Bids for the sale of $200,000.00 Power and Light'Bonds of the City of Eugene were opened. and read, bids being received from Rufus C. Holman, State Treasurer; ,$mith, Camp & Rile.jr, Ltd. et al; and. Ferris & Hard.grove et ale On motion the bid.s were referred to the Eugene Water Board for consid.eration, and later the Eugene Water Board. returned said bid.s with a recommendation to the Qounc that the sale of the bonds be awarded. to the State of Oregon Treasury Department. Chairman Large of the Finance Committee moved that the reoommendation of the Water .' The Judiciary Committee, by Chairman Edwards, recommended to the Council the adoption of the proposed oontract with Hobi Airways, a o9rporat,ion, and on motion duly seoonded the recommendation was adopted. Porter on account of payment on 11th Street paving I assessment in the sum of $62.63 be repaid to him by the City Treasurer and proper ~ notation thereof be made on the Lien Docket for the reason that the improvement has . . been reassessedt and that there is no liability on the part of Mr. Porter and the !1 la,nd owned by him. Motion was made and seconded to adopt the recommendation, and the ayes and nays were called, all councilmen voting ayet nay, none., .Chairman Lamb of the Street -Commi ttee reported that Mr. C. F. Hyde desired to place a retaining wall about six feet into Indiana Avenue, and that the street I committee felt that owing to the location this oould be done without prejUdice to the City's interest in the street, and moved that permission be granted to C. F. Hyde to construct the wall as requested with the distinct understanding that no permanent right is granted by the City, and that Mr. Hyde or his suocessors in > business shall remove the retaining wall and any rights or privileges oonferred upon them at any time when in,the judgment of the Council it becomes necessary to l' move said wall or alter the condition of said street. The motion was seconded and carried; The quest,ion of whether the City should impose a charge upon the W.C. 'l. U for burning grass on property owned by them in the Huddleston's traot was considere , ,. /1 and motion made, seconded, and carried that no charge be entered against them for thi s service. A peti tion of C. -F. Hyde for the paving o:fChula -Vista Street from 26th Avenue North 219.4 feet was read and motion made, seconded, and carried to grant the request and directed that the ~ngineer's plans be prepared and the neoessary ordinance be drawn for, the next meeting of the COUnoil. A communication from the Oregon .Stat.e,FireMarshal, A. H. Averill, and a draft of a proposed hill relating to tank wagons engaged in transportation of volatile and flammable liquids was read and referred to the Judiciary Committee. Application of Neomi Watson for rooming house ,permit at 68 West lOth Street, having the approval of R. W. Hall, Chief of Police, was on motion granted. , . Reports for the month of August of the Police Department , Building Inspector, and ,the EUgene ,Public Library were read and placed on file. City Engineer Clubb reported the cutting or burning of grass on 1224 lots owned by 631 owners at a payroll cost of $1,242.50, and that the amount on the books due the Oi ty was $1,598.00.. Mr. ,Glubb also reported the completion of the following contract acoord- ing to the specifications: "Paving the alley between Thirteenth Avenue and Fourteenth Avenue from Hilyard to Alder Streets. Ordinance No. 8243, - June 22, 1931. Gontractor - Nels Jorgenson Finished pouring concrete August 5th, 1931 Finished curing concrete September 4, 1931 .war ran t s due October 9, 1931 , I inspeoted the work on September 4th, 1931, and found it to be comple ted ac.cord- I ing to the contract. A communication from City ~ttorney.Calkins was read giving his opinion I too t the Ci ty is authori zed to buy its own war ran ts for sinking funds. ,The following resolution was read and motion made, seconded, and carried to adopt the same: " RESOLUTION Whereas, the Oi ty of Eugene lias money on hand in what is known as the City Hall Bond ~inking fund to the amount of approximately $40,000.00, and Whereas there will be no need to use any of said fund for the retire- ment of the bo~ds of said issue for more than six months, towit, for approximately four years t ' / . Therefore, Be It Resolved by the Common Council of the City of Eugene, that the Oity Treasurer be and he is hereby ordered to invest such portions of the above named fund in such outstanding warrants of the City of Eugene, as shall be recommended in writing by the Finance Committee of the City.Council, from time to time. n An Ordinanee repealing Ordinance No. 8260, entitled ,"An Ordinance orderi a special elec~ion ~or submitting to the electors of the City of'~gene, Oregon, at such special election to be held on the 15th day of September, 1931, the follow ing proposed amend~ent to the Charter of the City of Eugene, referred to the electors of said City by the Co~mon Counoil ,for their approval or rejection, and providing for polling places and for the appointment of JUdges and Clerks of the election, and all acts necessary for the carrying on of the said election, and declar ing an emergency, n passed by the Common Council and approved by the ,Mayor on the lOth day of 4ugust, 1931, and declaring an emergency was read the first time, and passed its second and third readings by title by unanimous consent under sus~ pension of the rule, and was placed on its final passage. ~he ayes and nays were I D called, all councilmen voting aye, nay, none. On ,....... motion duly seconded, the recommendation was adopted. -- I An Ordinance levying assessments for the paving of the alley between 13th and 14th Avenues from Hilyard Street to Alder Street in the City of Eugene, Lane County, Oregon, having been read the first time on August 24th, 1931, and regis~- ered notices for protests having been sent, is read the second time and objections called for and none heard, and on motion the Ordinance was read the third time oundersuspension of the rule and was placed on its final passage. The Ordinance was declare passed and numbered 8269. 0 An Ordinance amending Qrdinance No. 8245 of the City of ~ugene, Oregon, enti tIed ,".A.,n Ordinance regulating the erection, construction, enlarge~ent, alter~- . tion, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of buildings and/or structures in the City of Eugene providing for the issuance of permits and collection of fees therefor; declaring and establishing Fire Districts; providing penalties for the violation thereof; and repealing all ordinance andlor parts of ovdinances in conflict therewith" was I read the first time, and passed its second and third readings by title by unan~ imous consent under suspensi on of the rule, and was placed on its fi:nal passage. Mayor Wilder announced the resigna,tion of H. A. Looney from the Board of I Ii Appeals and appointed Ghas. F. Goettling as a successor. On motion the appoint~ ment was confirmed by the qouncil. II ,Councilman Simon reported the unpleasant noises caused by the mufflers I of the Motor Buses on the street, and the City Recorder and Councilman :aond were authorized to take steps to abate this nuisance. 11 ~ounci~an Simon also outlined to the Council his plan ror the care of unemployed persons during the coming winter, particularly recommending a plan by I which able bodied men could be employed in cutting cord wood upon a tract of- Wood land to be a,cquired by the Ci ty, the men to be paid at a fixed rate per aord and the City to be reimbursed by later sale of this wood. The general situation as to unemployment and charity for the winter was discussed and a general desi.re expressed that something along the lines indicated should be worked out for the coming winter. No definite action was taken and the matter continued for fUrther . I plans. I Mr. Lew Swanger from the Central Labor Gouncil also discussed the question of unemployment. I A claim of Jack Dawson for medical services on account of a case of poison oak contracted in the course of employment was ordered disallowed. t On motion Council adjourned to meet at 7:30 o'clock P.
