Minuties of the adjourned meeting of the Common- Council, held at the hour of 7:30 o'clock P. M., May 25, 1931. There were present Mayor H. E. Wilder and all members of the Counci 1. Meeting was called to order by the Mayor. The ~rudiciary Committee, by Chairman Edwards, reported regarding the jurisdiction of the City over the Riverw00d Park that they had obtained a search of the recorcls and from it it appeared that Eugene had no jurisdiction over ,this park, and that the trac t referred to by Mr. Lindley was outside the Ci ty Limits, and tihat the City was in no position to take such action as Mr. Lindley proposed and that the matter should be indefinitely postponed. On motion duly seconded and carried the recommendation was adopted. I The Finance Committee by Chairman Large moved that the City find that :the work donEl by the Salvation Army for the relief of unemployed in the City of Eugene dux'ing the past few months was actual emergency relief which the County and Ci.ty should ,have been called upon to meet a t the time, and that the County having paid $250.00 toward the meeting of this expense that the City should pay to the Salva tion Army $250.00 as its just proportion. The motion was seconded., The Ci ty Attorney expressed the opinion that this was not a p.roper aro.nicipal expenditure. The ayes and nays were called, Councilmen voting aye, Large, Ilamb, Hendershott, Zumwalt and Bond, nay, Reid, Simon and Edwards. ~otion was declared carried. . Mr. Ilarge also reported an offer of Geo. H. Burr, Conrad and Broom of Portland, to sell the City $25,000 City of Eugene Refunding Bonds, issued December 1911., due December 1936 at a price of 103.50, and moved that the City buy these bonds at this price out of accrued sinking funds and that said bonds be retired. Motion was seconded and carried. ChaiI'man Lamb of the Street Committee reported that property owners out on West .Eaeventh Street between Almaden and Chambers Streets were asking for the construction of sidewalks along a driveway which was reported to be dedicated to the public. It appeared that there was no record of the acceptance of this dedication by the City and that existing liens against the attempted dedication have not been satisfied, this matter was referred to the Street Committee and. City Engineer for further investigation. Bids for the purchase of fire hose were opened and read and referred to t,he Fire and Water Committee and Fire Chief Nusbaum, with power to act. Chair'man Hendershott of the Fire and Water Committee moved that the Ci ty accept an offer of the Goodrich Silvertown rnc. to charge the regular 34 x 7 tubes used in the tires of two city fire trucks, to GOOdrich air Container tubes. The eight AiI' Container tubes to cost $148.80, and they to allow the City $59.20 for exchange acceptin~ the Rresent heav~ duty tubes at that valuation, leaving a net amount to be pa~d of ~89.60. Mot~on was seconded, and the ayes and nays were called, all Councilmen voting aye, nay, none. The Recorder reported that the temporary tabernacle at the corner of 13th and Charnelton Streets has been razed, and that a request had been made that the bond. made guaranteeing the removal of this building be released, and on motion seconded and carried it was so ordered. I . Janitor Boyd's request that the Council determine the question of heat~ ing method for next winter, and if necessary arrange for fuel, was referred to Mayor Wilder. The City Recorder stated that the State Mutual Building & ,Loan Assn. of 722 South SpI'ing Street, Los Angeles, California, as Mortgagee of the Wallie Price property, of which the City has acquired title by foreclosure proceedings of a sidewalk lien contained in BOOk J, page 32, line 7, and on which the oi ty also held liens at Book J, page 103, for the Opening of Clark Street, and in Book N, page 30, for the grading and graveling of Clark Street, altogether aggregating approxima tely $228.00, de sired to purchase this property from the City to protect their mortgage interest and were willing to pay the City the full amount of all liens, penalties, interest and costs if the city would execute its deed in their favor. After some discussion the matter was referred to the Finance Gommittee and the City Recorder to report back at the next meet- ing of the Council. On motion of Chainmwl Hendershott of the Fire and Water Committee, duly seconded and carried, it was ordered that the Fire Chief, Mr. Nusbaum, be author- ized to attend the Firemen's Convention at Corvallis June 3, 4, 5 and 6th, with the expenses paid. The following resolution was presented: I . F. Keeney. rr ~J A motion was made and seconded to adopt the same. The ayes and nays were called, all'Councilman voting aye, nay, none. A Lease Agreement between the' City of Eugene and the United States of America was presented, and the following resolution read: ~~.;.., rt aESOLUTION I , I .. I Be it Resolved