Attorney Calkins related the conditions of the proposed reassessment of the South Willamette Street sidewalk, and Attorney E. R. Bryson presented the protest of F. X. and G. X. Schaefers, Calvin Pryor, and Mike Dewey. A motion was made, seconded, and carried that the Council 'express 01 tself as favorable to a settlement with these objectors on a fift.)" per"cent basis, it be,ing understood that the settlement at this basis is to clear the presene interest of the City in a' certificate against this property held under previous'lien foreclosure. A motion was made, seconded, and carried that the Council finds and determines that the objections to the proposed assessment are not well taken, and that the same he overruled and denied and t,hat the reassessment ordinance prepared by the City Attorney be read. Vmereupon an Ordinance reassessing the costs of constructing a 'concrete sidewalk on the "East side of Willamette Street from 16th Avenue to H~spital Drive was read the first time and laid over. A written reQuest of James Mohammed for continuation of a street peddlers tamale license was denied on motion of Councilman Hendershott, duly seconded and carried. ' . II II II II Ii II II ii II il j ! I 1 The Recorder reported a collection of $234;12, refund of taxes paid on Motor Vehicle Fuel.' The Recorder called attention of the Councll to the Circuit Court Tax Fore- closure proceedings against various City property, upon which the City holds liens for public improvements, and asked advice as to the procedure to be taJcen in protection of City's holding at the Sheriff's sale of these properties in March. On motion the mat ter was referred to the Finance Commi ttee. C , An Ordinance regulating the playing of cards, dice or any other game which shall be played in any pool room or card room or similar resort in the City of Eugene, and also regulating places maintained for playing ffilCh games was read the fir st time and laid over. -, Four Sidewalk Improvement Ordinances were read the first time, and passed their second and third readings by title by unanimous consent/under suspension of the rule, and were placed on their final passage. The ayes and nays wel"e called, all councilmen voting aye, nay, none. 'I An Or'd.inance levying assessments for the grading and graveling of Indiana Avenue from the West line of Agate Street to the West line of Columbia Stree~ in the City of Eugene, Lane County, Oregon, was read the first time and laid over. An Ordinance levying assessments for the grading and graveling of Taylor Street from the North line of Eighth Avenue West to a point 231 feet North of the North line of Eighth Avenue West in the City of Eugene, Lane County, Oregon, was read the first time and 1 aid over. An Ordinance levying assessments for the construction of a sewer on the North side of 13th Avenue from the West line of Oli ve Stree t to a point 167 feet East of the East. line of Charnelton Street, in the Ci ty of Eugene, Lane County, Oregon, was read the first tifne=and laid over. . The f'ollowing resolution opening Fifth Avenue East from the East line of Lot 8, Block 10, Original Plat of Eugene to the center line of Mill Street if produced South in Eugene, Oregon, was read and on motion adopted: "RESOLUTION FOR THE OPENING OF FIFTH AVENUE EAST FROM THE EAST LIN~F LOT 8, . BLOCK 10, ORIGINAL PLAT OF EUGENE TO THE CENTER LINE OF MILL STp,-m IF PRODUCED SOUI'H IN EUGE1TE', OREGON. ( RESOLVED: That the Common Council of the City of Eugene, Oregon, deems it expedient and necessary to open, layout, and establish Fifth Avenue East from 1 the East line of Lot 8, Block 10, Original Plat of Eugene to the Center line of Mill Street if produced South in Eugene, Oregon, and that the City Engineer be and is hereby directed to make a survey of the same, to mark the boundaries there- of, to make a plat thereof, and make and file a written report containing a full and complete description of such street wld its boundaries, and of the portions of each lot, part of lot or tract of land to be appropriated therefor. At this time the Engineer's report and plat for the pro:posed opening of Fifth Avenue East from the East line of Lot 8, Block 10, Original Plat of Eugene to the center line of Mill Street if produced South in Eugene was submitted. and filed. The ayes and nays were called, all Councilmen voting aye, nay, none. The Ordinance was declared passed and numbered 8025. The following resolution proposing the opening of Mill Street from the South line of Lot 5, Block 10, Original :Plat of Eugene to the North line of Fifth Avenue if produced East in Eugene, Oregon, was read and on motion adopted~ "RESOLillION FOR THE OPENING OF MILL SrREET FROM THE SOUrH Ln~E OF LOT 5, BLOCK 10, ORIGINAL PLAT OF EUGEl~E TO THE NORTH LINE OF FIFTH AVENUE IF PROCUED EAST' IN EUGENE, OREGON. The ayes and nays were called, all Councilmen voting aye, nay, none. The Ordinance was declared passed and numbered 8026. Mr. Burt Misto suggested that the present stop signs were not in a position for good visibility. He also made the sugsestion that the City should make Thirteenth Avenue East a through Street. The Council expressed appreciation of his suggest,ions and assured him that this'was a subject which had already receive much consideration. I' '-- Chairman Zumwalt of t,he Health COlIltnittee outlined the plans for handling of City garbage at the expiration of the Bray Bros. contract, and the following matters prepared by City Attorney'Calkins, under the direction of the Health Commi t tee, we,t:'e considered. .. Elliot t for the purcha se of ten acres, more or less, and including roadway, the sarne being a metes and bound description in the Southwest Quarter of the Southwest Quarter of Section 8 in Township 18 South ~f Range'3 West of the Willamette Meridian, at a price of One Thousand Dollars was read, and ma ti on Inade, seconded, and carried to accept the option, and an executed warranty deed was tendered to be held- in escrow by the City. I Street Committee rec.eived bids of S. B. Finegan and Smith and Watkins for hard rubber tires for the City Sp~inkling Wagon and installation thereof, each bid being for $446.00. On motion it was ordered that the Street Committee award the contract to'S. B. Finegan if the tires were satisfactory. Councilman Simon moved that the Council grant leave of absence and expenses to the Chief of Police to attend the Willamette University Police School to be he Id on March 9th to 14th. The motion was seconded. and. carried. Building Inspector Rund1ett submitted prelialinar~T blue prints of proposed change~ in City Hall for Police Quarters.
