I Minutes of the regular monthly meeting- of the Common Cmuncil, held at the hour of 7:30 o'clock P.M., February 13, 1934. Council was called to order by Mayor Large, with all Councilmen present. Minutes of the regular meeting of Hanuary 8, and the ad~ourned meeting of January 22, 1934 were read andapproved. Attorney Donald Husband again called to the attention of the Council the request of certain Plumbers for a reduction of the Plumber's Lioense fee and extension of the license fee to cover retailers of plumbing supplies. This matter was continued in the hands of the Sewer Committee for report. , C. A. Wintermeier, Attorney, presented a petition of residents in the vicinity of Lots 3 and 4 of Mountain View Park, asking that the ditch that was dug'from Onyx: Street Southeasterly past 25th Street be converted into a storm sewer line if any money is available for that purpose. The petition was referred to the Sewer Committee and Engineer. Attorney Gordon Wells stated that the City Treasurer had, several years before, issued a certificate that there were no Ci ty liens against the portion of the South 100 feet of Lot 4, Block 1, Chambers Addition, and that it had developed that there were liens for paving in the sum of $58.47 and for sidewalk in the sum of $36.66. He asked the City to-remit the accrued interest on these assess- ments. Motion was made and seconded that the same be remitted and the^ayes and nays were called, Councilmen voting aye, 8, nay, none. The motion was carried. Mr. Wells also presented the objection of Mr. Willis Ghamberlain to the , further raising of the grade of East Broadway on the West side of the Southern Ii Pacific right of way, and was advised that the City had communicated with the Ii Southern Pacific Company requesting that the grade at this point be allowed to !;! remain as planned without the further raising, and that if the Company conceded this his client would be satisfied. The Recorder was instructed to receive and hold liquor applications, collecting the fee of $5.00 in advance on all applications, and to communicate with the State Liquor Commission to determine its position with reference to the City's investigation of applications, and that if the Commission requested this investigation b~ the ci ty, the Recorder should refer all applications on which the advance fee of '5.00 had been paid, to the Police Committee for investigation and report to the Council. The Finance Committee by Chairman Hendershott recommended that the City pay $25.00 per month as one-half of the rental of the Yates Hotel for transient refief, and a motion was made and seconded that for the months of January, February, :March, and April the Recorder be instructed to draw a warrant on the Relief Fund for $25.00 in favor of F. L. Chambers. The ayes and nays were'called, Councilmen voting aye, 8, nay, none. .' Councilman Bond did not join in this report, thinking that possibly the City would be money ahead to work out the proposition along the lines suggested by Mr. Estes, but the question of establish- ing a precedent of compromising on City liens determined the action of the Council, which on motion adopted the report of Chairman Lamb. City Attorney Calkins reported on the proposal of Hugh H. Requests for commercial wood sawing locations of L. L. Lamb, 436 Lincoln Street, James Lajoie" 90 N. Lawrence Street, and C. G. Bauer, at the Northeast corner of Lawrence and Cheshire Streets, all of which were recommended by Chief BePgman, were on motion granted. -I The City Treasurer requested instructions as to the distribution of the $650.00 received from the Boxing Commission and held to the credit of the Civic Emergency Fund. ,A motion w~s made and seconded that he be instructed to disburse this money 60"per cent, or $390.00 to the various Veteran's. organizations and 40 per. cent, or $260.00 to Mrs. Ella Richardson, Police Matron. The ayes and nays were called, Councilmen voting aye, 8, nay, none. The motion carried. Monthly reports for January, 1934 of the City Engineer,~ Eugene Public Library, Police Depart~ent and Fire Department were placed on file. The Recorder's Annual report of City Finances was submitted and a copy furnished each member of the Council, the Mayor, and Attorney.. - , A communication from Victor P. Morris was read aonveying his ~cceptance as member of the Planning Commission. . Communication from Frederick D. Stricker was read, stating that the State Board of Health had approved the preliminary plans for the construction of a sewage treatment plant at Eugene. The Park Board, by Helen Kerr Maxham, Secretary, presented to the Council a proposal for three 3 foot tables, and three 12 foot tables for use in Skinner's Butte Park; quotin.g prices from the Midgley Planing Mill Co. for these tables in the total sum of $24.37. Also recommended that