that the City of Eugene by its Mayor and Recorder be and are hereby authorized and directed to execute on behalf of the City of Eugene in quadruplicate the lease submitted by the Treasury Department of Washington D.C. for the lease of a room in the City Hall Building for the use of the United States ~nternal Revenue Collector. rr Motion was made and seconded and unanimously carried to adopt the resolution. Report of the Library Board for the month of April was read and filed. An Ordinance adjusting and settling a certain assessment for the cost of constructing a cement sidewalk along the East side of Willamette Street from 16th Avenue to Hospi tal Dri ve, ha ving been read the first time on May 11th, 1931, was read the second time and objections called for. Mike Dewey appeared before the Gouncil objecting to any assessment against his property. On motion the ob~ jection was over-ruled and there being no further objections, the ordinance was read the third time and placed on its final passage. The ayes and nays were called, all councilmen voting aye, nay, none. The Ordinance was declared passed and numbered 8046. I I I I I I I I 1 4. I Seven Sid.ewalk Assessment Ordinances, having been read the first time on May 11th, 1931, and registered notices for protest having been sent, and now no protests being received, said ordinances were read the second time, and passed their third readings by title by unanimous consent under suspension of the rule, and were placed on their final passage. The ayes and nays were called, all councilmen voting aye, nay, none. The Ordinances were declared passed and numbered consecutively from 8047 to 8053, both numbers inclusive. Eighty-six sidewalk improvement Ordinances were read the first time, and passed their second and third readings by title by unanimous consent under suspension of the rule, and were placed on their final passage. The ayes and nays were called, all councilmen voting aye, nay, none. The Ordinances were declared passed and numbered consecutively from 8054 to 8139, both numbers inclusi ve. I I I I I II I Mayor Wilder reported that he had attended the dedication of the bridge at G.rants Pass as a representative of the City of Eugene, and reported briefly the proceedings of that ocassion. At this time Mayor Wilder retired from the meeting, and E. Large, President of the Council, presided over the remainder of the session. An Ordinance providing for the grading and graveling of the alley running East between Broadway and Eleventh Street and South between Patterson and Hilyard Streets was read the first time, and passed its second and third readings by title by unanimous consent under suspension of the rule, and was placed on its final passage. The ayes and nays were called, all councilmen voting aye, nay, none. The Ordinance was declared passed and numbered 8140. An Ordinance approving and adopting the plans and specifications of the Oi ty Engineer for the improvement of the alley running East between Broadway and Eleventh Street and South between Patterson and Hilyard Streets by grading and graveling the same was read the first time, and passed its second and third readings by title by unanimous consent under suspension of the rule, and was placed on its final passage. The ayes and nays were called, all councilmen voting aye, nay, none. The Ordinance was declared passed and numbered 8141. A communication from Eugene Lodge No,. 357 B.. p. O. J,i;., asking the Cit,y to waive the license on the Levitt-Brown-Huggins Shows for the six day periOd beginning June 15th and ending June 20th, was read, and motion made, seconded and carried to grant the request. Councilman Edwards, as Council member of the Park Board, reported that the Park Board had met and discussed the question of the use of the Skinner's Butte .:Elk Pen and had decided that nothing would be done at the present time, but that next fall they would move the deer to the small pen on Skinner's Butte, and that the Elk would be moved to the pen on the North side of the road in Hendrick's Park, and the South side would be made available for other park purposes. Motion was seconded by Councilman Hender shott, and upon vote all Councilmen supported said motion except Councilman Edward, voting no. 1 ..'^Oii , .A,t the request of Councilman Edwards, Attorney Calkins read and dis~ cussed sections of the Charter restricting and limiting the authority of the City in the expenditure of public money. Dr. Simon reported for the Police Committee that the Taxi Cab Companys were going to meet together and work out the parking problem for themselves, and a report of the arrangemen ts would be made later to the Counc i1. Mr. C:ampbell asked that some work be done to improve the condi tion of Reed Street over a course of two blocks from Spring Drive as the same is imp~ssab1 at the present; t.ime, and the request was referred to the Street Committee with powe r to act.
