To THE MEMBERS OF TRE Cm,IMON COUNCIL OF l'RE CI TY OF EUGENE:
I hereby call a special meeting of the COliliilon Council to meet at the Council
Chambers in the City Hall on Friday, December 15th, 1935, at 5:00 o'clock P.M.,
for the purpose of considering and passing a Resolution relating to a guarantee
to the Oregon State Highway Commission, and to the Bureau 0 f Public Roads of' the
Department of Agriculture of the United States, concerning the use of' East
Broadway Street aln Franklin Avenue, and an Agreement by the Ci ty of Eugene to
maintain Highways improved under National Industrial Recovery Act.

Pursuant to the notice of Special Council meeting, the Council was called
to order in special session by Mayor Large, at 5:00 o'clock P.M., December 15th,
1933, with all Councilmen present except Simon, Zumwalt and Edwards.
The following Resolution relating to a g~arantee to the Oregon State
I Highway Commission, and to the Bureau of Public Roads of the De~partment of
Agriculture of the United States, concerning the use of East Broadway Street
and 1!'ranklin Avenue, which resolution is hereinafter ifully set out in the minutes
" of this me e ting, was read.
Councilman Lamb moved the adoption ~f the resolution. The mo ti on was
seconded by Councilman Hendershott, and the ayes and nays were called, Council-
men voting aye: Lamb, Hendershott, Reid, Bond and Harris. Nay: None, Absent,
Councilmen Simon, Zumwalt, and ~dwards, and the resolution was declared passed.

WHEREAS, State Highway No. 1 of the- State of Oregon, known as the Pacific
Highway, is routed through the Ci ty of ~'ugene, Lane County, Oregon, a Municipal
Corporation, and the route officially adopted for said highway by the State
. Highway Commission traver~es the following street or stree ts, or avenue s, of
sai d Oi ty; to-wi t : East Broadway S tree t and Franklin Avenue.
c AND, WHEREAS, the State Highway Co~nission of the State of Oregon is
desirous of receiving Feaeral Aid for the improvement of said highway,
AND, WHEREAS, ~he Bureau of Public Roads of the Department of Agriculture
of the United States will not participate in the construction of said Highway

until and unless the said C!'ty of l!,'ugene will _guarantee by resolution officially
adopted by the City Council of said City, that no encroachments will be permitted
I upon the right-of-way of said highway within the corporate limits of said City,
which will permanently obstruct or interfere with the free and convenient flow
of traffic over said highway through said City; and will so regulate parking of
vehicles on said streets or avenues traversed by said highway that the free,
convenient and safe flow of traffic shall not be impeded; and aeree not to impose

unreasonable limitations of speed upon said highway, nor impose any regulations

ment of telephone or electric light poles or other public service facilities. I

The following agreement between the Ci ty' and the Ore~on State Highway
Commission for the improvement of 1.55 miles of highway on East 3roaaway and
F'1'anklin ..31 vd. fraIl High St1'eet to the City Limits, under Section 204 of the
I Hational Industrial Recovery Act, which agreement is hereinafter set out in the .
I minutes of t hi s me e t i ng, v,ra s read.

Councilman Lamb moved tha:t the City accept and enter into said contract and
that l.fayor Elisha Large be authorized to sign the same on behalf of the City.
The motion was seconded by Councilman Hendershott, and the ayes and nays were
I called, Councilmen voting aye, Lamb, Hendershott, Heid, I30nd and Harris, nay none,
ab sent Councilmen Simon, Zumwalt, and Edwards, arrl the motion was declared carried.

2. That the said City hereby reQuests the Highway Department to submit the
aforementioned j!roject with recommendation that it be approved by the Secretary of
Agriculture, and agrees that if such project is approved and constructed by the
Highway Department and the Secretal"'y of Agricul ture it thereafter, at its own cost
,. and expense, will maintain the pr~ject in a mamLer satisfactory to them, or their
authorized representatives, and will make ample provision each year for such
maintenance.