an eaves trough be put upon the Elk shed in Hendrick's Park, and that drain tile be provided and laid to drain the elk pen. Councilman Harris moved that these plans have the approval of the Council, and the expenditure be authorized, which motion was seconded and carried. Dr. Harris also recommended the appointment of Robert Schiska as a special officer for the City Park, stating that he was willing to assume this position without pay, and on motion duly seconded. and carried the appointment was made. Council~an Harris called attention to a need 6f a woodshed and tool house at Skinner's B~tte Park, and the advisability of widening the road in the Park, and the erectiQn of directing signs and other signs for the protection of shrubbery and control of ,dogs, and other matters looking to the improvement of conditions in the Ci ty Park. e Mrs. Howard Hall called the attention of the Counail to an old dilapidated building opposite the Hall residence at 1991 Garden Street, which had not been occupied for 8 .years unle ss by hob os or transients.. The matt er was referred to the Health Committee, Chief of Police, and City Attorney. The Recorder presented the offer of Mrs. C. C. Misfeldt to sell her 80 x.lOO foot lot and b~ildings in Skinner's Butte, Park for a consideration of $40.00 per month without ~nterest over a periOd of 6 years. The motion was made, seconded and carried to reject the offer. I .: The ReCQrder reported that under the approval of the Finance Committee and' ~~yor, the Tre~surer had exchanged a $1,000.00 Portland Water Bond; due June 1, 1938, which had.. been held by our Sinking Fund for a $1,000.00 City of Eugene General Refunding Bond, due December 1, 1936, with Camp and Co. of Portland. They paying 1/4 of qne per cent difference on the Bonds with interest computed at even date of exchang~. On motion, duly seconded and carried, the exchange was approved by the Council., Motion was made and seconded that the Recorder include with the monthly salary warrant pf Dr. L. G. Helterline an additional sum of $15.00 per month for expense account, of gas and oil. The ayes and nays were called, Councilmen voting aye 8, nay none., and the mot ion was carrie d. The Recorder presented an offer from the Committee on Arrangements, of the Church of the Nazarenta suggesting a contract with the City to take care of. delinquent City. assessments, interest, and taxes, in the event that they were able to secure a tit~e from the parties owning property at 8th and Madison Streets. On mbtmon the matt~r was referred to the Finance Committee with authority to enter into such contract for payment as they deemed advisable. Communications were presented frOm the President and Secretary of the Eugene Central Labor Council; President and Secretary of the Master Plumbers; and President and Secretary of the local union No. 481 of the association of Journey- man Plumbers and Steam Fitters, in behalf of those organizations, urging the appointment o:f a qu.ali:fied Plu.mbing Inspector, and partieularly recommending 1Jlr. 1 '. ~!I . ~ 251 _._--- -- ------ ,~ Montie Lesley for the position of Plumbing Inspector. RESOLUTION .: WHEREAS, the Common Council of the City of Eugene has observed with great satisfaction the highway improvements being made in this section of the state, all of which furnish avenues of approach to and from the City of Eugene, and WHEREAS, the Common Council has interviewed and secured from the Hon. Carl G. Washburne a general statement of the activities of the Highway Commission and the development work being carried fo~vard by them, and \VHEREAS, criticisms have been launched at various times which the Council feels to have been unauthorized and unjust. tending t'o leave an impression with the State Highway Commission of a lack of appreciation of the splendid work being done by that body for the state in general, and for thi s portion 0 f the sta be in part- icular, THEREFORE 1 BE IT RESOLVED BY THE C01~ON COUNCIL OF THE CITY OF EUGENE: That the development and maintenance work being carried on in the State of Oregon, a1nd in this portion of the state in particular, by the state Highway Commission, is, in the juqgment of the Common Council of the City of Eugene, being carried forward in a most intelligent and disinterested manner, and the Common Council desires too t there be communicated to the State Highway Commission its strong endorsement of the Policies being carried fo.r:ward by the Commission and its appreciation of the services rendered to the state in general, and to this vi~inity in particular. .: BE IT FURTHER RESOLVED: That the City Recorder be and he is hereby directed to spread this Resolution upon the Council's record, and to forward a copy to the State Highway Cemmission on behalf of the City CoUncil. Passed by the COiDmOn Council this 13th day of February, 1934. -0- The following Resolution was read and motion made, seconded and carried for its adoption: , ]. 1,., RESOLUTION WHEREAS, heretofore and on the 28th ~ay of August, 1925, the 9ity of Eugene, having improved Madison Street from Fifth Street to Cheshire Street by paving the same, and having apportioned the cost thereof, caused to be placed upon the R~~order's Lien Docket a lien against Lot 1, Block A of Mayhew's Addition to Eugene drawing 6 per cent from said date, and the owners thereof having made applic~tion under the Bancroft Bonding Act for ten years in which to pay the same, and now at I this time, no payment having been made thereon and the owners having neglected and refused to pay the. sum or sums due and payable thereon for said ~riod, The Council now, by reason of such neglect and refusal to pay the sum or sums aforesaid, declares L. H. Green and Tillie K. Green, husband and wife, have made, executed and delivered to the City of Eugene, a municipal corporation, a bargain and sale deed for Lots 1,2,3,6,10,11,12 and the West 100 feet of Lots 7 and 8 in Block 25, College Hi'll Park Addition to Eugene, Lane County, Oregon, _pursuant to a relin(!uishtnent of the property because of the City's claims for street assess- ments, and the property being delin(!uent as to taxes, the purpose being to avoid the cost of a foreclosure by the City. BE IT RESOLVED by the Common Council of the City of Eugene that at any time that the City has an opportunity to 1;Lell the property herein desc,ribed, that the Recorder be and he is hereby directed to mail to Paul D. The ayes and nays were called, Councilmen voting aye, 8, nay, none, absent none. The Ordinance was declared passed and numbered 8379. An Ordinance declaring the intention of the Common Council of the City of Eugene to make a reassessment of the cost of paving Sixteenth AVelllle East from the East line of Willamette Street to the West line of Alder Street as the same abuts the property hereinafter described, and fixing a time and place for holding a meeting of the Common Council, at which all protests against such reassessment shall be heard, and directing the giving of notices, was read the first time, and passed its second and third readings by title under suspension of the role by unanimous consent of the Council, and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye, 8, nay, none. The Ordinance was declared passed and numbered 8380. 1 An Ordinance authorizing the City Recorder and City Treasurer to accept Home Owners Loan Corporation Bonds in payment of assessments for Streets, Sewers and Sidewalks, was read the first time, and passed its second and third readings by title under suspension of the rule by unanimous consent of the Council and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye, 8, nay, none. The Ordinance was declared passed and numbered 8381. An Ordinance for the preservation of quiet and order in the City of Eugene, and regulating the consuption of intoxicating liquors in public places, was read the first time and passed its second and third readings by title under suspension of the rule by unanimous consent of the Council and was placed upon its final passage. The ayes and nays were called, Councilmen voting aye, 8, nay, none. The Ordinance was declaBed passed and numbered 8382. Councilman Hendershott .reported that the Rifle Club were planning to in.stall a rifle range in the basement of the building at 931 Oak Street; and it appearing to the Council that care was being taken to install the same in a manner to prevent possible accidents, no objection was raised in the Council to the plans of the Rifle Club. e. Communication from the Cashman Realty Company in regard to an assessment on part of Lot 1, Block~, Cherry Grove Addition was referred to the Judiciary Committee and City Attorney. It was reported that the red lights at lOth and Mill streets had been removed, and on motion it was ordered that a new red light be installed at this point. 1 Estimates for the cost of repairs to the City Hall were submitted by 1~. Mosher, Building Inspector, and on motion duly seconded and carried it was ordered that the City proceed if C.W.A. funds can be secured for this purpose. Councilman Hendershott moved the adoption of the following Resolution and the same was seconded and carried. RESOLUTION WHEREAS, on February 6, 1934, Honorable Hal E.. NOW, THEREFORE, be it resolved that we deplore the death of this beloved State Officer and the loss of an outstanding citizen, Whose code of honor, integrit' and idealism was an active influence for .the welfare of this great state. Be it further resolved that this resolution be spread upon the minutes of this meeting and that a copy be mailed to the family of the d~parted as an expression of our deepest sympathy in this hour of bereavement. .
